Thank you for the call today. The current permittee requests release from the mining permit based
on the modified reclamation plan. The property has been sold.The current developer is preparing
the project for construction. We'll notify you once construction activities begin in accordance with
the approved erosion control plan for the subdivision so that a reclamation inspection can be
performed, and the mining permit released. Thanks again for all your help on this project.

Here is the ADI letter from April. Now that the permit modification has been issued to modify the
reclamation plan, a release could occur once development is occurring under the newly approved
Erosion Control Plan.

Can you resend us the letter you reference below. I don't recall ever receiving it.
Our client has finally received their NCDEQ Stormwater permit and is preparing to being
construction in ASAP.
I have copied our client and the original mine permitee on this email for their records.

Tammy,
The modification to the reclamation plan ( to go to a residential development) was issued June 7,
2022. In the letter we stated that a release of the permit will only be considered by the Department
once development under the Erosion Control Plan # Bruns-2022-083 has been initiated.
If the permit is released the annual fee will not need to be paid, however if the permit is not
released then the annual fee is still due September 1, 2022.
Please let us know if development under Bruns-2022-083 has started and if there is a requested
release. We can have an inspector verify and then release the permit.

The annual renewal has been issued for the permit. In lieu of the pending request, they were
questioning as to whether or not this should be paid.
Please advise on the status of the release and if the annual fee will need to be paid.
