Pursuant to the passage of House Bill 58, which became law on October 4, 2017 as SL 2017-209, all existing mining permits and any newly issued mining permits are to be issued for the life of site or for the duration of the lease term. The"life of site" means the period from the initial receipt of a permit for the operation until the mining operation terminates and the required reclamation is completed. Considering the above, this letter hereby modifies your existing mining permit to remove all references to the prior expiration date to convert your permit to a life of site or lease permit effective immediately. No action is required on your part for this modification to be effective. Please attach this letter to your existing minina permit for future reference. The mine name and permit number on the permit document, and all existing operating and reclamation conditions contained therein, shall remain in full force and effect. Furthermore, all provisions of GS §74-51 and GS §74-52 still apply to all new, transferred and modified mining permits. In addition to the life of site or lease mining permit provision, SL 2017-209 also enacted a new annual mining permit operating fee of$400 per mining permit number. By statute, the initial payment of this annual $400 fee must be submitted to this office by December 31, 2017—see the attached Invoice to remit the initial annual fee payment by this deadline. Beginning in 2018, the$400 annual operating fee must be submitted by July 1 of each year with the required Annual Reclamation Report as required by GS §74-55. Failure to submit the fee by the required deadline will result in a $50/month late fee and could result in the denial of future permit actions and/or revocation of your mining permit. Lastly, pursuant to GS §74-54, the cap on reclamation bonds has been raised from $500,000 to $1 million. Any adjustments needed in existing bonds will be initiated by this office or addressed during your next requested permit action unless you contact this office with a written request to have your bond reevaluated. The issuance of a mining permit andlor any modification to it does not supersede local zoning regulations. The responsibility of compliance with any applicable zoning regulations remains with you, Thank you for your cooperation in this matter. If you have any questions on the above, please contact Ms. Judy Warmer, Assistant State Mining Specialist, or me at(919) 707-9220. The intention was to mine the whole property, not just the initial start square shown on the map. For some reason it was assumed that that initial start square was six acres, when in actuality it is much less that that (I scaled it off from the mine map) . Basically, we need to correct the permit. They can still work it in six acre increments but they intend to mine the entire site. The operational plan is still to conduct mining operations on no more than 6 acres at a time. However, areas previously mined may not be immediately reclaimed upon termination of mining activity, and may be disturbed again at a later date(for example, to provide positive drainage off site). The permit states that the "permitted acreage at this site is 58.56 acres and the amount of land you are approved to disturb is 12.5 acres." Stripped topsoil and other waste soil will be pushed to the buffer line to create a berm along the excavation. The m ber also serves to divert sediment-laden runoff to a sediment basin. At the end of mining activity, this soil is spread over cut slopes to provide a medium for vegetation. Initially,a temporary rock dam will be installed in the northeast corner of the site. Runoff will be directed to this basin by the berms along the perimeter. Mining activity will progress in strips from the east to the west, beginning at the northeast corner and working toward the south. When the work moves beyond the east-west ridge in the approximate center of the mine,a second temporary rock dam may be installed in the southeast corner. Erosion control devices will be checked for stability and operation following every runoff-producing rainfall but in no case less than once each week. Any needed repairs will be made immediately to maintain the integrity and design intention of each measure. 3.a. Access to the project will be provided via a 60' access easement by adjoining property owners. Site Description The subject site is a 58.56 acre parcel that was recently cleared of timber. It is prnpnceri fnr lisp as a sand mine: At any given time, the contractor expects that no more than 6 acres would be disturbed. Furthermore, cut slopes, non-active mine areas, and other disturbed non-mined areas will be seeded and stabilized per NCDENR specifications. As the site is located along a ridge that runs from east to west, runoff from the site generaiiy flows to the nnrth and south. On the north side of the site, most runoff runs to the northeast corner. Much of the runoff from the south half of the site runs toward the southeast corner. A gravel construction entrance will be installed at the entrance.to the property, off the access easement, to prevent trucks from tracking sediment off the mine site. Initially, a (temporary) rock dam will be located at the northeast corner of the site. Runoff will be directed into the rock dam via berms along the 25' unexcavated setback. If needed, a second (temporary) rock dam will be located on the northern property line as shown on the attached map. Temporary and permanent seeding will be applied to all disturbed areas as required to prevent erosion. Collectively, these erosion control measures should prevent the transport of sediment off-site. Refer to the Reclamation Maps (sheet C-1 and C-2) and Detail Sheet (C-3) for proposed final and intermediate contours and locations and details of the erosion control measures described above. Planned Sedimentation and Erosion Control Practices The following erosion control measures will be installed/constructed as shown on the attached grading/drainage plan and detail sheets: 1. Fertilizing, Seeding and Mulching: To be installed as per temporary and permanent seeding specifications. See attachment for specifications. 2. Gravel Construction Entrance: To be installed at the entrance to the landfill as shown on the Mine Map. 3. Rock Dam: To be installed as shown on the Mine Map. Maintenance Plan I. All erosion control practices will be checked for stability and operation following every runoff-producing rainfall but in no case less than once every week. Any Crawfod Project#03019 Page 2 Sedimentation and Erosion Control atrative Raynnine Pit—Harnett County,NC needed repairs will be made Immediately to maintain the integrity and design Intention of every erosion control feature. 2. All seeded areas will be fertilized, reseeded as necessary, and mulched according to specifications in the vegetation plan to maintain a vigorous, dense vegetation cover. If any seeding failure occurs, those areas shall be reseeded rvlth rye grass for temporary stabilization and prepared for permanent seeding. Construction Schedule 1. Obtain all necessary permits and =approvals and hold pre-constructlon conference. 2. Mark the property and buffer lines in the field to delineate where berm is to be placed. 3. Certification of grass seed from seed vendor for each seed mixture. B. Product certificates. 1.4 QUALITY-ASSURANCE A. Ground cover should be provided (seeded, mulched; and tacked)-within a maximum of 15 working days or 90 calendar days, whichever is less, after a land disturbing activity. B. Maintain and establish disturbed areas by watering, fertilizing, weeding, mowing, trimming, replanting, and other operations to produce a uniformly smooth lawn for not less than the following: 1. Permanent groundcover: 60 days after date of Substantial Completion. Thereafter, maintain at 3 month intervals minimum during the one year warrantee period on or about the 15 of the month to maintain growth. 2. Erosion Control Temporary Seeding - Install as required to minimize erosion. Minimum 15 days after a land disturbing activity in accordance with The North Carolina Department of Environment & Natural Resourses (NCDENR). 1.5 PROJECT CONDITIONS A. Utilities: Determine location of above grade and underground utilities and perform work in a manner which will avoid damage. Hand excavate as required. Maintain grade stakes until removal is mutually agreed upon by concerned parties. CRAWFORD DESIGN COMPANY IIwruDSCAPINC_ 02900- 1 0 • B. Excavation: When conditions detrimental to plant growth are encountered, such as rubble fill, adverse drainage conditions, or obstructions, notify Engineer before planting. C. Contractor shall seed all areas disturbed by the construction phase. PART 2 - PRODUCTS A. Grass Seed: Fresh, clean, dry, new-crop seed complying with the Association of Official Seed Analysts' "Rules for Testing Seeds" for purity and germination tolerances. 1. Seed Mixture: Provide seed of grass species and varieties, proportions by weight, and minimum percentages of purity, germination, and maximum percentage of weed seed as indicated. B. Topsoil: ASTM D 5268, pH range of 5.5 to 7, 4 percent organic material minimum, free of stones 1 Inch (25 mm) or larger in any dimension, and other extraneous materials harmful to plant growth. 1. Topsoil Source: Reuse surface soil stockpiled on the site. Verify suitability of surface soil to produce topsoil meeting requirements and amend when necessary. Supplement with imported topsoil when quantities are Insufflclent. Clean topsoil of roots, plants, sods, stones, clay lumps, and other extraneous materials harmful to plant growth. C. Lime: ASTM C 602, -Class T,--agricultural limestone, applied at the rate of 2 tons/acre. D. Commercial Fertilizer: Commercial-grade complete fertilizer of neutral character, consisting of fast- and slow-release nitrogen, 50 percent derived from natural organic sources of urea-farm, phosphorous, and potassium in the following composition: 1. Composition: 800-1000 lbs/acre of 10-10-10 (or the equivalent). PART 3 - EXECUTION A. Lawn Planting Preparation: Loosen subgrade to a minimum depth of 4 inches (100 mm). Remove stones larger than 1-1/2 Inches (38 mm) in any dimension and sticks, roots, rubbish, and other extraneous materials. 1. Spread planting soil mixture to 4-inch depth to meet thickness, grades, and elevations shown, after light rolling and natural settlement. Do not spread if }I Flan coil o subgrade is frozen, o'iuiy wn or .-.y,......,. 2. Place approximately 1/2 the thickness of planting soil mixture required. Work into top of loosened subgrade to create a transition layer and then place remainder of planting soil mixture. CRAWFORD DESIGN COMPANY LANDSCAPING 02900- 2 B.
