Response to Comments—Permit Transfer Request

Dear Corey:
On behalf of Rose Brothers Paving Company(RBP),Smith Gardner, Inc.(S+G) is responding to
comments dated January 4, 2024 (copy attached) for the permit transfer request for the Grit
Pit Mine located near Rich Square,NC. Please find each comment in italicsfollowed by current
response or progress in bold below.
1. A recent inspection report date December 19,2023,noted deficiencies regarding the E&SC
measures,boundary markers,and the need fora stormwaterpermit. These items are also
identified in the additional information request dated December 21, 2021. Please provide
proof that these deficiencies have been addressed.
The facility obtained stormwater coverage in March of 2021 with a certificate of
coverage (NCG020974) under the General Permit NCG020000 for mining activities. A
copy of the certificate of coverage is also provided herein. The current mine map has
been updated to show SCMs installed at the facility. Per a phone call with your office
on January 29, 2024, and the mine being inactive, boundary markers have been
installed along the eastern and southern buffers. Prior to mining activities resuming,
and any expansion of the affected acreage, additional boundary markers will be
installed to prevent breaches into the undisturbed buffer.
2. On the provided mine map, the total disturbed acreage is listed as 48.8 acres. Rose
Brothers Paving is currently bonded for 49.02 acres at this site. Please address the
proposed reduction in affected acreage.
The reduction in acreage is a result of improved and more accurate mapping abilities.
3. The mine map shows a haul road that breaches the undisturbed buffer on the south-east
section of the site. Please clarify why this was done and what is proposed to prevent it
from reoccurring.
See response above regarding installation of boundary markers.

4. A 2023 reclamation report was not found which is a violation under reclamation
guidelines.
It is our understanding that the report was previously submitted in August 2023. A copy
is provided herein.

We have reviewed the permit transfer request your company submitted for the referenced mine site. In order for
this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and §74-51 of the
Mining Act of 1971, please provide the additional or revised information in accordance with the following
comments:
1. A recent inspection report dated December 19,2023,noted deficiencies regarding the E&SC measures,

information request dated December 21,2020. Please provide proof that these deficiencies have been

We have reviewed the transfer request your company submitted for the referenced mine site. In order for this
office to complete its review of the referenced project in accordance with CIS 74-50 and 51 of the Mining Act of
1971,please provide the additional or revised information in accordance with the following comments:

I. A recent inspection indicated erosion and sediment control measures out of compliance as required by
condition 3A. Please address erosion and sediment control measure to ensure no off-site sedimentation.
2. A recent inspection indicated mining permit boundaries were not marked as required by condition 5 of the
mine permit. Please mark affected area boundaries.
3. A recent inspection indicated refuse pile of asphalt on site,which is a violation of mining pennit
condition I OA. Please remove refuse or other solid waste generated from outside the permit.
4. Please obtain and provide proof of an NCG020000 stormwater permit.
