OPERATING CONDITION #4.B.: Adequate mechanical barriers including, but not limited to diversions, rip rap pits, or ditches shall be provided in the initial stages of any land disturbance and maintained to prevent sediment from discharging onto adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the affected land. Check dams or acceptable alternatives are needed in the ditch at the lowest limits of disturbance. Silt fence should be installed along the-toe of the fill slopes. All bare soils should be appropriately stabilized. 3. OPERATING CONDITION #4.E.: An erosion and sedimentation control plan(s) shall be submitted to the Department for approval prior to any land disturbing activities not indicated on the revised erosion control plan or mine maps submitted with the approved application for a mining permit and any approved revisions to it. Such areas include, but are not limited to expansion outside the approved pit area, creek crossings, or expansion of overburden or waste disposal areas. The Department was not notified in writing prior to the changes in site conditions being implemented. 4. OPERATING CONDITION #11.: The operator shall notify the department in writing of the desire to delete, modify or otherwise change any part of the mining, reclamation, or erosion/sedimentation control plan contained in the approved application for a mining permit and any revisions to it. Approval to implement such changes must be obtained from the Department prior to on-site implementation of the revision. Dear Ms. Wehner: Hanson Aggregates Carolina, Inc. is pleased to forward you the additional information that was requested by your office in a letter dated June 17, 1999 for the renewal of the Elm City Quarry Mine Permit (Permit # 98-13). We enclose two copies of the erosion and sediment control plan (EC-1) which has been amended as requested. The erosion and sediment control plan shows the location of the overburden disposal area along with the required cross sections. The top of the overburden disposal area is to be sloped towards the mine and a small catch berm installed at the top of the slope. This berm will help direct the stormwater to one of three slope drains that are to be installed in accordance with the N.C. Erosion & Sediment Control Planning and Design Manual. The end of the slope drain will discharge into a ditch at the base of the overburden disposal area. A rip rap splash pad will be installed at the base of the slope drain to help reduce erosion of the drain. Stormwater from the drain will be directed to a settling basin prior to its discharge from the site, The overburden disposal area will be vegetated with grasses as described in the approved reclamation plan. We have taken note of the concerns voiced by NC Wildlife Resources Commission in their letter dated June 8, 1999. We have excluded the low lying pond area at the northern end of the permit modification area from the mine permit. To ensure the preservation of this area we propose to include a 50' buffer around the area as shown on the plan. `1 We have reviewed the permitted acreage at Elm City Quarry and have determined that the correct permitted acreage should be 2.60.2 acres. However since we have now agreed to exclude the low lying area from the permit we will have to reduce the permitted acreage by 1.1 acres which will leave the total permitted acreage as 259.1 acres.
