Mining Permit Modification
Neuse River Basin
Submitted are two (2) copies of the revised mine maps/specifications, portions of the mine
application that have been modified, and evaluation for the above referenced project. The revisions
were based on the comments from NCDEQ-DEMLR in a letter dated October 26, 2023. The
following are responses to the review comments.
1. Please provide proof, such as copy of the signed return receipts from certified mail, that all
adjoining landowners and chief administrative office of each county and municipality have
been properly notified.
Attached are the returned receipts from the certified mailings. One of the recipients did not
sign the return receipts,one of the recipients did not claim the letter,and one of the recipients
may have not received the letters although the addresses used were from the Wilson County
Tax Department.
2. Please provide proof that you have submitted your NOI for your NPDES Stormwater permit.
Attached is the proof of submittal to the Stormwater Section.
3. Please clarify the mining process. You've proposed that no mining below the water table nor
dewatering will occur. However, you've proposed reclaiming the site as a lake once ruining
is complete. Pease clarify how you intend to maintain more than 4' of water in the lake if
mining below the water table is not to occur.
The attached Page 7 of the application has been changed to reflect excavation below the
water table. However, no dewatering will be conducted. Excavation will be with an
excavator that can reach an average depth of 25 ft. Groundwater is shallow and several
former excavations west of the site show shallow groundwater conditions.
4. There are potential intermittent features depicted on the NRCS Soil Survey which would be
impacted by the excavation pits. This project contains impacts to wetlands and the
aforementioned streams, which is an activity that must be authorized by the DWR/IJSACE.
Please provide additional details on the wetland and stream disturbance. This may require a
Jurisdictional Determination, Buffer Determination, or 401 Water Quality Certification.
Pease provide proof of correspondence/approval from USACE and DWR for the disturbance.
Attached is proof of PCN submittal to USACE and NC Division of Water Resources.
5. Please provide proof of 401/404 approval from DWR and USACE for the wetland crossing
or provide proof of correspondence from DWR and USACE stating why 401/404 is not
needed.

6. Please provide construction and maintenance details for the wetlands crossing.
The roads on the mine maps are existing roads installed during logging. For the stream
Crossing at Culvert 4 and the wetland Crossing at Culvert 5, 1.5 ft. high berms will be
added to the road that crosses these features. Detail on Sheet D-1 shows the road cross
section.
7. Pease provide geographic control points (e.g., latitude/longitude) for the mine permit
boundary, so that the permit boundary shown on the map can be verified in the field.
The North Carolina coordinate system was used to provide control points for the boundary
of the mine permit limits. These points are shown on Sheet C-1.
8. Please provide maintenance and construction details for the diversion berm and perimeter
berm. This should include vegetive stabilization.
The berm detail has been modified on Sheet D-1.
9. Please provide additional details and skimmer basin emergency spillway liner installation.
Proper installation will be critical to ensure it functions as needed.
Sheet D-1 provides the details for anchoring the spillway liner.
10. Please provide additional details on the diversion berm to ensure that sheet flow to sediment
basins is minimized and inflow occurs upstream of the first baffle.
The basins have perimeter berms that ensure that the stormwater will pass at the inlet of
the basin.
11. You've indicated in your application (C.10)that future tree plan planting will provide
screening from public view. Please clearly identify and label on the mine map the location of
the future plantings.
Page 10 of the application has been modified (see attached). The existing trees should
proved screening without planting new trees.
12. You've shown mine haul roads withing the 50' undisturbed wetland buffer. Please clarify the
use of theses roads and explain how impact to wetland will be mitigated if there is a haul
road within 50'.
The roads shown on the mine maps were installed for logging. The roads in the wetlands
will not be used except for the most northern and eastern road within the mine permit
limits.
