Pursuant to the passage of Hansa BW 56, which became law on October 4, 2017 as CL 17-20 , all existing mining permits and any newly issued mining permits are to be issued for the life of site or for the duration of the lease terra, The`life of site"mea ns the period from the initial rzne i pt of a perm it for the operat on until the mining operation terminates and the required reclamation is completed. Considering the above, this letter hereby modifies your existing raining permit to remove all references to the price expiration date to convert your permit to a life of site or lease permit effective immediately. No action is required on your part for this modification to be effective_ Please attach this letter to your exi tin rri rain ermit for future reference. The mine name and permit number on the permit document,and all existing operating and reclamation conditions contained therein, shall remain in full force and effect. Furthermore,all provssions of GS§74-51 and GS§74-52 still apply to all new, transferred and modified mining permits. In addition to the life of site or lease mining permit provision,BL 2017-209 also enacted a new annual mining permit operating fee of 400 per mining permit number, By statute. the initial payment of this annual 400 tee roust be submitted to this office by December 31,2017- see the attached Invoice to remit the initial annual fee payment by this deadline Beginning in 2018. the $4 00 ar=nual operating fee must be submitted by July 1 of each year with the required Annual Reciarnation Report as required by GS 74-55. Failure to submit the fee by the required deadline will result In a 501month late fee and could result in the denial of future permit actions and/or revocation of yot,r=mining permit. Lastly, pursuant to- B 74-54. the cap on reclamation bonds has been raised from$500.000 to t rnillidn. Any adjustments needed in existing bonds will be initiated by this office or addressed during your next requested permit action nless you contact this office with a written request to have your bond reevaluated. The issuance of a mining permit and/orany modification to it does not supersede local zoning regulations. The responsibility of compliance with any applicable.coning regulations remains with you. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Flan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Modifications January 1, 2000: This permit has been modified to change the corporate name from Vulcan Materials Company to Vulcan Construction Materials LP. Expiration Date This permit shall be effective from the date of its issuance until March 15, 2022. Conditions This Permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq.,.and to the following conditions and limitations: r Page 3 OPERATING CONDITIONS: 1. Wastewater and Quarry Dewaterinq A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any storm water runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Division of Water Quality to secure any necessary storm water permits or other approval documents. 2. Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. Durina nrocessin4 operation, water trucks or other means that may_ be necessary_ shall be utilized to prevent dust from leaving the permitted area. 3. Buffer Zones A. Any mining activity affecting waters of the State, waters of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission, B. Sufficient buffer shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural 'vvater%ourse or wetland. C. Sufficient buffer shall be maintained between any excavation and any adjoining property line to protect adjoining property. These buffer zones, with the exception of the installation of required sediment control measures and approved earthen berms, shall remain undisturbed. D. Site-specific buffers and screening methods shall be submitted to and approved by the Department prior to initiating any land-disturbing activities at this site. Page 4 4. Erosion and Sediment Control A. The operator shall notify the Winston-Salem Regional Office, Land Quality Section at least 48 hours prior to reactivating this mining operation. B. An updated and detailed erosion and sediment control plan and mine advancement plan shall be submitted to and approved by the Department E or to rnmmPnrinn anv lanri-ciisfiirhinn nrfivitip-, at thi-, -,ifp C. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, check dams, sediment retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. 5. Groundwater Protection Groundwater monitoring wells shall be installed and monitored as deemed appropriate by the Department. 6, Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause off-site damage because of sedimentation, shall be planted or otherwise provided with groundcover, devices or structures sufficient to restrain such erosion. B. Overburden cut slopes along the perimeter of the quarry opening shall be graded to a minimum 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum ten (10) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of any overburden slope. 7. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8. Blasting The operator shall provide to the Department a copy of the findings of any seismic studies conducted by this facility. The operator shall make every reasonable effort to incorporate the studies the studies' recommendations into the production blasting program. i Page 5 The following blasting conditions shall be observed by the operator to prevent hazard to persons and adjacent property from thrown rock or vibrations. The operator shall monitor each blast with a seismograph located at a distance no farther than the closest off site regularly occupied structure not owned or leased by the operator. A seismographic record including peak particle velocity, air overpressure, and vibration frequency levels shall be kept for each blast (except as provided under Operating Condition Nos. 8B and 8D of this permit). Records shall be maintained at the permittee's mine office and copies shall be provided to the Department upon request. F. However, blasting may occur in other approved areas within the permitted boundary. Authorization to blast at the blast site may be granted at the time of the verbal reporting of the high ground vibration or high air blast reading if the circumstances justify verbal approval. Failure to report will constitute a permit violation. G. F! rock Prevention: The operator shall take all reasonable precautions to ensure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of the Mining Permit. Page 8 H. Flyrock Reporting Should flvrock occur beyond the permitted and auarded areas; the nneratnr shall immediately report the incident to the Department. Further use of explosives on the mine site shall be suspended until the following actions have been taken: 1. A thorough investigation as to the cause(s) of the incident shall be conducted, 2. The report shall meet with the approval of the Department before blasting may resume at the mine site. I. Studies: T he operator shah provide to the Department a copy of the findings of any seismic studies conducted at the mine site in response to an exceedence of a level allowed by these blasting conditions. The operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. J. Notice: The operator shall, when requested by the Department, give 24-hour advance notice to the Land Quality Section Regional Office prior to any blast during a period for which notice is requested. 9. High Wall Barrier A physical barrier consisting of large boulders placed end-to-end or fencing shall be maintained at all times along the perimeter of any highwall to prevent inadvertent public access. In addition, a minimum 10 foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of any overburden cut slope. 10. Visual Screening Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Refuse Disposal A. No on-site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on-site and directly associated with the mining activity may be / J V disposed of in a designated refuse area. Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 14. Bonding The security, which was posted pursuant to N.C.G.S. 74-54 in the form of a $500,000.00 blanket bond, is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. Archaeological Resources Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. l Page 11 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or are likely to become noxious, odious or foul. 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Agricultural Experiment Station and the North Carolina Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: 1. Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with water, provide a permanent barricade (fence) along the top of any high wall, and grade and revegetate any areas in unconsolidated material. 2. An updated and detailed Reclamation Plan shall be submitted to and approved by the Department prior to reactivating this site. 3. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: Page 12 ` A. All areas of unconsolidated material such as overburden or waste piles shall be, graded to a 2 horizontal to 1 vertical or flatter slope and terraced as necessary to insure slope stability. B. Any settling ponds and sediment control basins shall be backfilled, graded, and stabilized or cleaned out and made into acceptable lake areas. C. The orocessino. stockaile. and other disturbed areas neiahhnrinn the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation. E, No contaminants shall be permanently disposed of at the mine site. On-site disposal of waste shall be in accordance with Operating Conditions Nos. 12A through D. F. The affected land shall be graded to prevent the collection of noxious or foul water. 4. Revegetation Plan: An updated and detailed Revegetation Plan shall be submitted to and approved by the Department rip ar to commencing any land-disturbing activities at this site. 5. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. MINING PERMIT EXPIRATION DATE: June 26 2012 Page 2 In accordance with the application for this mining permit, which is hereby approved by the Department of Environment and Natural Resources hereinafter referred to as the Department, and in conformity with the approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for the protection of the surrounding environment and for reclamation of the land and water affected by the permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan is a separable obligation, secured by the bond or other security on file with the Department, and may survive the expiration, revocation or suspension of this permit. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act; the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. B. Any stormwater runoff from the affected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Stormwater Section, Division of Water Quality, to secure any necessary stormwater permits or other approval documents. 2. Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission and enforced by the Division of Air Quality. B. During quarry operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. J. L.1UIiGl LVI IGJ A. Any mining activity affecting waters of the State, waters of the U. S., or wetlands shall be in accordance with the requirements and regulations promulgated and enforced by the N. C. Environmental Management Commission. B. Sufficient buffer shall be maintained between any affected land and any adjoining waterway to prevent sedimentation of that waterway from erosion of the affected land and to preserve the integrity of the natural watercourse. C. Sufficient buffer shall be maintained between any excavation and any adjoining property line to protect adjoining property. These buffer zones, with the exception of the installation of required sediment control measures and earthen berms, shall remain undisturbed. D. Site-specific buffers and screening methods shall be submitted to and approved by the Department prior to initiating any land-disturbing activities at this site. Page 4 4. Erosion and Sediment Control A. The operator shall notifv the Winston-Salem Reaional Office, Land Quality Section, at least 48 hours prior to reactivating this mining operation. B. An updated and detailed erosion and sediment control plan and mine advancement plan shall be submitted to and approved by the Department prior to commencing any land-disturbing activities at this site. C. Adequate mechanical barriers including, but not limited to diversions, earthen dikes, silt check dams, silt retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in proximity to the affected land. 5. Groundwater Protection Observation wells shall be installed, maintained, and monitored as deemed necessary by the Department. 6. Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. B. Overburden cut slopes along the perimeter of the initial pit opening shall be graded to a 2 horizontal to 1 vertical or flatter and shall be stabilized within 60 days of completion. Furthermore, a minimum ten (10) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of the overburden slope. 7. Surface Drainage The affected land shall be graded so as to prevent collection of pools of water that are, or likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. Page 5 8. Blastin4 The operator shall provide to the Department a copy of the findings of any seismic studies conducted at this facility. The operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. The following blasting conditions shall be observed by the operator to prevent hazard to persons and adjacent property from thrown rock or vibrations: The operator shall monitor each blast with a seismograph located at a distance no farther than the closest off site regularly occupied structure not owned or leased by the operator. A seismographic record including peak particle velocity, air overpressure, and vibration frequency levels shall be kept for each blast (except as provided under Sections B. and D. of this permit). The following blasting conditions shall be observed by the mine operator to prevent hazard to persons and adjacent property from surface blasting: A. Airblast With Monitoringa: Airblast overpressure resulting from surface blasting shall not exceed 129 decibels linear (dBL) as measured at the immediate location of any regularly occupied building not owned or leased by the operator outside of the permitted area such as a dwelling house, church, school, or public, commercial or institutional building, unless an alternate level based on the sensitivity of the seismograph microphone as specified below is being used: Lower Frequency Limit of Max Level, Measuring System. in Hz in dBL_ 0.1 Hz or lower-flat response 134 peak 2.0 Hz or lower-flat response 133 peak 6.0 Hz or lower-flat response 129 peak D. D = Distance from the blast site to the nearest inhabited building not owned or leased by the mine operator (feet). P = Unconfined air overpressure (decibels). A = Airblast or air overpressure for typical quarry situations (decibels). The airblastloverpressure shall not exceed 129 decibels, for the purposes of this Section. E- Record Keening: The operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; blast location; distance from blast to closest offsite regularly occupied structure; and weather conditions at the time of the blast. Records shall be maintained at the permittee's mine office and copies shall be proviaea 'Lo the Department upon request. F. Excessive Ground Vibration/Airblast Reporting; If ground vibration or airblast limits are exceeded, the operator will immediately report the event with causes and corrective actions to the Department. Use of explosives at the blast site that produced the excessive reading shall cease until corrective actions approved by the Department are taken. However, blasting may occur in other approved areas within the permitted boundary. Authorization to blast at the blast site may be granted at the time of the verbal reporting of the high ground vibration or high air blast reading if the circumstances justify verbal approval. Failure to report will constitute a permit violation. o 0 Page 8 G. Flyrock Prevention: The operator shall take all reasonable precautions to ensure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of the Mining Permit. H. Flyrock Reporting: Should flyrock occur beyond the permitted and guarded areas, the operator shall immediately report the incident to the Department. Further use of explosives on the mine site shall be suspended until the following actions have been taken: I. A thorough investigation as to the cause(s) of the incident shall be conducted. 2. A report detailing the investigation shall be provided to the Department within 10 days of the incident. The report shall, at a minimum, document the cause(s) of the incident along with technical and management actions that will be taken to prevent further incidents. The report shall meet with the approval of the Department before blasting may resume at the mine site. 1. Studies: The operator shall provide to the Department a copy of the findings of any seismic studies conducted at the mine site in response to an exceedence of a level allowed by these blasting conditions. The operator shall make every reasonable Cl"Wo L to incorporate me studies recornrnendations into the production blasting program. J. Notice: The operator shall, when requested by the Department, give 24 hour advance notice to the Land Quality Section Regional Office prior to any blast during a period for which notice is requested. 9. High Wall Barrier An appropriate physical barrier consisting of large boulders placed end-to-end or fencing shall be maintained at all times around the perimeter of any highwall to prevent inadvertent public access. in addition, a minimum ten (10) foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of the overburden cut slope. Page 9 10. Visual Screening Existing vegetation shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms, shall be employed as deemed appropriate by the Department. 11 . Plan Modification A. The operator shall notify the Department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion and sedimentation control plan contained in the approved application for the inactive renewal of this mining permit. Approval to implement such changes must be obtained from the Department prior to on-site implementation of the revisions. B. An updated and detailed erosion and sediment control plan and mine advancement plan shall be submitted to and approved by the Department prior to initiating any land-disturbing activities at this site. 12. Refuse Disposal A. No on-site disposal of refuse or other solid waste that are generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Solid Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. _r• _r . -� B. Mining refuse as defined by G.S. 74-49 (14) of The iviining Act of 19711 generated on-site and directly associated with the mining activity may be disposed of in a designated refuse area. All other waste products must be disposed of in a disposal facility approved by the Division of Solid Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall be disposed of within the permitted area. C. For the purposes of this permit, the Division of Land Resources considers the following materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14) of the N.C. Mining Act of 1971): 1) on-site generated land clearing debris 2) conveyor belts 3) wire cables 4) v-belts 5) steel reinforced air hoses 6) drill steel Page 10 D. If mining refuse is to be permanently disposed within the mining permit boundary, the following information must be provided to and approved by the Division of Land Resources prior to commencement of such disposal. Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 14. Bonding The gp.nirity which was pnsted pursijant to N.C.G_S_ 74-54 in the form of a $500.000.00 blanket bond is sufficient to cover the operation as indicated in the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 15. Archaeological Resources Authorized representatives of the Division of Archives and History shall be granted access to the site to determine the presence of significant archaeological resources. s � Page 11 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G.S. 74-53 1. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and.spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or are likely to become noxious, odious or foul. 5. RECLAMATION CONDITIONS: I. Provided further; and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with water, provide a permanent barricade (fence) along the top of any highwall, and grade and revegetate any areas in unconsolidated material. 2: An updated and detailed Reclamation Plan shall be submitted to and approved by the Department rp for to reactivating this site. Page 12 3. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A. All areas of unconsolidated material such as overburden or waste piles shall be graded to a 2 horizontal to 1 vertical or flatter slope and terraced as necessary to insure slope stability. B. Any settling ponds and sediment control basins shall be backfilled, graded, and stabilized or cleaned out and made into acceptable lake areas. C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation. E. No contaminants shall be permanently disposed of at the mine site. On-site disposal of waste shall be in accordance with Operating Condition 12.A. through D. F. The affected land shall be graded to prevent the collection of noxious or foul water. 3. Reyegetation Plan: An updated and detailed Revegetation Plan shall be submitted to and approved by the Department rp for to commencing any land-disturbing activities at this site. 4. Reclamation Plan: Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. This permit is not transferable by the permittee with the following exception: if another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue. of a sale, lease, assignment or otherwise, the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permitteeis successor is not complying with the Reclamation Plan or other terms and conditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to-modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49 . This Permit shall be subject to the provisions of the Mining Act, N.C.G. S. 74-46 , et. seq. , and to the following conditions and limitations: OPERATING CONDITIONS: 1 . wastewater and Quarry Dewatering A. Any wastewater processing or mine dewatering shall be in accordance with the permitting requirements and rules promulgated by the N.C. Environmental Management Commission. - ' B. Any stormwater runoff from the of fected areas at the site shall be in accordance with any applicable permit requirements and regulations promulgated by the Environmental Protection Agency and enforced by the N.C. Environmental Management Commission. It shall be the permittee's responsibility to contact the Water Quality Section , Division of Environmental Management, to secure any necessary stormwater permits or other approval documents . 2 . Air Quality and Dust Control A. Any mining related process producing air contaminant emissions including fugitive dust shall be subject to the requirements and rules promulgated by the N.C. Environmental Management Commission. . B. During quarry operation, water trucks or other means that may be necessary shall be utilized to prevent dust from leaving the permitted area. 3 . Buffer Zones A. Any mining activity affecting wetlands shall be in accordance with the requirements and regulations nrnmul antt-d anc3 Pnfnrc-ed by thP ii,S - Armv Cnrns of Engineers. B. Sufficient buffer shall be maintained between any affected land and any adjoining waterway to prevent sedimentation of that waterway from erosion of the affected land and to preserve the integrity of the natural watercourse. These buffer zones, with the exception of the installation of required sediment control measures and earthen berms, shall remain undisturbed. 4 . Erosion and Sediment Control A. A detailed sediment and erosion control and mine advancement plan must be submitted to and approved by the Department prior to commencing any land-disturbing activities at this site. - B. The operator shall notify the Winston-Salem Regional Office, Land Quality Section , at least 48 hours prior to reactivating this mining operation. C. Adequate mechanical barriers including, but not limited to diversions , earthen dikes , brush barriers, silt check dams, silt retarding structures , rip rap- pits , or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in proximity to the affected Land. D. An erosion and sediment control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the erosion control plan and mine maps specified in 4 (A) above. 5 . Groundwater Protection observation wells shall be installed, maintained, and monitored as deemed necessary by the Department. 6 . Graded Slopes and Fills A. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure, or device. In any event, exposed slopes or any excavated channels , the erosion of which may cause offsite damage because of siltation, shall be planted or otherwise provided with groundcover , devices or structures sufficient to restrain such erosion. Furthermore, a minimum ten ( 10) foot wide horizontal safety bench shall be provided at the top of the rock and at the toe of the overburden slope. 7 . Necessary structures such as drainage ditches or conduits shall be constructed or installed when required to prevent such conditions. 8 . Blasting The operator shall provide to the Department a copy of the • r_ _ • l findings of any seismic studies conducted at this 1dU111[.y . The operator shall make every reasonable effort to incorporate the studies' recommendations into the production blasting program. The following blasting conditions shall be observed by the operator to prevent hazard to persons and adjacent property from thrown rock or vibrations : A. In all blasting operations, except as hereinafter otherwise provided, the maximum peak particle velocity of any component of ground motion shall not exceed 1 inch per second at the immediate location of any building outside of the permitted area regularly occupied by human beings such as dwelling house, church, school , public building, or commercial or institutional building outside of the permitted area. The operator shall monitor each blast with a seismograph. B. Airblast overpressure shall not exceed 128 decibels linear (dBL) as measured at the immediate location of any regularly occupied building such as any dwelling house, church, school , public building, or commercial or institutional building. C. The operator shall take all reasonable precautions to insure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Should flyrock occur beyond the guarded area or the levels in Items A and B above are exceeded, the operator shall report the incident to the Department immediately and further use of explosive at the site shall be immediately suspended until the following actions have been taken: Page 6 of 11 I . A thorough investigation as to the cause(s) of the incident shall be conducted. 2 . A satisfactory report detailing the investigation shall be provided to the Department within 10 days of the incident. Said report shall., at a minimum, document the cause(s) of the incident along with technical and management actions that will be taken to prevent further incidents . The report shall meet with the approval of the Department before blasting may resume at the site. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of this permit. D. The operator shall maintain records on each. individual blast describing: the total number of holes; pattern of holes and delay of intervals; depth and size of holes; type and total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; and blast location. ' Records shall be maintained at the permittee's mine office and copies shall be provided to the Department upon request. E. The operator shall , 'when requested by the Department, give 24 hour advance notice to the Land Quality Section prior to any blast during a period for which notice is requested. 9 . High Wall Barrier A physical barrier consisting of large boulders placed end-to- end or fencing shall be maintained at all times around the perimeter of any highwall to prevent inadvertent public access . In addition, a minimum ten foot wide horizontal safety bench shall be provided at the junction between the top of rock and the toe of the overburden cut slope . 10. Visual Screening Existing vegetation .shall be maintained between the mine and public thoroughfares to screen the operation from the public. Additional screening methods, such as constructing earthen berms , shall be employed as deemed appropriate by the Department. Page 7 of 11 n . Plan Modification A. The operator shall notify the Department in writing of the desire to delete , modify or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for the inactive renewal of this mining permit. Approval to implement such changes must be obtained / from the Department prior to on-site implementation of the revisions . B. An updated and detailed Sediment and Erosion Control Plan shall be submitted to and approved by the Department prior to initiating any land-disturbing activities at this site. 12 . Refuse Disposal A. No on-site disposal of refuse or other solid waste that are generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Solid Waste Management and the Land Quality Section, Department of Environment, Health and Natural Resources . The method of disposal shall be consistent with the approved reclamation plan. B. Mining refuse as defined by G. S. 74-49 ( 14 ) of The Mining Act of 1971 generated on-site and directly associated with the mining activity 'may be disposed of , in a designated refuse area . All other waste products must be disposed of in a disposal facility approved by the Division of Solid Waste Management. No petroleum products, acids, solvents or their storage containers or any other material that may be considered hazardous shall L _ _ __E _L` _ L L� the _ Ue disposed of within he permitted area. 13 . Annual Reclamation Report An Annual Reclamation Report shall be submitted on a form supplied by the Department by February 1 of each year until reclamation is completed and approved. 14 . Bondina The security which was posted pursuant to N.C.G. S. 74-54 in the form of a $25, 000 . 00 blanket bond is sufficient to cover the operation as indicated an the approved application. Page 9 of 11 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the terms of the Mining Permit. The approved plan provides : Minimum Standards As Provided-By G. S. 74-53 1 . The final slopes in all excavations in soil , sand, gravel and other unconsolidated materials shall be-at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2 . Provisions for safety to persons and to adjoining property must be provided 'in all excavations in rock. 3 . All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the land. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, likely to become noxious , odious or foul . 5 . The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the North Carolina Aqricultural Experiment Station and the North Carolina Forest Service. 6 . Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event , provide reclamation at the earliest practicable time after completion or termination of mining on any segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS: 1 . Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with water, provide a permanent barricade (fence) along the top of any highwall , and grade and revegetate any areas in unconsolidated material . Any settling ponds and sediment control basins shall be backfilled, graded, and stabilized or cleaned out and made into acceptable lake areas . ---.- -- C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall be leveled and smoothed. D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation . F. This permit is not transferable by the permittee with the following exception: If another operator succeeds to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or otherwise,the Department may release the permittee from the duties imposed upon him by the conditions of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the successor operator, provided that both operators have complied with the requirements of the Mining Act and that the successor operator agrees to assume the duties of the permittee with reference to reclamation of the affected land and posts a suitable bond or other security. In the event that the Department determines that the permittee or permittee's successor is not complying with the Reclamation Plan or other terms and con- ditions of this permit, or is failing to achieve the purposes and requirements of the Mining Act, the Department may give the operator written notice of its intent to modify, revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit. The operator shall have right to a hearing at a designated time and place on any proposed modification, revocation or suspension by the Department. Alternatively and in addition to the above, the Department may institute other enforcement procedures authorized by law. Definitions Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have the same meaning as supplied by the Mining Act, N.C.G.S. 74-49. Conditions The permitted mining operation shall not violate standards of air quality, surface water quality, or ground water quality promulgated by the Environmental Management Commission. This permit shall be effective from the date of its issuance until August 63. 1992 and shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq. , and to the following conditions and limitations: • 3 of 7 1. Any wastewater processing or mine dewatering shall be in accordance with permit requirements and regulations promulgated by the Division of Environ- mental Management. 2. Any mining process producing air contaminant emissions shall be subject to the permitting requirements and regulations promulgated by the Division of Environmental Management. 3. Sufficient buffer shall be maintained between any affected land and any adjoining waterway to prevent sedimentation of that waterway from erosion of the affected land and to preserve the integrity of the natural water- coilrs e. 4. Adequate mechanical barriers including but not limited to diversions, earthen dikes, brush barriers, silt check dams, silt retarding structures, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance to prevent sediment from discharging onto adjacent surface areas or into any lake or natural watercourse in proximity to the affected land. 5. The angle for graded slopes and fills shall be no greater than the angle which can be retained by vegetative cover or other adequate erosion control measure, structure or device. In any event, exposed slopes or any excavated channels, the erosion of which may cause offsite damage due to siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient to restrain such erosion. b. The affected land shall be graded so as to prevent collection of pools of water that are, or are likely to become, noxious or foul. Necessary structures such as drainage ditches or conduits shall be constructee or installed when requircd to prevent such conditions. 7. The following blasting conditions shall be observed by the operator to prevent hazard to persons and adjacent property from thrown rock or vibrations: A. In all blasting operations, except as hereinafter otherwise provided, the maximum peak particle velocity of any component of ground motion shall not exceed one inch per second at the immediate location of any building regularly occupied by human beings such as dwelling house, church, school, public building, or commercial or institutional building. B. Airblast overpressure shall not exceed 128 decibels linear (dBL)- warning, 132 dBL caution, and 135 dBL maximum as measured at the immediate location of any regularly occupied building such as any dwelling house, church, school, public building, or commercial or institutional building. 4 of 7 C. The operator shall take all reasonable precautions to insure that flyrock is not thrown beyond areas where the access is temporarily or permanently guarded by the operator. Should flyrock occur beyond the guarded area, it shall be reported to the Department immediately, who will conduct a thorough investigation to determine the cause. Failure to take corrective measures to prevent flyrock and repeated instances of flyrock shall be considered a violation of the permit. D. Operator shall maintain records on each individual blast describing: the total number of holes; pattern of holes; depth of holes; total pounds of explosives; maximum pounds per delay interval; amount of stemming and burden for each hole; and blast location. Records shall be maintained at the permittee's mine office and copies shall be provided to the.Department upon request. E. Operator shall, when requested by the Department, give 24 hour advance notice to the Land Quality Section prior to any blast during a period for which notice is requested. 8. Sufficient buffer shall be maintained bostween any excavation and any adjoining property line to prevent caving of that property and to allow grading of the sideslopes to the required angle. 9. A physical barrier consisting of a fence or boulder barriers, etc. , shall be maintained around the perimeter of any quarry highwall. 10. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public throughfares whenever practical to screen the operation_ from public view. 11. An Annual Reclamation Report shall be submitted on a form supplied by the Department on February 1 of each year until reclamation is completed and approved. 12. The security which was posted pursuant to N.C.G.S-. 74-54 in the form of $25,000.00 Blanket Bond is sufficient to cover the quarry operation as indicated on the approved application. This security must remain in force for this permit to be valid. The total affected land shall not exceed the bonded acreage. 5 of 7 APPROVED RECLAMATION PLAN The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the continuing validity of -that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of the permittee, which continues beyond the term of the Mining Permit. The approved plan provides: Minimum Standards As Provided By G. S. 74-53 + f 1 l ions s_ i a l an other uncon- solidated materials shall be at such an angle as to minimize the possibility of slides and be consistent with the future use of the land. 2. Provisions for safety to persons and to adjoining property must be provided in all excavations in rock. 3. All overburden and spoil shall be left in a configuration which is in accordance with accepted conservation practices and which is suitable for the proposed subsequent use of the. lend. 4. No small pools of water shall be allowed to collect or remain on the mined area that are, or are likely to become noxious, odious or foul, 5. The revegetation plan shall conform to accepted and recommended agronomic and reforestation practices as established by the N.C. Agricultural Experiment Station and the N.C. Forest Service. 6. Permittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated. These activities shall be conducted according to the time schedule included in the plan, which shall to the extent feasible provide reclamation simultaneous with mining operations and in any event, initiation of reclamation at the earliest practicable time after completion or termination of mining on any Segment of the permit area and shall be completed within two years after completion or termination of mining. RECLAMATION CONDITIONS 1. Provided further, and subject to the Reclamation Schedule, the planned reclamation shall be to allow the quarry excavation to fill with ground water, barricade along the top of any highwall, and grade and revegetate any areas in unconsolidated material. 2. The specifications for surface gradient restoration to a surface suitable for the planned future use are as follows: A., A physical barrier consisting of a fence or boulder barriers, etc., shall be maintained around the perimeter of any quarry highwall. B. Any cut or fill slopes in overburden or other unconsolidated material shall be graded to a 2 horizontal to 1 vertical grade or flatter and terraced as necessary to insure slope stability. F 6 of 7 C. The stockpile, office and process plant areas shall be graded and smoothed. D. Any settling ponds or sediment basins shall either be backfilled and stabilized or cleaned out and made into lake areas. E. No contaminants shall be dumped at the mane site. Scrap metal, trash or other such waste shall be removed from the site and properly disposed. F. The affected land shall be graded to prevent she collection of noxious or foul water. G. Any excavated, diverted, or disturbed natural channels shall be stabilized. 3. Revegetation Plan Revegetation and reforestation of the affected areas will consist of the following measures: A. Site preparation including grading, ditching, and cultivating will be carried out effectively in order to revegetate and/or reforest. Reasonable efforts will be made to correct minor soil deficiencies through the application of fertilizers, mulches, etc. Local climate, topography, and soil conditions will dictate revegetation and reforestation efforts. B. Revegetation will be completed through the proper application of the following: 1. Preparation of seed bed - 3 to 4 inches. 2. Affected areas to be seeded with a combination of 45 pounds of Sericea lespedeza and 45 pounds of fescue. (Scarified lespedeza in the Spring and unscarified in the Fall) . 3. Fertilizer - 1000 pounds of 5-10-10 per acre. 4. Lime - 2 tons per acre. 5. Mulch - Approximately 80 bales per acre. All applications to be spread uniformly over the affected area. C. Describe your intended plan for the reclamation and subsequent use of all affected lands and indicate the general methods to be used in reclaiming this land. Preliminary reclamation work will be carried out in conjunction with the mining operation,where practicable, with the completion of such work upon abandonment of the site. However, such preliminary work does not in any way suggest that our mining operation at that site is being concluded. With the expansion of the pit area, all slopes will be graded and seeded, where possible, to reduce the possibility of slides and erosion. In areas where grading or site preparation is in progress, care will be taken to avoid the siltation or sedimentation of adjoining streams and lakes; dur- ing operations at a site, adequate settling ponds will be ma_intai.ned to prevent any untreated water from plant processes from being discharged into any stream or lake until it meets the water quality standards of the Corps of Engineers. Specific areas will be designated as fills and used for the disposal of refuse from the mining operation, however, no fill area used for the disposal of contaminants such as used motor oils or cleaning solutions will be maintained in a location which might allow these substances to pollute any adjoining stream or lake. Upon comple- tion of mining operations, all refuse, metal scrap,and concrete pourings will be removed from affected areas or buried in fills; spoil banks will be graded so as to blend into the surrounding terrai- ;=zeal grading and filling will be accomplished in a manner complementary to the topography of the affected area and will allow for adequate runoff of ground water and the retardation of erosion. Areas designated as suitable for reclam- ation as lakes will be graded and sloped to present an attractive , accessable shoreline which would not be subject to erosion or slides. Vegetation of all areas affected by the operation will be accomp- lished through the planting of grasses and tree seedlings, the exact types of which will vary from operation to operation as local climate and soil conditions dictate. Accepted conservation practices will be adhered to throughout the reclamation process in an effort to return the area to as nearly an original state as feasible. Pit areas will be well fenced and marked and approaches to the pit will be sloped, graded, and seeded to prevent the possibility of slides. Subsequent use of a pit as a resetvoir or a sanitary landfill will be subject to negotiation with the appropriate -authorities, based on- the local requirements for such a facility. Reclamation Plan 2. Indicate what practices you will take to protect adjacent surface resources. Where practicable, trees and grasses will be planted to aid as an erosion control medium and as a buffer zone between mining operations and adjacent surface resources. 3. All grading along stream banks and ground water runoff areas will be carried out in accordance with good conservation prac- tices followed by grassing of such areas so as to minimize erosion. Where deemed necessary, stream banks will be rip-rapped. 9. Describe provisions for prevention of noxious, odious or foul water collecting or remaining in mined areas. Mined areas will be graded and- sloped so as to maintain continuity of the terrain and provide natural runoff, thus prohibiting the formation of pools of stagnant, noxious water.. 10. G. S. 74-52 provides that the permit may be renewed at any time during the two years prior to its expiration. The procedure to be followed and standards to be applied in renewing a permit shall be the same as those for issuing a permit. It was found that the stockpile areas have a serious erosion problem that needs , immediate attention. These areas have eroded causing offsite deposits of sediment in the road ditch as well as adjacent cropland. This letter is to advise you of the deficiency and to request that it be corrected within 30 days., It would probably be easlp�eorrected by•seeding these areas and constructing a berm along the lower perimeters. with sediment pits at the outlets. Box 4195 Winston-Salem, NC 27105 Dear Mr. Hanes: On June 4, 1985, an inspection of the Cycle Quarry (Permit No. 99-1) was made as required by G.S. 74-56 of "The Mining Act of 1971," as amended. Our inspection found the following problems : 1. Serious erosion is occurring_ on the south side of this site. It appears that runoff from this area goes into the small pond downstream which has trapped a lot of sediment. However, the approved Reclamation Plan and G.S. 74-53 of "The Mining Act" require that an area be reclaimed within two years after comple- tion or termination of mining. Therefore, the above mentioned area needs to be reclaimed. Your Reclamation Plan gives revege- tation specifications which should be followed. 2. There was serious erosion problems resulting in off-site sedi- mentation at the stock-pile area on the north side of this site. This is a violation of Operating Condition No. 4 of your Mining Permit. This area must be corrected to comply with the condition noted above. It is further recommended that this area also be reclaimed as mentioned in No. 1 above. 3. It was noted that the fence around the pit has been cut at some locations . This Report is required by G.S. 74-59 and Regulation No. 5B.0010 of The Mining Act of 1971 for all mines under permit whether they are active or inactive, but not released. Failure to submit the Report by February 1, 1986 is a violation of your mining permit and is subject to enforcement action. You or your firm were given until May 20, 1986, to file a late Report, thereby precluding the initiation of any such enforcement action. To date the Department has not received your Report and, therefore, is informing you that you are in violation of your permit. Failure to file the Report within 30 days of receipt of this notice on the enclosed form may, under authority of G.S. 74-64, result in the assessment of a civil penalty of $100.00. A 50 ' wide green belt surrounding the property will be maintained. e. Upon completion of construction, berms , pit slopes , diversion dit- ches and any other disturbed akeas not necessary for operational pur- poses will be vegetated. f. The construction of a water supply pond upstream from the sediment basin (described in paragraph 2-a) , a cross section of the dam described as section D-D and detailed on draw- ing number 111-6 , will also serve as a sediment basin. g. Placement of rip-rap at the inlet and outlet of the 650 ' of 42" CMP located under the plant and stockpile area. h. Location of the pit de-watering dis- charge point at at the head of the water supply pond will provide extra settling time for this water. B. Quarry de--watering and neighboring well water levels - In an- swer to your questions , I submit the following: 1. According to Dr. Harry LeGrand, Hydrological Con- sultant, it is unlikely that we will have any effect upon neighboring well water levels. 2 . In order to monitor any possible effects , however, we will install approximately five '(5) one hundred (100 ' ) feet deep (3"0) monitoring wells around the southern and eastern portions of our property plus a 6"O well for our own use 'near the office and scale house. All of these wells will be 1'ocated between the pit and our neighbors. 3 . If we do find beyond a reasonable doubt that we are Mr. James D. Simons August 13 , 1980 Page 3 adversely affecting neighboring wells we will seek the advice of Dr. Harry LeGrand and take appropriate action. 4 . The monitoring wells and our own producing well will be made available to the NCDNR in order for them to con- duct their own survey and monitoring program. We would .like to have access to information NCDNR obtains from any program that might be set up or followed that would pertain to our position in the neighborhood. C. Future development will allow us to expand toward our neighbors but blast facing our own plant and property. 2 . The location of each residence and structure near the quarry will be identifiable through the use of a grid aerial photo relative to the grid Location of each blast. 3 . Prior to blasting operations , we will consult with blasting specialists on acceptable and standard blasting techniques and procedures applicable to East Forsyth Quarry, taking into consideration the sur- rounding neighborhood, distances from roads, highways , and residences. 4 . Drilling, loading and blasting operations will be han- dled by qualified personnel who will make applicable the blasting techniques- and procedures recommended by the blasting specialists . 5. Records for each blast will be maintained and include the following: number of holes , pattern, depth, total pounds of explosives, maxium pounds per delay, burden, spacing and sterraiinq and blast location. 6 . All reasonable precautions will be taken to insure that fly rock is not thrown off of the property under the control of Vulcan. 7 . We will attempt to monitor all blast with a seismongraph and record the location, distance from the blast and identity of the property owner where the unit is located. Mr. James D. Simons August 13 , 1980 Page 4 8 . Each seismograph recording will be analyzed by an in- dependent seismologist and records maintained by Vulcan. 9 . Blasting complaints will be handled as follows: a. Date and time of complaint, quote words used and identify caller. b. Maintain independent blasting com- plaint records.
