The deficiencies discovered and the necessary corrective actions are as follows:
1., OPERATING CONDITION #4.A.: The operator shall notify the Raleigh

t. OPERATING CONDITION #4.B.: Adequate mechanical barriers including,
but not limited to diversions, rip rap pits, or ditches shall be provided in
the initial stages of any land disturbance and maintained to prevent
sediment from discharging onto adjacent surface areas or into any lake,
wetland or natural watercourse in proximity to the affected land. Check
dams or acceptable alternatives are needed in the ditch at the lowest
limits of disturbance. Silt fence should be installed along the-toe of the fill
slopes. All bare soils should be appropriately stabilized.
3. OPERATING CONDITION #4.E.: An erosion and sedimentation control
plan(s) shall be submitted to the Department for approval prior to any land
disturbing activities not indicated on the revised erosion control plan or
mine maps submitted with the approved application for a mining permit
and any approved revisions to it. Such areas include, but are not limited
to expansion outside the approved pit area, creek crossings, or expansion
of overburden or waste disposal areas. The Department was not notified
in writing prior to the changes in site conditions being implemented.
4. OPERATING CONDITION #11.: The operator shall notify the department
in writing of the desire to delete, modify or otherwise change any part of
the mining, reclamation, or erosion/sedimentation control plan contained
in the approved application for a mining permit and any revisions to it.
Approval to implement such changes must be obtained from the
Department prior to on-site implementation of the revision. As stated
above, the conditions of the approved permit have not been implemented.

If the previously described deficiencies are not corrected within 30 days following
your receipt of this Notice, this matter will be referred to the Director, Division of Land
Resources, Department of Environment and Natural Resources, for the issuance of an
official Notice of Violation in an effort to secure compliance at the site.

MINING PERMIT
You have previously expressed an interest and/or are listed as an adjoining land
owner in the application to modify this mining permit filed by Hanson Aggregates
Carolina, Inc. to conduct mining activities off SR 1400 in Wilson County. The mining
permit (no. 98-13) was modified on November 3, 1999.
North Carolina law allows persons aggrieved by the issuance of a mining permit
to contest the decision by filing a petition for a contested case in the Office of
Administrative Hearings pursuant to N.C.G.S. 150B-23 of the Administrative Procedure
Act (APA).
If you believe that you are an aggrieved party within the meaning of the APA, a
petition for a contested case must be filed in the Office of Administrative Hearings
within sixty (60) days of the mailing of this notice to you.
If you file a contested case petition, it must be in writing and in the form
prescribed by N.C. General Statutes 150E-23. File the original petition and one copy
with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N. C.
27699-6714.

Elm City Quarry— Permit # 98-13.
Dear Ms. Wehner:
Hanson Aggregates Carolina, Inc. is pleased to forward you the additional
information that was requested by your office in a letter dated June 17, 1999 for
the renewal of the Elm City Quarry Mine Permit (Permit # 98-13). We enclose
two copies of the erosion and sediment control plan (EC-1) which has been
amended as requested.
The erosion and sediment control plan shows the location of the
overburden disposal area along with the required cross sections. The top of the
overburden disposal area is to be sloped towards the mine and a small catch
berm installed at the top of the slope. This berm will help direct the stormwater to
one of three slope drains that are to be installed in accordance with the N.C.
Erosion & Sediment Control Planning and Design Manual. The end of the slope
drain will discharge into a ditch at the base of the overburden disposal area. A rip
rap splash pad will be installed at the base of the slope drain to help reduce
erosion of the drain. Stormwater from the drain will be directed to a settling basin
prior to its discharge from the site, The overburden disposal area will be
vegetated with grasses as described in the approved reclamation plan.
We have taken note of the concerns voiced by NC Wildlife Resources
Commission in their letter dated June 8, 1999. We have excluded the low lying
pond area at the northern end of the permit modification area from the mine
permit. To ensure the preservation of this area we propose to include a 50' buffer
around the area as shown on the plan.

We have reviewed the permitted acreage at Elm City Quarry and have
determined that the correct permitted acreage should be 2.60.2 acres. However
since we have now agreed to exclude the low lying area from the permit we will
have to reduce the permitted acreage by 1.1 acres which will leave the total
permitted acreage as 259.1 acres.
We hope we have provided all the information you require to finalize the
mine permit issuance. However, should you require any additional information do
not hesitate to contact the writer.

Dear Mr. Izzell:
Hanson Aggregates Carolina, Inc. has received a letter from Land Quality
Section asking for additional information before processing the renewal and
modification for the Elm City mine permit ('Permit # 98-13). We would be pleased
if you would address items one and two in the attached letter. To assist you we
provide the following information:
1) In response to comments from Wildlife we have agreed to exclude a portion of
the 23 acre area to be added to the permit. The area to be excluded is shown on
the attached map. Please add this information to the plans.
2) The outline of the maximum area of overburden disposal is shown on the
attached map. The planned height for the overburden is 35-40 feet above natural
ground level and side slopes will be 2:1. The overburden disposal site will be
vegetated. Please amend the plans to include this information and add the
requested cross sections.
3) Please provide the required erosion & sediment control details, including the
need for any slope drains from the overburden disposal area. Show all details on
the maps and provide copies of the calculations.
Please ensure you sent three copies of the required information to the
attention of the writer by July 19, 1999.

The Wildlife Resources Commission has reviewed the project regarding impacts to wildlife and

made on June 7, 1999. Our comments are provided in accordance with provisions of the Fish and Wildlife
Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), Section 40 1(b) of the Clean Water Act
of 1977 (as amended). and the North Carolina Mining Act of 1971 (as amended, 1982: G.S. 74-76 et. seq.,

It is our understanding the applicant is requesting a permit modification to add 23 acres outside the

low-lying area containing a pond With dead Standing timber occurs near or within the far(western) end of
the 23 acre tract. Wetland vegetation, primarily willows, is prevalent along the pond shoreline and
duckweed covers nitich of the wateCs surface. The pond and associated wetlands provide good habitat for
muskrat, great blue heron, wood duck, and various reptiles and amphibians. A red-tailed hawk was also
observed hunting In the pond viclility. If the pond area is within the proposed 23 acre mine addition, We
recommend that the pond area be deleted from the modification request and that a minimum 50 ft, vegetated
buffer be maintained adliacem to wetlands associated with the pond.

We have reviewed the renewal/modification application for this mine
and offer the following comments:
The site appears to primarily drain into the existing water-filled
pit. As long as site grading is performed to direct runoff into the
pit, no operational S&E issues are anticipated_ It appears that
channels and interior S&E measures have been:designed(as evidenced by
the detail sheets), but we do not recall seeing the design previously.
In any event, ECI was left out of our package (which should show the
detailed S&E plan). .DWQ indicates that Hanson has filed for coverage
under their general permit, and DAQ uidicates that a permit
application will be necessary for this site.
As Iong as you have seen/reviewed the detailed S&E, we believe the
site should be OK with the usual stipuations associated with DWQ/DAQ
permitting. l would also add that NCDOT Class I. rip-rap should be
placed at least 18" thick.

2. Minc maps must be accurate and appropriately scaled drawings, aerial photographs
or enlarged topographic maps of the entire mine site. All aspects of the mine site
must bed Labeled on the maps along with their corresponding
(approximate) a reage. As reminder, mining permits can only be issued for
up to 10 years; t us, all mine and reclamation maps must only denote those
activities that a intended to be conducted during the life of the mining
