I am the owner of Wildflower Learning Community, a property which is adjacent to Merritt Gravel Pit in Chapel Hill,
North Carolina. At some point in the past, DEQ permitted a haul road for the Merritt Gravel Pit mining operation on the
easement road. My partner, Kevin Poimboeuf, spoke with David Miller at NCDEQ several weeks ago and recorded that
conversation. During that conversation, Mr. Miller stated more than once that DEQ's granting of the permit on the
easement road was a mistake. At the time, the easement road was owned within the Merritt family; however, the
adjacent property has since been purchased by me. I do not consent to the shared easement road being used as a mine
haul road, especially as Mr. Merritt has had difficulty since I purchased the property in controlling the dust from his haul
road (addressed by Orange County) and requiring trucking customers to maintain the 5mph speed limit signs Mr. Merritt
posts on the easement road. Trucks drive extremely fast down the road.
When I tailed Mr. Miller today to find out what process I can begin to let DEQ know that I don't consent to the haul road
being on the easement road, he had completely changed his tune and said that DEQ has nothing to do with that, and it's
my problem. He subsequently hung up the phone twice on me when I asked him to provide me with the name and
contact information for NCDEQ's counsel after he specifically told me that I needed to go speak with DEQ counsel if
wanted to take the matter further. He repeatedly accused me of illegally recording the conversation which is inaccurate,
as NC law allows for such activities with the knowledge of only one person. He became belligerent during the
conversation and eventually hung up (twice), as I mentioned earlier. At no time did I raise my voice or speak in any
manner that is disrespectful to Mr. Miller.
I have requested information about how to proceed with a complaint about the location of the haul road for Merritt's
Gravel Pit. I have thoroughly perused the NCDEQwebsite and do not see any process that addresses this specific issue,
which I know is very unique.

continue to be surprised and confused about people's response to my attempt to gather information about the Merritt
Gravel Pit. I thought that government bodies were intended to support and help citizens. I definitely think that I have
been mistaken about that, because all I've encountered in trying to gather information is resistance and what appears to
be hiding information. I want everyone on this email to know that I am not someone who gives up. If the answer turns
out to be that I can't do anything about this, and there's a policy that addresses it, and it's very clear, I will
wholeheartedly accept that. However, no one has been able to produce any policy or regulation or rule pertaining to this
issue. And the more I ask, the more bitter and resistant folks at the government level appear to be.
Why?
Why not provide the information that simply allows me to request that DEQ revisit this permit and provide me with
information about how it was granted and how it complies with DEQ regulations?

Additionally, the Merritt Gravel Pit has used fencing placed on my property for years as safety fencing to keep the public
out of their mine. I have recently removed that fencing and opened up that area for my farm. Now, the gravel pit's
operations are fully visible and accessible to the public. I do not feel it is my responsibility to help the gravel pit comply
with NCDEQ regulations, especially when it means giving up parts of my own land so that he can use it for his own.

Guidelines for Access: The staff of the Central Office is dedicated to making public
records in our custody readily available to the public for review and copying. We also have
the responsibility to the public to safeguard these records and to carry out our day-to-day
program obligations. Please read carefully the following before signing the form.
1. Due to the large public demand for,file access, we request that you call at least a
day in advance to schedule an appointment for file review so you can be
accommodated. Appointments are scheduled between 9:00 a.m. and 3:00 p.m.
Viewing time ends at 4:45 12.m. Anyone arriving without an appointment may
view the fifes to the extent that time and staff supervision are available.
2. You must specify files you want to review by mine name or permit number, as
appropriate. The number of files that you may review at„one appointment will be
limited to five.
3. You may make copies of a file when the copier is not in use by the staff and if
time permits. Cost per copy is 5 cents per copy. Payment is to be made by
check, money order, or cash in the administrative offices.
4. Files must be kept in the order you received them. Files may not be taken from
the office. No briefcases, large totes, etc. are-permitted in the file review area.
To remove, alter, deface, mutilate, or destroy material in public files is a
misdemeanor for which you can be fined up to $500.00.
5. In accordance with GS 25-3-512, a $25.00 processing fee will be charged and
collected for checks on which payment has been refused.
6. The customer must present a photo ID, sign-in, and receive a visitor sticker prior
to reviewing files.

Your application for renewal and modification of the above referenced
mining permit has been approved. The modification is to expand the mining area
by 4 acres as indicated on the mine man dated March 13. 1998. A conv of the
renewed and modified permit 's enclosed.
The conditions in the renewed and modified permit were based primarily
upon the initial application. Modifications were made as indicated by the renewal
and modification requests and as required to insure compliance with The Mining
Act of 1971. The new expiration date is June 10, 2008, I would like to draw your
particular attention to Operating Conditions Nos. 4 and 5 of your renewed and
modified permit.
- The issuance of a mining permit and/or any modification to it does not
supersede local zoning regulations. The responsibility of compliance with any

In addition to the above, an inspection was made of the above mine on May

approved Reclamation Plan attached to and incorporated as part of this permit, provisions must be made for
the protection of the surrounding environment and for reclamation of the land and water affected by the
permitted mining operation. This permit is expressly conditioned upon compliance with all the requirements
of the approved Reclamation Plan. However, completed performance of the approved Reclamation Plan
is a separable obligation, secured by the bond or other security on file with the Department, and,may survive ----
the expiration, revocation or suspension of this permit.
This permit is not transferable by the pelmittee with the following exception: If another operator succeeds
to the interest of the permittee in the permitted mining operation, by virtue of a sale, lease, assignment or
otherwise, the Department may release the permittee from the duties imposed upon him by the conditions
of his permit and by the Mining Act with reference to the permitted operation, and transfer the permit to the
successor operator,provided that both operators have complied with the requirements of the Mining Act and
that the successor operator agrees to assume the duties of the pen-nittee with reference to reclamation of the
affected land and posts a suitable bond or other security.
In the event that the Department determines that the permittee or permittee's successor is not complying with
the Reclamation Pldn or other terms and conditions of this permit, or is failing to achieve the purposes and
requirements of the Mining Act, the Department may give the operator written notice of its intent to modify,
revoke or suspend the permit, or its intent to modify the Reclamation Plan as incorporated in the permit.
The operator shall have right to a hearing at a designated time and place on any proposed modification,
revocation or suspension by the Department. Alternatively and in addition to the above, the Department

Definitions
Wherever used or referred to in this permit, unless the context clearly indicates otherwise, terms shall have
the same meaning as supplied by the Mining Act, N.C.G.S. 74-49.
Modifications

map dated March 13, 1998. In addition, 20.5 acres of reclaimed land have been released from the original
permitted acreage at this mine site.
Expiration Date
This permit shall be effective from the date of its issuance until June 10, 2008.
Conditions
This permit shall be subject to the provisions of the Mining Act, N.C.G.S. 74-46, et. seq., and to the
following conditions and limitations:
OPERATING NDITI N :
1. A. Any wastewater processing or mine dewatering shall be in accordance with the permitting
requirements and rules promulgated by the N.C. Environmental Management Commission.

B. Any stormwater runoff from the affected areas at the site shall be in accordance with any

app'icable permit requirements and regulations promulgated oy the Environmental Protection
Agency and enforced by the N.C. Environmental Management Commission. It shall be the
permittee's responsibility to contact the Stormwater Section, Division of Water Quality, to
secure any necessary stormwater permits or other approval documents.
2. A. Any mining process producing air contamination emissions shall be subject to the permitting
requirements and rules promulgated by the N.C. Environmental Management Commission
and enforced by the Division of Air Quality.
B. During mining operations, water trucks or other means that may be necessary shall be
utilized to prevent dust from leaving the permitted area.
3. A. Sufficient buffer(minimum 100 foot undisturbed) shall be maintained between any affected

wetland from erosion of the affected land and to preserve the integrity of the natural
watercourse or wetland.
B. Any mining activity affecting waters of the State, waters of the U. S., or wetlands shall be
in accordance with the requirements and regulations promulgated and enforced by the N. C.
Environmental Management Commission.
4. A. Adequate mechanical barriers including but not limited to diversions, earthen dikes, silt
check dams, silt retarding strictures, rip rap pits, or ditches shall be provided in the initial
stages of any land disturbance and maintained to prevent sediment from discharging onto
adjacent surface areas or into any lake, wetland or natural watercourse in proximity to the
affected land.
B. All erosion and sedimentation control measures shall be constructed and maintained as
indicated on the mine map dated March 13, 1998 to prevent off-site sedimentation. At all
times, surface water runoff from the affected areas at the site shall be diverted into the
approved measures.
5. All affected area boundaries (8 acres) shall be permanently marked at the site on 100 foot intervals
unless the line of sight allows for larger spacing intervals.
6. The angle for graded slopes and fills shall be no greater than the angle which can be retained by
vegetative cover or other adequate erosion control measure, structure, or device. In any event,
exposed slopes or any excavated channels, the erosion of which may cause off-site damage because
of siltation, shall be planted or otherwise provided with ground cover, devices or structures sufficient

7. The affected land shall be graded so as to prevent collection of pools of water that are, or likely to
become, noxious or foul. Necessary strictures such as drainage ditches or conduits shall be
constructed or installed when required to prevent such conditions.
S. Existing vegetation or vegetated earthen berms shall be maintained between the mine and public
thoroughfares whenever practical to screen the operation from the public.
9. Sufficient buffer(minimum 100 foot undisturbed, with the exception of the temporary road section
indicated on the mine map dated March 13, 1998) shall be maintained between any excavation and
any mining permit boundary or right-of-way to protect adjacent property.

10. A physical barrier consisting of a fence or earthen berm, etc., shall be maintained around the
perimeter of any highwall.
11. Refuse Disposal
A. No on-site disposal of refuse or other solid waste that is generated outside of the mining
permit area shall be allowed within the boundaries of the mining permit-area unless
authorization to conduct said disposal has first been obtained from both the Division of
Waste Management and the Land Quality Section, Department of Environment and Natural
Resources. The method of disposal shall be consistent with the approved reclamation plan.
B. Mining refuse as defined by G.S. 74-49 (14) of The Mining Act of 1971 generated on-site
and directly associated with the mining activity may be disposed of in a designated refuse
area. All other waste products must be disposed of in a disposal facility approved by the
Division of Waste Management. No petroleum products, acids, solvents or their storage
containers or any other material that may be considered hazardous shall be disposed of
within the permitted area.
C. For the purposes of this permit, the Division of Land Resources considers the following
materials to be "mining refuse" (in addition to those specifically listed under G.S. 74-49 (14)
of the N.C. Mining Act of 1971):
1) on-site generated land clearing debris
2) conveyor belts
3) wire cables
4) v-belts
5) steel reinforced air hoses

D. If mining refuse is to be permanently disposed within the mining permit boundary, the
following information must be provided to and approved by the Division of Land Resources
prior to commencement of such disposal:
I. the approximate boundaries and size of the refuse disposal area;
2. a list of refuse items to be disposed;
3. verification that a minimum of 4 feet of cover will be provided over the refuse;
4. verification that the refuse will be disposed at least 4 feet above the seasonally high
water table; and
5. verification that a permanent vegetative groundcover will be established.
12. An Annual Reclamation Report shall be submitted on a form supplied by the Department by
February 1 of each year until reclamation is completed and approved.
13. The operator shall notify the Department in writing of the desire to delete, modify or otherwise
change any part of the mining, reclamation, or erosion/sediment control plan contained in the
approved application for a mining permit and any approved revisions to it. Approval to implement
such changes must be obtained from the Department prior to on-site implementation of the revisions.

14. The security which was posted pursuant to N.C.G.S. 74-54 in the form of a$30,600.00 Assignment
of Savings Account is sufficient to cover the operation as indicated in the approved application. This
security must remain in force for this permit to be valid. The total affected land shall not exceed the
bonded acreage.
15. A. Authorized representatives of the Division of Archives and History shall be granted access
to the site to determine the presence of significant archaeological resources.
B. Pursuant to N. C. G. S. 70 Article 3, "The Unmarked Human Burial and Human Skeletal
Remains Protection Act," should the operator or any person in his employ encounter human
skeletal remains, immediate notification shall be provided to the county medical examiner
and the chief archaeologist, North Carolina Division of Archives and History.

APPROVED-RECLAMATION PLAN
The Mining Permit incorporates this Reclamation Plan, the performance of which is a condition on the
continuing validity of that Mining Permit. Additionally, the Reclamation Plan is a separable obligation of
the permittee, which continues beyond the terms of the Mining Permit.
The approved plan provides:
Minimum Standards As Provided BY-G.S. 74-53
l. The final slopes in all excavations in soil, sand, gravel and other unconsolidated materials shall be
at such an angle as to minimize the possibility of slides and be consistent with the future use of the
land.
2. Provisions for safety to persons and to adjoining property must be provided in all excavations in
rock.
3. All overburden and spoil shall be left in a configuration which is in accordance with accepted
conservation practices and which is suitable for the proposed subsequent use of the land.
4. No small pools of water shall be allowed to collect or remain on the mined area that are, likely to
become noxious, odious or foul.

practices as established by the North Carolina Agricultural Experiment Station and the North
Carolina Forest Service.
6. Pennittee shall conduct reclamation activities pursuant to the Reclamation Plan herein incorporated.
These activities shall be conducted according to the time schedule included in the plan, which shall
to the extent feasible provide reclamation simultaneous with mining operations and in any event,
provide reclamation at the earliest practicable time after completion or termination of mining on any
segment of the permit area and shall be completed within two years after completion or termination
of mining.
RECLAMATION CONDITIQNS:
1. Provided further, and subject to the Reclamation schedule, the planned reclamation shall be to
regrade and satisfactorily revegetate any disturbed areas.
2. The specifications for surface gradient restoration to a surface suitable for the planned future use are
as follows:
A. All sideslopes shall be graded to a 2 horizontal to 1 vertical or flatter slope.
B. Any settling ponds or sediment basins shall be backfilled and stabilized.
C. The processing, stockpile, and other disturbed areas neighboring the mine excavation shall
be leveled and smoothed.
D. Compacted surfaces shall be disced, subsoiled or otherwise prepared before revegetation.

E. No contaminants shall be permanently disposed of at the mine site. On-site disposal of waste
shall he in accordance with Onerating Condition Nos. 11.A. through D.
F. The affected land shall be graded to prevent the collection of noxious or foul water.
3. Revegetation Plan:
Ater site preparation, all disturbed land areas shall be revegetated as per the seeding specifications
indicated on the mine map dated March 13, 1998.
In addition, the permittee shall consult with a professional wildlife biologist with the N.C. Wildlife
Resources Commission to enhance post-project wildlife habitat at the site.
4. Reclamation Plan:
Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event,
reclamation shall be initiated as soon as feasible after completion or termination of mining of any
mine segment under permit. Final reclamation, including revegetation, shall be completed within
two years of completion or termination of mining.

2. Mine maps must be accurate and appropriately scaled drawings, aerial photographs or enlarged
topographic maps of the entire mine site. • All aspects of the mine site must be clearly labeled
on the maps along with their corresponding (approximate) acreage. As a reminder, mining
permits can only be issued for up to 10 years; thus, all mine and reclamation maps must only
denote those activities that are intended to be conducted during the life of the mining permit.
All maps must be of a scale sufficient (see minimum requirements listed below) to clearly

Two sediment Basins will be provided for the land distribution
activities . One sediment basin is located to collect sediment
runoff from the access road and the other basin is located to
collect runoff from the mine.

S. a. How wide a buffer will be maintained between any mining activity and any adjoining permit
boundary or right-of-way? Buffers must be located vnithin the permit boundaries. Buffers
along permit boundaries must be, at a minimum, unexcavated buffers. Show all buffer
locations and widths on the mine map(s).

mine excavation. Locate all such structures on the mine map if they are within 300 feet of any
proposed excavation.
100 foot buffers will be maintained along all permit boundaries. The excavation will be
sloped to a 2:1 or flatter.
APPLICATION FOR A NIINING PERNIIT
c. Describe what kind of barricade will be used to prevent inadvertent public access along any
high wall area and when it will be implemented. Vegetated earthen berms, appropriate
fencing and adequate boulder barriers may be acceptable high wall barricades. A
construction detaillcross-section and location of each type of barricade to be used must be

indicated on the mine map(s).
The majority of the site has a permitter fence or streams along the
perimeter to discourage public access .
d. Provide a cross-section on the mine map(s) for all fill slopes (berms, wastepiles, overburden
diyno'yal areas, etc_), clearly indicating the intended side slope Rradient, installation of any
benches andlor slope drains (with supporting design information) jf needed, and the method of
final stabilisation.
We do not anticipate having anv dill slopes at this site. The berms to be constructed as
erosion and sediment control and highwall barriers will have 2:1.or utter side slopes.

and indicate the general methods to be used in reclaiming this land. This information must be

• Reclamation activities will be carried out concurrently with mining to keep the total excavation
area to no more than 4 acres at any one time.
• Pit walls and other slopes will be graded to a 2:1 or flatter and stabilized in accordance with
the approved revegetation plan.

The sediment control measures (berm with gravel SIters) will be knocked down, cleanest out,
graded to positively drain and stabilized in accordance with the approved revegetation plan.
7. Describe the method of control of contaminants and disposal of scrap metal, Junk machinery,
cables, or other such waste products of mining. (Note definition of refuse in The L ing Act
of 1971). No off-site generated waste shall be disposed of on the mine site without prior written
approval from the NC Department of Environment, Health, and Natural Resources, Land
Quality Section and either the Division of Solid Waste Management (DSWLvl) or local governing
body. If a disposal permit has been issued by DSWNI for the site, a copy of said permit must
be attached to this application. All temporary and permanent refitse disposal areas must be clearly
delineated on the mine map(s) and reclamation map, along with a list of items to be disposed in said
areas.
No waste material will be disposed of within the mining permit boundaries.
8. fndicate the method of restoration or establishment of any permanent drainage channels to a
condition minimizing erosion, siltation and other pollution.,Provide design information, including
typical cross-sections, of any permanent channels to be constructed as pan of the reclamation plan.
Indicate the location(s) of all permanent channels on the reclamation map.
No drainage channels will be created or disturbed by the proposed mining activities.
9. Provide a schedule of reclamation that indicates the sequence of reclamation and approximate
time frame. If reclamation is to be accomplished concurrently with mining, then clearly indicate on
the mine map(s) and reclamation map each segment that is to be mined and reclaimed daring each
year of the permit. Add drawings showing typical cross-sections and final features of the proposed
reclamation.

10. Describe your plan for revepetation or other surface treatment of the affected areas. This plan

Dear Mr. Merritt:
Engineering & Environmental Science Company has completed the
evaluation of the mine permit renewal . This evaluation included
the erosion control calculations, mine permit application renewal ,
and the mine map showing the mine activities. Following is a brief
discussion of this mine and our evaluations.
GENERAL PROJECT DISCUSSION
The 47 . 7 acres of land where the sand excavation is occurring is
owned by Mr. Billy C. Merritt and Lela Lou Merritt. The property
is located in orange County, approximately two miles south of
Chapel Hill . Access to the mine is through an existing gravel road
that connects the mining area to Damascus Road.
Mining is conducted moving upslope on the topography. The mining
activity generally results in gently sloping ground after
reclamation. As mining progresses, the haul road is relocated on
the past, relatively flat mined, ground. Approximately 20 . 5 acres
of land have been mined and reclaimed in the past, and it is
desired to remove this area from the permit. At present,
approximately 3 . 6 acres of land is exposed in the active mine area,
and 1. 0 acre is exposed for the access road. With removal of the
reclaimed acreage, the new mine permit boundaries represent
approximately 27 . 2 acres. Including the existing access road, the
total exposed ground at any given time will be less than 8 acres.
The majority of the existing access road is well constructed and
stable with vegetated ditches. The only temporary portion of the
roadway is at the previously mined areas that are relatively flat .
The roadway in this area will be flush with the ground and
stabilized with stone.

Reclamation will include removal of all structures except the
stable portion of the access road. All areas will be graded smooth
and sloped for positive drainage. Final perimeter mine slopes will
be 2 : 1 (H:V) or flatter.
EROSION CONTROL CALCULATIONS
The erosion control calculations are contained in the attachment of
this report. The TR-55 method was used to evaluate runoff volume
from the mine area.
Two sediment basins are provided for the mine and the access road.
The basins were designed for the 10-year peak flow rate, and the
outlet stone section was designed for the 25-year peak flow rate.

Dear Mr. Merritt:
The initial review has been completed on your renewal request
for the mining permit for the Merritt Gravel Pit in Orange County.
The following additional information is needed to complete our
review:
1) Page 2 of the application form indicates that only 5
acres are to be covered by this mining permit, yet the
mine map clearly indicates that greater than 5 acres are
to be covered by the permit. It appears that you are
confusing permitted acreage and bonded acreage. The bond
amount is based upon the amount. of land to be affected at
any one time by the mining operation. Your current bond
amount is $2 ,500. 00 and covers up to 5 acres affected.
The permitted acreage includes the proposed mining limits
for the life of the permit (not to exceed ten years) , the
haul roads, buffer zones, sediment and erosion control
measures and any - reclaimed areas that have not been
released from your permit by the Department. The
processing fee is based upon your permitted acreage.
Please revise the mine map and page two of the
application form to indicate how many acres are to be
covered by this permit.
2) All areas to be affected by mining activities at this
site during the next ten years must be located and
labelled on. the mine map, including sediment basins,
buffer zones, haul roads, and areas that have been
previously reclaimed but not released. The mine permit
boundaries must encompass the areas covered by the mining
permit and must be clearly labelled as such on the mine
map.

Furthermore, the original application was for 30 acres.
All areas that have been affected by mining activities at
this site and have not been formally released by the
Department must be within the permit boundaries. We have
received your recent request to have 20 acres released
from this permit. It appears that these areas are
interior to the mine site boundaries. This Section's
policy is that only areas along permit boundaries that
have been satisfactorily reclaimed can be released from
a permit. Releasing areas interior to the permit
boundaries only causes confusion concerning the permitted
area. However, the Raleigh Regional Office Land Quality
Section staff has inspected the areas indicated as
r GiY .l eGaS—\.l {a on jul or mine map. These areas were found to be
sufficiently reclaimed and will no longer be considered
in the bonding amount (unless they are re-affected) , but
these areas will remain within the permitted boundaries.
3) Please note the before you can legally discharge water at
this site, you must contact the Water Quality Section of
the Division of Environmental Management with this
Department concerning permits that may be needed through

An onsite meeting was held between Mr. Merritt, Mrs. Merritt, Dale
Faulkner (surveyor) , John Holley, Debbie Barbee, Tony Sample and
myself today at 10: 00 am. We discussed reclamation and release the
reclaimed areas of their site. I explained the requirements on
mine maps (showing the areas to be released, permitted, etc. ) . I
explained that the permitted area must encompass haul roads, the
approximate mining limits for the next ten years, buffer zones (of
approx. 50 feet) , and sediment and erosion control measures. I
also explained the difference between affected acreage to be
covered by the reclamation bond and permitted acreage. It appears
that they will propose on the new mine map to advance towards the

to be permitted and released and the break-down of the acreage
under the permit. John discussed sediment and erosion control
measures. The Merritts seemed to understand our requirements.

These comments are provided pertaining to Fish & Wildlife concerns
related to the mining permit renewal/modification for Billy C. Merritt
in Orange County. Our comments are provided in accordance with
provisions of the N. C. Mining Act of 1971, (G. S. 74-46 through 74-68,
15 NCAC 5; as amended, 1982) .
The previously mined area is currently planted in lespedeza and appears
to be fairly well stabilized. The surrounding area is mostly pine
woodland with some scattered mixed upland hardwood. The remainder of
the property is an open field with scattered hardwood. Deer, small
mammals, songbirds, raptors and possibly other small game species
currently use most of the property. A small drainage carries water into
two sediment basins and then into a small stream which eventually feeds
into University Lake. The small stream would probably be significant to
the fishery of University Lake. The sediment ponds on the property
appear to be sufficient to contain the runoff. The small area being
mined for sand/sandstone should not be significant for the wildlife that
currently use this property.
We do not expect significant impacts to fisheries or wildlife resources
from activities associated with mining at this site.

operation having unduly adverse effect on wildlife and freshwater fisheries
(G. S. 74-51 (2) ) . Please respond by August 7 , _ 1993 so that we may complete
our review of this request within our statutory time limits.
As is the case in our review of all mining permit applications, renewals
and modifications, this office will carefully review all proposed erosion and
sediment control measures to ensure that they are sufficient to restrain

We have reviewed the subject application and I generally concur
with the attached comments from my staff. However, I offer the
following additional comments for clarification and your
consideration:
(1 ) Information for release of the reclaimed areas has already
been provided to you by Debbie Barbee.
( 2) According to Debbie, the current and proposed mining areas
are flat and should have adequate buffer to serve as
sediment control without the construction of new ponds.
( 3 ) Note the DEM Water Quality comment concerning dewatering.
It is recommended that the operator be reminded that any
dewatering must first be permitted through DEM. The standard
condition should be able to address this with a little
specific wording.
(4) The current permit for this site does not include specific
seeding specifications. I called Ms. Merritt today and she
verbally confirmed the seeding -nix they have been using at
this site with good success (per SCS recommendations) .
Since it is consistent with the specifications in our S&E
manual , I recommend that we add the specifications from page
6 . 11. 20 of the manual to the reclamation conditions in the
renewal permit for consistency with other new and renewed
permits.
