NORTH CAROLINA Interim Director Environmental Quality May 16, 2024 Certified Mail Return Receipt Requested 7022 0410 0003 1130 7960 Mr. Jason Conner BV Hedrick Gravel and Sand Company PO Box 425 Swannanoa,NC 28778 RE: Lake Norman Quarry Mining Permit No. 55-01 Lincoln County Catawba River Basin Dear Mr. Conner: We have reviewed the modification request your company submitted for the referenced mine site. In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: 1. The permit boundary on the property owner map does not match the permit boundary on the mine map. Please clarify the discrepancy and please add the property lines and owners of record to the mine map. 2. The permit boundary on the mine map does not extend to the public road. N.C.G.S. §74-49 defines "affected land"as the surface are of land that is mined, the surface area of land associated with a mining activity so that soil is exposed to accelerated erosion, the surface area of land on which overburden and waste is deposited, and the surface area of land used for processing or treatment plant, stockpiles, nonpublic roads, and settling ponds. Please clearly indicate and label on the mine map that the haul road to the nearest public road is included in the Mine permit boundary. 3. Please clearly indicate and label on the mine map the stream buffers to the relocated Forney Creek on the Mine map. The relocated stream and buffers should be labeled on the same map that shows the related mining activities and permit boundary. 4. Please address the enclosed comments from the Mooresville Regional Office Please note, this office may request additional information, not included in this letter, as the mining application review progresses.
