Dear Mr. Williams:
We have reviewed the modification request you submitted for the referenced mine site. In order for this office to
complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of
1971,please provide the additional or revised information in accordance with the following comments:
1. Please clarify the name of the applicant for this mine permit modification. The current permit is issued
to "Prize Management LLC DBA Sand Ridge Materials." If your intent is to transfer the permit to
"Alton Williams, Jr."you must provide the items required in the TRANSFER Checklist. If the name
of the applicant was provided in error, please provide a corrected version of pg. 1 and the land entry
agreement.
2. Your response to C.3.0 in the application states that you intend to dewater, however you have left the
estimated rate and response to impact to nearby wells blank. Map Sheet C-00, as well as the cover
letter for the Erosion and Sediment Control (E&SC) calculations state there will be no dewatering.
Please clarify your intent to dewater the excavation. Please provide the details to C.3.0 in your
response. Please clearly indicate and label on the mine map wells that are located within 500' of the
excavation.
3. Please clarify the proposed life of the mining operation. The information on pg. 3 states 3 years and
the information on pg. 14 states 20 years.
4. Please provide proof that the NOI for the NPDES Stormwater permit has been submitted.
5. Your response to C.3.B in the application states that there will be no discharge to waters of the state,
however there are outfall locations shown on the mine maps. Please clarify your intent to discharge
water from the mine permit boundary.

6. N.C.G.S. §74-49 defines "affected land" as the surface are of land that is mined, the surface area of
land associated with a mining activity so that soil is exposed to accelerated erosion,the surface area of
land on which overburden and waste is deposited, and the surface area of land used for processing or
treatment plant, stockpiles, nonpublic roads, and settling ponds. Please clearly indicate and label on
the mine map that the haul road to the nearest public road is included in the Mine permit boundary.
7. Increasing the boundary to include the above items will require notice to adjoining landowners. Please
provide proof, such as copy of the signed return receipts from certified mail, that TOWN OF
GARYSBURG; FITZHUGH,ANDREW E; MITCHELL, GRACIE; MITCHELL,VITA;WILLIAMS, LARRY
DUANE WILLIAMS; MAYO,SHAVON POWELL; SEABOARD COASTLINE RAILROAD; and the Chief
Administrative Officer of each county and municipality in which any part of the permitted area is
located,have been properly notified.
8. Please provide proof of access easement or right of way agreement.
9. Please clearly identify and label on the mine map the location of fuel tanks, solvents,or other chemical
reagents stored on site.
10. Your response to D.5 states that as part of reclamation the plant and stockpile areas will be graded for
positive drainage to the mine area and that the plant will be removed, however the plant and other
infrastructure is shown on the reclamation map. Please clarify your reclamation plan and provide a
map that accurately reflects the site reclamation details.
11. Your response to D.2 states that an excavated or impounded body of water will not be left as part of
reclamation,however your mine maps show lakes as mine reclamation. Please clarify your response.
12. Please clearly indicate and label on the mine map the location of the E&SC control measures,including
silt fence.
13. The cover letter for this modification was dated February 26, 2020 and the mine map was last revised
January 15, 2020, however this submission was not received until March 13, 2023. Please verify that
these dates are accurate.
14. Please clarify your response to C.B. How do you intend to prevent inadvertent public access to the site?
15. Please clearly indicate and label on the mine map the location of any pumps and discharge locations
for the newly proposed mine excavation area.
16. Please provide proof that the wetlands and affected area boundaries have been clearly marked on site.
Markings should be clearly visible and marked at 100 foot intervals unless the line of site allows for
larger spacing intervals.
Please note, this office may request additional information not included in this letter, as the mining application
review progresses. Be advised that our review cannot be completed until all of the items listed above have been
fully addressed.

As required by 15A NCAC 513.0113,you are hereby advised that you have 180 days from the date of your receipt
of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request
additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot
be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be
made to grant or deny the mining permit based upon the information currently in the Department's files at the end
of the 180-day period.
Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the
additional information requested by this letter as soon as possible. Your prompt response will help us to complete
the processing of your application sooner.
