PO Box 1668 Kings Mountain,NC 28086 RE: Imerys Mica Kings Mountain Mining Permit No. 23-03 Cleveland County Broad River Basin Dear Ms. Shuford: We have reviewed the modification request your company submitted for the referenced mine site. In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: 1. Only a portion of the Neisler site is proposed for release. Please provide geographic controls (metes and bounds, coordinates, etc) for the boundaries that will remain after the release of the northern and western portion of the Neisler site. 2. Please update the acreage table (found on page 4 of the application) to reflect the site both before modification and as it is proposed for post-modification and the release of several areas. The letter included with the application, dated June 24, 2024, indicates that 244.27 acres of affected land are proposed with this application, but the acreage table indicates 119.16 acres. In addition, the row for "Total Permitted Acreage"remains constant at 447.39 through the table though the previous permit and included letter indicate the sites current"Total Permitted Acreage"to be 828.32 acres. 3. It is unclear from the application what the reclamation plan will be for the area to remain permitted after this modification. Please provide an updated Reclamation Map and Reclamation Plan for the site. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
