I will respond to each item in the order of your letter for clarity. 1. The buffers between the mining limits and the permit boundary have been clarified on the mine map. This is a very simple mine plan, with the permit boundary defined by well established farm ditches and the existing farm road. For clarity, the buffer has been labeled as 40 feet unexcavated. 2. These structures were addressed in the initial application, and in the previous ADI letter response dated March 28, 2022, item 7. These structures will be removed as the excavation extends into this area. However, they have been added to the mine map for clarity. 3. The dewatering basin is temporarily located in the southwest corner of the current mining area. This has been added to the mine map. Since the existing mining area will be allowed to fill with water and serve as a large pond, the dewatering basin will no longer be necessary upon approval of this modification, and utilization of the large pond. 4. Bruce Conway Jr was sent a notification in the initial permitting process in 2022. A Notice has been sent to Starflite Holdings. Certified Mail Receipts for both notifications are attached. 5. The acreage table has been corrected. 6. As explained in the previous ADI letter response dated March 28, 2022, according to the NPDES permitting rules, a Pumping Operation and Monitoring Plan is required when the pumping could possibly draw down groundwater levels to impact a nearby wetland or waterway. According to two reviews by the US Army Corps of Engineers, there are no wetlands or streams in the vicinity of the mining area. The only jurisdictional feature is an agricultural ditch near the current mining area, and since the pumped water discharges into this ditch, it is impossible for it to be impacted by any groundwater drawdown. The precise location of these ditches is clearly and permanently recorded in existing and older air photos, public GIS data, as well as agricultural soils maps. The mining area can be very simply calculated by a trapezoidal area measurement and calculation. The boundaries can be easily be marked in the field using the ditches. These boundaries can be easily confirmed at any future date by comparison with air photos or soil maps, and subsequent confirmation by trapezoidal area calculations. 8. As explained in the original approved mine map, the reclamation plan is simply to leave the mining areas as ponds. However, a separate page showing only the ponds is included. We trust that this information will allow you to complete your review of this modification request. Please let me know if you need any additional information. In order for this office to complete its review of the referenced project in accordance with N.C.G.S.§74-50 and§74-51 of the Mining Act of 1971, please provide the additional or revised information in accordance with the following comments: 1. Buffers are not labeled/shown on the proposed area to add land to the permit boundary. Please indicate the offset distance for the buffer and whether they will be unexcavated or undisturbed on the Mine Map. 2. The inspection report,and satellite imagery, indicate that a structure is inside the permit boundaries on the north-east portion of the currently permitted area and not shown on Mine Map. Please add all structures within the permit boundary to the Mine Map. 3. The inspection report, and satellite imagery, indicate that the dewatering basin for the existing mine is not located as shown on the mine map. Please update the Mine Map to show the current location of the dewatering basin. 4. Property owners Bruce Conway Jr and Starflite Holdings, both North of the acreage to be added, are within 1,000 feet of the proposed mining permit boundary to be added to your mining permit. Please provide proof that they have been notified such as Certified Mail receipts. 5. The acreage table values on the Mine Map don't add up. Please adjust the acreage table to indicate the increased acreage. 6. To protect the surrounding wetlands and streams, please provide a pumping O&M plan. 7. Please clarify how acreage can be accurately calculated and how boundaries in the field can be marked accurately. 8. Please refer to Section D of the mine permit application and provide a reclamation map that clearly illustrates the reclamation plan for the entire site. The map should clearly illustrate the post mining use of the entire site. It shoruld also include all italicized items listed in the application. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
