In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: 1. Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining landowners and chief administrative officer of each county and municipality have been properly notified. Notice has not been provided for Dorris W.Whitley—Poulson Family Trust,or Ron Hunt —Wilson County Manager. 2. You stated that you attached proof of submittal to the Stormwater Section,however no documents were attached. Please provide these details. 3. The wetlands crossing at the entrance to the site was not included in the PCN. Please clarify if this crossing will also be permitted. 4. Please verify that any wetlands impacts will be permitted before mining activity occurs. 5. Please provide maintenance details for the diversion berm and perimeter berm. This should include vegetive stabilization, inspections, mowing requirements, etc. Please be advised that 2:1 slopes may be difficult to mow with standard mowing equipment. 6. Please clarify what type of stabilization will be utilized for the inflow into the basins. 7. For basin 3 please provide additional details on diversion berms to ensure that sheet flow to sediment basins is minimized and inflow occurs upstream of the first baffle. 8. You've stated that existing roads were installed for logging,however from the mine map it is not clear what roads are to be utilized for mining purposes and which will not be used. Please clearly identify on the mine map your permanent haul roads, and the existing roads that will not be used as part of the mining operation. The haul road along the north side of the perimeter is shown on top of the 3.5 ft perimeter berm. Please clarify the location of the berm and haul road. 10. National Wetlands Inventory(NWI) shows there more wetlands on site than what was provided on the mine map. Please clarify where the wetlands data shown on the mine map was sourced. Please provide any wetlands delineations and or Jurisdictional Determinations that were completed for the wetlands on site. Please note, this office may request additional information, not included in this letter as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
