All aspects of the mine site must be clearly labeled on the maps along with their corresponding (approximate) acreage. As a reminder, mining permits can only be issued for up to 10 years; thus, ant and reclamation maps must only denote those activities that are intended to be conducted during the life of the mining permit. All maps must be of a scale sufficient (see minimum requirements listed be to clearly illustrate the following, at a minimum: a. Property lines of the tract or tracts of land on which the proposed mining activity is to be located including easements and rights -of -way. b. Existing or proposed permit boundaries. c. Initial and ultimate limits of clearing and grading. d. Outline and width of all buffer zones (both undisturbed and unexcavated). e. Outline and acreage of all pits/excavations. f. Outline and acreage of all stockpile areas. gg Outline and acreage of all temporary and/or permanent overburden disposal areas. h. Location and acreage of all processing plants (processing plants may be described as to location and distance from mine if sufficiently far removed). i. Locations and names of all streams, rivers and lakes. j. Outline and acreage of all settling and/or processing wastewater ponds. k. NOTIFICATION OF ADJOINING LANDOWNERS The "Notice" form, or a facsimile thereof, attached to this application must be sent certified or registered mail to all landowners who are adjoining (contiguous to) the permit boundaries as indicated on the mine map(s). The only exception to the above is if another means of notice is approved in advance by the Director, Division of Land Resources. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Sufficient buffer shall be maintained between any affected land and any adjoining waterway to prevent sedimentation of that waterway from erosion of the affected land and to preserve the integrity of the natural watercourse. The stream crossing of the access road shall be stabilized. 4. Adequate mechanical barriers including but not limited to diversions, earthen dikes, brush barriers, silt check dams, silt retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in proximity to the affected land. Erosion and sediment control measures indicated in the Application for Mining Permit submittals shall be installed. Additional measures shall be installed as needed. 5. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause offsite damage due to siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. 6. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 7. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public thoroughfares whenever practical to screen the operation from the public. 8. Sufficient buffer shall be maintained between any excavation and any adjoining property line to prevent caving of that property and to allow grading of the sideslopes to the required angle. A minimum buffer of 50 feet shall be maintained between the mine area and any adjoining property lines. 9. A physical barrier consisting of a fence or boulder barriers, etc., shall be maintained around the perimeter of any highwall. 10. An Annual Reclamation Report shall be submitted on a form supplied by the Department on February 1 of each year until reclamation is completed and approved. Page 4 of 7 11. The security which was posted pursuant to N.C.G.S. 74-54 in the form of Two Thousand and Five Hundred Dollar ($2,500) assignment is sufficient to cover the operation as indicated on the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 12. Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. Page 5 of 7 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: 1. Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to backfill, grade and revegetate all disturbed areas. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. Unweathered rock shall be backfilled first into any excavation, followed by red clay (subsoil). B. Topsoil shall be stockpiled during mining and evenly respread after backfilling the excavation. Page 6 of 7 C. Any sideslopes shall be graded to a 2 horizontal to 1 vertical or flatter grade. D. All settling ponds shall be backfilled and stabilized. E. Any diversions or channels shall be stabilized. F. Terracing and contouring shall be used to enhance revegetation. G. No contaminants shall be dumped at the mine site. Scrap metal, trash or other such waste shall be removed from the site and properly disposed. H. The affected land shall be graded to prevent the collection of noxious or foul water. 3. Revegetation Plan: Site Preparation Grade and shape area to repair gullys and fill low places. Lime and Fertilizer Apply 2 tons finely ground dolomitic limestone per acre plus 200 lbs. of triple superphosphate. At seeding apply 800 lbs. of 5-10-10. Seedbed Preparation Work lime and fertilizer into the soil to a depth of 3 or 4 inches. On slopes too steep for conventional equipment (2 horizontal to 1 vertical or steeper) use hand tools to scatter and mix materials or hydroseed. Establishment with seeds Apply grass and legume seed with a rotary seeder to prepared seedbed, then cultipack. Use proper varieties, rates and seeding times. Mulch Apply 1-2 tons straw or hay per acre or until 25% of ground is visible. Anchor mulch on steep slopes with slats or plastic neeting. Use plastic netting in areas of concentrated flow. Maintenance Control competition from brush and weeds by bushhogging. Lime every 4 years using 2 tons per acre. Fertilize in late winter with 400 lbs. of 5-10-10. Apply in early fall if legume is developing better than grass. Recommended seeding rates, varieties, and times of year for critical area treatment.
