The review has been completed on the renewal request your company submitted for the
referenced mine site. However, the following is needed to continue processing your
application:
The reclamation bond was calculated for this site using the information submitted on the
revised mine map. The reclamation bond for this site has been calculated to be $83,800.00.
The calculation worksheet is enclosed for your review and the bond or balance ($13,608.92)
will be required prior to approval of this modification renewal.
For your convenience, I have enclosed a bond form, an assignment of a savings
account form and irrevocable standby letter of credit form for your use in securing the required
bond. The name on the security must be the same as the name appearing on the application
for a mining permit, i.e., North American Emerald Mines, Inc. In addition to one of these
alternatives, you may, upon request, substitute a cash deposit.
P-lease-be-advised--that-the-renewal-request cannot be completed -until -the -new bond -
amount has been received.
As required by G.S. 74-51 (h), you are hereby advised that you have 60 days from the
date of your receipt of this letter to submit the reclamation bond. If you are unable to meet this
deadline and wish to request additional time, you must submit information, in writing, to the
Director clearly indicating why the deadline cannot be met and request that an extension of
time be granted.

In response to your request for information letter dated August 23, 2011 please find
below and attached the requested information by the number as specified in your
correspondence:
1. Clearly define which sediment diversions are associated with each trap
• Sediment Trap ST-9 receives runoff flow from DB-6 which then flows into DB-5
and offsite after leaving the trap
• Sediment Trap ST-1 receives runoff flow from D-3 and DB -1 which flows to SD-
1 then to DB-4 and on to SD-3. ST-1 also receives flow from D-2.
• Sediment Trap ST-2 receives runoff flow from DB-2 which flow to SD-2, then to
DB-3 and SD-4. ST-2 also receives flow from D-1.
• Sediment Trap ST-4 receives runoff flow from DB-9.
• Sediment Trap ST-3 receives runoff flow from diversions D4, D-5, C-2, D-6, D-
7, C-1, D-9, DB-7 & D-8.
• Ditch D-10 does not flow into a sediment trap but into the pit.
• Sediment Trap ST-7 receives runoff flow from the general area and is an existing
structure.
• Sediment Trap ST-8 receives runoff flow from DB-10 and DB-11.
• Sediment Trap ST-5 receives runoff flow from DB-8 and D-11.
• Sediment Trap ST 6 receives runoff flow from D-12
See attached maps MP-2 and MP-3 for more information on the diversion flows.
2. Clarify Limits of Clearing
The existing County/Town road right of way was shown as the limits of clearing in the
legend and has been relabeled in the legend on the attached maps.
3. The surface area of ST-3 should be increased due to impervious area of Parkin¢
lot. The trap should have a high C-Value and possible change to basin.
Sediment Trap ST-3 is an existing trap/basin that receives runoff flow from an area that is
stable and during a June, 2011 inspection it appeared to be functioning properly. The C-
value for the gravel, paved and roof areas used to calculate the flows in ditches D-4, 5, 6
& 7 are in the higher range and appear to be appropriate. It should also be noted that the
parking area is small and runoff flow from the west side of the parking area flows to the
north and away from the area in question.
4. Ensure that ST-7 does not discharge into ST-S
ST-7 is an existing trap/basin which discharges south from the basin and flows downhill
to the east and into a natural draw. ST-8 discharges into a wooded area to the south.
See attached trap calculation sheets with new spillway design. The summary sheet shows
the minimum length, where the calculated length was shorter.

We have reviewed the Renewal request you/your company submitted for the referenced
mine site. However, the following information is needed to continue processing your
application:
Please clearly define which sediment diversions are associated with each trap.
Some diversions appear to by-pass the intended trap.
The limits of clearing appear to extend into the Esmeralda mine site. Please
clarify on the map.
3. The surface area of ST-3 should be increased because of the imperviousness of
the parking lot. The trap should have a high C-value and may need to be a basin
rather than a trap.
4. Ensure that ST-7 does not discharge into ST-8.
5. All spillways must be designed to pass a 25 year 24 hour storm event. Revise
the Sediment Trap Chart to reflect this.
Please note, the Land Quality Section may request additional information, not included
in this letter, as the mining application review progresses.

The reclamation bond has been calculated using the information submitted on the
revised mine map. The reclamation bond for this site would be $83,800.00. The calculation
worksheet is enclosed for your review and the new bond or balance ($13,608.92.00) will be
required prior to approval of this renewal request.
For your convenience, I have enclosed a bond form, an assignment of a savings
account form and irrevocable standby letter of credit form for your use in securing the required
bond. The name on the security must be the same as the name appearing on the application
for a mining permit, i.e., North American Emerald Mines, Inc.. In addition to one of these
alternatives, you may, upon request, substitute a cash deposit.
Please be advised that our review cannot be completed until all of the items listed
above have been fully addressed.
In order to complete the processing of your application, please forward two (2) copies of
the requested information and the bond to my attention at the following address:

As required by 15A NCAC 5B.0013, you are hereby advised that you have 180 days

in writing, to the Director clearly indicating why the deadline cannot be met and request that an
extension of time be granted. If an extension of time is not granted, a decision will be made to
grant or deny the mining permit based upon the information currently in the Department's files
at the end of the 180-day period.
Though the preceding statement cites the maximum time limit for your response, we
encourage you to provide the additional information requested by this letter as soon as
possible. Your prompt response will help us to complete processing your application sooner.

The modification of recent submittal dated July 26, 2011 and received in MRO on July 28, 2011 with
suspense date for comments August 19, 2011 was reviewed. I have the following comments.
01 Please increase the surface area for St-3. The equipment /parking area should have a high
value of "C". The ST-3 should be sediment basin instead of sediment trap.
20 Please make sure ST-7 should not outlet in ST-8.
QThe spillway capacity should be designed based upon the 25 year-24 hour storm.

Following are my review comments. I was at the site on April 27, 2011 for the annual inspection.
1. Flow from SD-2 appears would bypass SD-4 to send flow into ST-2, but would flow to SD-3 into ST-1. Provide
Iculations to show ST-1 can handle this Flow or provide adequate means to ensure flow from SD-2 would be directed to
ST-2.
The "Proposed Maximum Clearing Limits" extend onto the Esmeralda Exploration International site.
Page 2 of the permit application should reflect the new 'Total Permitted Acreage" as 94.36.44M
With the changes in the affected areas table, does this change the bond amount?
