As discussed,Norris&Bland has been retained by Mr.Williamson to assist in efforts to bring the proj ect into compliance. We discussed meeting Mr. Lambe on site to review all issues with the project so we may have a full understanding. The first course of action after our site meeting will be to order a full survey of the project to determine the extent of noncompliance. We agreed with Mr. Lambe that development of a new mining plan is needed as the previously approved plan is somewhat rudimentary and requires more detail. The noted violations will be corrected with the development of a new plan. The following corrections will result from survey and plan development: 1. Operating Condition 3A: Survey will reveal the extent of any buffer disturbance. Plans will indicate re-establishment of buffers where necessary for compliance. 2. Operating Condition 3C: Survey will re-establish the wetlands as indicated on the wetland map from February 2007. All wetlands will be identified, and 50 buffers will be identified if any required buffer has been disturbed,then it will be re-established to meet compliance requirements. 3. Operating Condition 4G: The approved limits excavation will be identified on site by survey in accordance with approved plans dated November 7, 2006. 4. Operating Condition 5: All affected area boundaries will be clearly identified on site by survey. Regarding required corrective measures we offer the following: A. The mining permit will be modified based on the development of a new mining plan. The new mining plan will require a survey of existing conditions. Development of a new plan will be contingent upon the surveyor's workload and availability. NCBELS License C-5102 Daniel Sams Notice of Violation February 28, 2024 N&B#24022 Page 2 B. Currently, we have instructed Mr. Williamson to install silt fence around all stockpiles. He will also install silt fence adjacent to any disturbed area adjacent to apparent wetlands. Silt fence will also be installed on the low side of disturbed areas to prevent sediment runoff to undisturbed areas. We also recommended that disturbed areas be stabilized as soon as possible where possible. C. Once Norris & Bland meets Mr. Lambe on site, we will order a survey for all areas of concern. Once survey is received,we will develop an Erosion and Sedimentation plan to bring all disturbed areas into compliance. D. Norris & Bland has advised Mr. Williamson to remove debris and begin stabilization efforts on disturbed areas. The survey will reveal extent of required cleanup. The Norris &Bland plan will identify areas for reclamation as well as areas to be included in the mine permit boundary area. E. Norris &Bland spoke to Mr. Lambe regarding the required NPDES permits. Norris &Bland has filled out the required NCG020000 & NCG210000 and are prepared to submit them. Each application requires a site plan with site plan checklist included in the required items section. Unfortunately,we cannot develop an accurate site plan that reflects current site conditions without updated survey data. We have requested to meet Mr. Lamb onsite to review the project and all areas of concern so we may order all required surveys for plan development. Mr. Williamson indicated that dewatering from the permitted mine area flows via swale to an existing pond. He indicated that it was his understanding at the time of the original permit that since the dewatering discharge was routed to an existing pond that a permit was not required. We have had further discussions with Mr. Lambe about this and will be filing for all necessary dewatering permits. We can file this permit application now and reference the previously approved mining plans or we can file the application at the same time we are filing for the mine modification.
