Dear Mr. Keller:
We have reviewed the application your company submitted for the referenced mine site. In order for this office to
complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of
1971,please provide the additional or revised information in accordance with the following comments:
1. Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining
landowners and chief administrative officer of each county and municipality have been properly
notified. Proof of notice to DANIEL HEFNER and JOEL LEWIS has not been provided.
2. N.C.G.S. §74-49 defines "affected land" as the surface are of land that is mined, the surface area of
land associated with a mining activity so that soil is exposed to accelerated erosion,the surface area of
land on which overburden and waste is deposited, and the surface area of land used for processing or
treatment plant, stockpiles, nonpublic roads, and settling ponds. Please clearly indicate and label on
the mine map that the haul road to the nearest public road is included in the Mine permit boundary.
This acreage must be included within the mine permit boundary.
3. Please clearly identify and label on the mine map the adjoining landowners who are adjoining the haul
road. Please provide proof that these adjoining landowners have been notified.
4. The mine permit boundary as denoted in the legend by a line with squares does not encompass all the
affected area. The buffers are shown outside this line. The haul road is shown outside this line. The
mine permit boundary must include all affected areas. The Limit of Excavation line may show only
the areas where excavation is to occur. Please clearly label on the mine map the proposed mine permit
boundary.
5. The mine permit is listed in the legend several times, as "Mine permit boundary", "permit/process
areas", "buffer permit limits". Please clarify your area designations and update your mine map.

6. Please clearly label and identify on the mine map all haul road internal to the mine permit boundary.
The mine map shows an access road terminating at a buffer. Haul roads are not shown to access the
mining excavation area. Please show the haul road as it passes the sediment ponds. Please provide a
buffer from the ponds to the haul road so as to mitigate any safety issues.
7. Please provide construction and maintenance details for the discharge barrel pipe as the haul road
crosses over.
8. The plan appears to show Basin P1 discharging into Basin P2 and Basin P2 discharging into Basin P3.
Clarify the logic of this design. Explain the benefit of this design as opposed to having one or two
larger basins discharging independently.
9. The design calculations show the flow into Basin P1 as 38 CFS, and the flow into Basin P2 as 35 CFS.
If Basin P1 discharges into Basin P2,then basin P2 flow cannot be lower than the Basin P1 flow.
10. The basins appear to have been designed using the 10-year storm. However, for mining sites, the 25-
year storm must be used.
11. Additional details for your basins are needed. Basins should include baffles, emergency spillway
location, and calculations must be provided, including calculations for the basin, emergency spillway,
and skimmer. Please show the elevations of the bottom of the basin,top of berm, emergency spillway,
and riser crest clearly on the plans. Ensure that proposed topographic contours tie into existing
contours. Show the berm for each basin and document that the minimum berm width is provided. The
minimum berm crest width for a sediment basin is 8 feet for basin with less than 10 feet fill height and
10 feet for basins with greater fill height.
12. Silt fence should be utilized on the downgradient edge of the disturbed area.
13. Provide additional topographic contour data to the north of the site so that the entire drainage areas can
be seen.
The wildlife study was for a different operation on a different parcel. Please provide wildlife information for this
specific site.
Please note, this office may request additional information not included in this letter, as the mining application
review progresses. Be advised that our review cannot be completed until all of the items listed above have been
fully addressed.

As required by 15A NCAC 513.0113,you are hereby advised that you have 180 days from the date of your receipt
of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request
additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot
be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be
made to grant or deny the mining permit based upon the information currently in the Department's files at the end
of the 180-day period.
Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the
additional information requested by this letter as soon as possible. Your prompt response will help us to complete
processing your application sooner.
