In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: 1. Please fill out the acreage table found on Page 4 of the permit application.As this is a new permit,only the column labeled"Total Affected Acreage"will need to be completed. 2. Please add the applicant's name to all mine maps, "Carolina Aggregate Sand Holdings LLC." 3. Identify all hydrogeologic features(wetlands,watercourses,waterbodies, etc.) on the map 4. Provide a plan detail, construction specs, and specific maintenance requirements for all proposed erosion& sediment control measures included on the plan. 5. Please provide construction drawings and maintenance requirements for all E&SC measures including but not limited to silt fence, construction entrance, stilling basins, energy dissipators, etc. These measures should also be shown on the mine map with lines/hatching/symbols and an updated legend as needed. 6. Show the location of all culverts/pipes for the access road on the mine maps. 7. The stockpile, fuel storage and processing equipment are located directly in front of the silt pond and would restrict the flow of water into it. How will water flow through this area into the basin/pond? Sheet flow into basins is discouraged. Discharge water into the basin in a manner to prevent erosion (diversions, berms, etc.). Provide a stable conveyance from diversions into basins (i.e. rip rap lined channel, slope drain,tarp, etc.). 8. Please provide design calculations for the silt pondibasin and diversion ditches. Detail notes (cross-section) on maps C-02 and C-03 show a haul road inside an undisturbed buffer. Undisturbed buffers may not have any land disturbing activity at all within them.Unexcavated buffers may be disturbed for E&SC measures, berms and haul roads, etc., but may not be excavated. Please revise the detail and include any permanent haul roads on the mine maps. 10. There are two areas on the mine maps, the south-western corner and the eastern most corner on the north side of the proposed permitted area,where the"Center of 6' Berm"line runs through the line for the"Excavation Area"indicating the berm running inside the excavation area.Please revise these lines so the berm is not in the excavation area. 11. Please refer to Section D of the mine permit application and provide a reclamation map that clearly illustrates the reclamation plan for the entire site. The map should clearly illustrate the post mining use of the entire site. It should also include all italicized items listed in the application. 12. To determine whether the operation will have unduly adverse effects on potable groundwater supplies, wildlife,or fresh water,estuarine,or marine fisheries,please provide a surface water delineation of the proposed permit area.Streams on and adjacent to the property may be subject to the Tar-Pamlico Buffer Rules.Impacts to surface waters that are above the General Certification threshold would require a 401 Water Quality Certification. 13. The application has not been signed by an officer of the company. Matthew Pipkin is not listed as an officer or managing member of Carolina Aggregate Sand Holdings LLC in the public filings on the Secretary of State Website.An officer of the company will need to sign page 1 and the land entry agreement on page 19 of the application or provide proof that Matthew Pipkin has signature authority for Carolina Aggregate Sand Holdings LLC. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
