Luck Stone has completed the following responses to the permit modification comments. Please review the following NCDEQ comments, the appropriate Luck Stone response and all attachments: 1. The application indicates that the excavation will be dewatered,however the withdrawal rate was indicated to be 0 GPD. Please update your estimate of the expected daily withdrawal rate or indicate that dewatering will not occur. Luck Stone Response-At this time,we're unaware of how much dewatering will be necessary during excavations. For that reason,we have not yet selected an appropriate pump or dewatering method. It should be noted that the NPDES Permit requires flows be recorded and submitted onto state discharge monitoring reports(DMRs). In summary, the current dewatering withdrawal rates is"to be determined:' 2. Please clarify if an updated groundwater monitoring plan will be submitted before dewatering activities begin. Luck Stone Response- Luck Stone intends to complete an updated groundwater monitoring plan in the very near future,prior to initial dewatering activities. 3. The previously approved and submitted 404 permits cover disturbance for the previously approved haul road.Please verify that you will acquire all necessary 401/404 certifications for any proposed disturbances for which they are required. Luck Stone Response-The appropriate impact permits have been acquired and are attached with this submittal. All future impact permit approvals will be submitted once acquired(prior to associated activities). 4. Please add the county name,Lee County,to all Mine Maps. Luck Stone Response-The attached mine maps have been updated to included locality information. 5. On-site fuel storage is proposed in this application. Please mark on the Mine Maps the proposed location for fuel storage. Luck Stone Response-The attached mine maps have been updated to include fuel storage information. 6. Please provide construction details/cross-sections for all proposed barricades,including fencing and berms,and show their locations on the Mine Maps. Luck Stone Response—This permit submittal was primarily to show the updated mine access road and new permit boundary. There are no true operational changes being submitted at this time. All prior approved operational and design information submitted through Little River should remain our plan until future operational changes have been submitted. 7. Please provide proof of an access easement or a right of way agreement allowing access to lands owned by Greenfield Timber,LLC. Luck Stone Response—Greenfield Timber,LLC is an entity of Luck Stone Corporation. 8. Please provide proof,such as the green card receipts,that neighboring landowners Tom Harrington and Greenfield Timber LLC have been notified of this modification,as well as Lee County Manager Lisa G.Minter and Sanford City Manager Phillip Hegwer. Luck Stone Response—All additional notifications have been sent. As noted in response 7,Greenfield Timber LLC is an entity of Luck Stone Corporation and does not need to be notified. Please see the attached certified return receipts for the remaining three neighbors. 9. Please see and address the attached comments from the Raleigh Regional Office. Luck Stone Response—Please see below responses to Raleigh Regional Office comments. 10. Clarify if additional culverts,pipes,or diversion ditches are planned for installation along the access road. Due to topography,it is likely such structures will be necessary. a. Provide design calculations for culverts and storm sewers(include HW,TW,and outlet velocities). b. Provide adequate pipe inlet and outlet protection for the culverts. Luck Stone Response—A design including the erosion and sediment control package has been completed and submitted to the city of Sanford. This package has been approved. NCDOT encroachment permits are on going and will be completed prior to entry from NC Highway 87. The package submitted to the city has been attached along with the city approval. 11. Provide perimeter erosion and sediment control measures around the existing and proposed access road to prevent erosion and sediment from transporting outside of the permit boundaries. Luck Stone Response—A design including the erosion and sediment control package has been completed and submitted to the city of Sanford. This package has been approved. NCDOT encroachment permits are ongoing and will be completed prior to entry from NC Highway 87. The package submitted to the city has been attached along with the city approval. 12. Provide a plan detail and specific construction sequence for the installation of the proposed bridge across the wetlands onto the site. Ensure any additional temporary work area necessary for this installation is shown on plans. Luck Stone Response—A plan detail will be provided to the state prior to construction. Currently, applications for USACE 404 individual permitting and a CLOMR package are under review by the respective agencies and localities. Appropriate plan detail as well as supporting regulatory agency approvals will be provided at a later date,prior to disturbance. 13. Provide a copy of the USACE 404 permit for the office file.identify the permitted impacts and impact areas on the erosion and sedimentation control plan sheets to correspond with the USACE and DWR documents.include any additional measures,construction specifications,maintenance requirements and construction sequencing as required by the 404/401/Buffer Determination and Buffer Authorization on the plan sheets. . 1 Luck Stone Response—The approved USAGE 404 permit related to the entrance road has been attached with this package. A separate application is currently under review for all future impacts associated with development of the site. 14. Please provide construction and maintenance details for the access road proposed,including roadway material. Luck Stone Response—A design including the erosion and sediment control package has been completed and submitted to the city of Sanford. This package has been approved. NCDOT encroachment permits are ongoing and will be completed prior to entry from NC Highway 87. The package submitted to the city has been attached along with the city approval. 15. Provide a construction entrance from the access road onto NC Highway 87(or the access point that connects exposed sediment areas to paved surfaces)to prevent sediment tracking from the site onto the public roadway. Luck Stone Response—A design including the erosion and sediment control package has been completed and submitted to the city of Sanford. This package has been approved. NCDOT encroachment permits are ongoing and will be completed prior to entry from NC Highway 87. The package submitted to the city has been attached along with the city approval.
