Dear Mr. Parr;
On behalf of Mr. Ralph Thomas, I am writing in response to your May 15, 2024 letter
requesting additional information on the above-referenced mining permit modification
application. We apologize for the delay in this response; we have been waiting for field
inspections and correspondence from the US Army Corps of Engineers as well as CAMA.
First, we have sent the required Notifications to Stevie and Jacqueline Wall and Emerald
Property Management, LLC. Copies of the Certified Mail Receipts are attached.
The US Army Corps of Engineers and CAMA have confirmed that there are no jurisdictional
wetlands or waters within the permitted area, and not within at least 50 feet of the permit
boundary. This is different from what was submitted with the original site plan and application,
so the plans have been modified to reflect this change. I have attached the revised wetland and
CAMA Jurisdictional Determination, as well as a copy of the email correspondence from Emily
Hughes, USACE. Also, according to Don Quinn, the wetlands specialist with Probe Resources
that performed the JD and has worked with the USACE and CAMA on this project, there is no
"intermittent stream" immediately south of the project. It is simply just another ditch, similar to
the other ditches in the area. The USGA map attached confirms this observation. It will not be
affected any more than the current mine affects it.
Since the CAMA "coastal wetlands" have been revised by CAMA, the mine map now shows
the correct placement.

Attached is a corrected project limits sketch, I had the wrong name on the first one I sent you. Photo of the
ditches/swells, they are now overgrown and hard to photograph.As you can see in the project limits drawing
the site falls towards the east(toward Hwy 70).A letter of concurrence will work for this project if that helps you
any.
