Box 6478, High Point, NC 27262 www.tlot-thwee;tgeo5cience.com NG eological Corporation License#442 July 29, 2024 Ms. Ann Davis 418o Davis Hardy Road Kinston, NC 28504 Via Electronic Mail: anndavisPdallas.ne+ Subject: Review of Mining Permit Application Proposed Rouse Sand and Gravel Pit Davis Hardy Road Kinston, NC Dear Ms. Davis: Northwest Geoscience, PC (NWGS) has reviewed the application for a mining permit for the proposed Rouse Sand and Gravel Pit adjacent to the Davis property on Davis Hardy Road in Kinston, North Carolina with respect to compliance with the requirements with the application. It is our understanding that a geologic assessment has not been conducted and we have not done so either. Based on our review, we believe there are numerous deficiencies with the application. These are discussed below along with the applicable section of the permit. 1. Section B1. The portion of the USGS 7.5 minute quadrangle map was included in the application does not show the site boundaries. 2. Section B3£ The acreage of the stockpile areas has not been stated on the maps. 3. Section B39. The acreage of overburden disposal areas has not been stated. 4. Section Ban. The location of Belch Branch has not been labelled,the too year floodplain for the branch has not been shown on the mine map and numerous blue line streams have not been identified. 5. Section B3q. The scale of the mine map is 1 inch = 200 feet which does not comply with the 1 inch = 50 feet requirement for a permitted site under 49 acres. 6. Section C6A. Having steeper side slopes below the water table will likely result in slumping of the side walls. The side slopes should be consistent. The 2:1 side slope is not consistent with the rules. 7. Section C6B. There are no cross sections for the overburden disposal areas. S. Section Di. There is no reclamation plan map showing the site after mining has ended. No final cross sections are included. 9. Section Et. The temporary sedimentation and erosion control measures calculations and subsequent costs are incorrect due to the omission of the cedar tree buffer. 1o. Section E1. The existing sand pit is to be reclaimed therefore the reclamation bond is incorrect due to the additional acreage. 11. During the initial removal of material prior to encountering the groundwater, what will be the source of water for dust control? 12. The site map was not prepared by a North Carolina Engineer or Land Surveyor as no metes and bounds are shown to delineate the property lines. Based on these deficiencies, the permit should not be approved. Your pulmonary condition is sufficient on its own merit to deny the permit as stated by Dr. Dennis Darcey, MD, MSPH, FACOEM, Division Chief, Division of Occupational and Environmental Medicine, Department of Family Medicine and Community Health, Duke University School of Medicine.
