If yes,cite evidence of such mining activity: X At the time of the site visit,NC DEMLR personnel observed stockpiles of materials located within the mine permit boundaries and observed equipment located within the pit. Was the mine operating at the time of inspection?If yes,explain: X Is the mine in compliance with the Operating Conditions of the permit?If no,explain: X • In accordance with Operating Conditions 4.0 of the Permit, "Mining activities shall occur as indicated on the Mine Map Sheets C1 and C2, both received by the Land Quality Section on September 16, 2011, and the supplemental information received by the Land Quality Section on February 24, 2011, May 12, 2011, and July 21, 2011."At the time of the site visit,NC DEMLR personnel observed mining activities occurring outside the mining area as indicated on the approved Mine Map. • In accordance with Operating Conditions 3.A of the Permit, "Sufficient buffer (minimum 50 foot undisturbed) shall be maintained between any affected land and any adjoining waterway or wetland to prevent sedimentation of that waterway or wetland from erosion of the affected land and to preserve the integrity of the natural watercourse or wetland."At the time of the site visit,it appeared that mining activities have occurred within the wetlands and within the fifty(50) foot buffer adjacent to the wetlands as indicated on the Mine Map. • In accordance with Operating Conditions 12 of the Permit, "The operator shall notify the Department in writing of the desire to delete, modify, or otherwise change any part of the mining, reclamation, or erosion/sediment control plan contained in the approved application for a mining permit or any approved revision to it. Approval to implement such changes must be obtained from the Department prior to on-site implementation of the revisions." • The operator shall install and/or maintain erosion control measures to include, but not limited to, adequate mechanical barriers, construction entrance, etc. in accordance with Operating Conditions 4.A of the Permit and the approved Mine Map. • The mine permit boundaries shall be permanently marked at the site on 100-foot intervals unless the line of sight allows for larger spacing intervals. Is the mine in compliance with the Reclamation Conditions of the permit?If no,explain: X At the time of the site visit, NC DEMLR personnel observed efforts to stabilize slopes associated with the mining pit. Therefore, the operator shall continue efforts to reclaim the slopes by establishing adequate cover of grass or other groundcover sufficient to restrain accelerated or man-made erosion. Is there any off-site damage?If yes,describe the type and severity of the damage: X During the site visit,NC DEMLR personnel observed mining activities within the undisturbed 50-foot buffer adjacent to wetlands and within wetlands located on the western portion of the mine. In addition,NC DEMLR personnel observed mining activities located outside of the approved mine permit boundaries located along the eastern portion of the mine. However, NC DEMLR personnel met with the operator on July 22"d and observed maintenance performed on the construction entrance. Is there potential for off-site damage? If yes,explain: X Corrective measures needed and/or taken: • Submit a major mine modification for the additional acreage that has been mined outside the approved mining boundaries. • Perform reclamation activities within the wetlands. • Install and maintain the erosion control measures as indicated on the approved Mine Map. • Maintain the construction entrance in accordance with the approved Plan in order to reduce off-site tracking of sediment onto the public roadways. • Mark the mine boundaries as indicated on the approved Mine Map and in accordance with the Permit. • Ensure that all mining is in compliance with all reclamation conditions of the Permit. For instance, reclamation shall be conducted simultaneously with mining to the extent feasible which includes grading side slopes to 3:1 or flatter to the water line and 2:1 or flatter below the water line. Other Recommendations and comments: NC DEMLR will issue the operator a"Notice of Deficiency,"due to the violations observed during the site visit which includes failing to submit a major mine modification prior to mining outside the approved mining boundaries. Is the Annual Reclamation Report map accurate? X 2021-2022 ARR has not been received and/or reviewed as of yet by the Wilmington Regional Office. Is the mine in compliance with the NPDES NCG02 permit requirements? X Stormwater pollution prevention plan Monitoring requirements During the site visit, NC DEMLR personnel did not observe dewatering activities occurring within the mine permit boundaries. However,the operator shall adhere to an approved dewatering plan and perform monitoring requirements in accordance with the Permit associated with this mine i.e.NCG020690 .
