FURTHER ORDER TO PERMANENTLY CLOSE AND ABANDON A
PORTION OF LASSITER ROAD LOCATED SOUTH OF TILLMAN ROAD
AND NORTH OF MARY EVANS ROAD MEASURING APPROXIMATELY
3228 LINEAR FEET , ADJACENT TO VULCAN LANDS LLC .
WHEREAS , pursuant to G . S . 153A-241 , on August 1 , 2023 , the County of Richmond adopted a
Resolution declaring its intent to close and abandon a portion of Lassiter Road ( SR 1123)
located south of Tillman Road and north of Mary Evans Road measuring approximately 3228
linear feet adjacent to Vulcan Lands LLC , in Richmond County , North Carolina , conditioned
upon NCDOT' s stated willingness and intent to abandon any property interest it has , or may
have , in the roadway easements , and/or rights-of-way of said portion of Lassiter Road , and
calling a public hearing on the question ; and
WHEREAS , the Richmond County Board of Commissioners directed the county clerk to carry
out the following statutory requirements :
The County Clerk caused a notice of the public hearing to be held on Tuesday
September 12 , 2023 , and reasonably calculated to give full and fair disclosure of the
proposed closing to be published in the Richmond County Daily Journal once a week for
three successive weeks before the hearing ,
The County Clerk sent a copy of the Resolution by registered or certified mail to each
owner as shown on the county tax records of property adjoining the public road ; and
The County Clerk caused a notice of the closing and public hearing to be prominently
posted in at least two places along the road .
WHEREAS , a public hearing was held at 5 : 30 PM by the Richmond County Board of
Commissioners on September 12 , 2023 , at 105 West Franklin Street Courtroom C ,
Rockingham , NC 28379 for the purpose of giving consideration to close and abandon that
portion of Lassiter Road ( SR 1123) located south of Tillman Road and north of Mary Evans
Road measuring approximately 3228 linear feet adjacent to Vulcan Lands LLC conditioned upon
NCDOT' s stated willingness and intent to abandon any property interest it has , or may have in
the roadway easements , and/or rights of way of said portion of Lassiter Road ; and
WHEREAS , at its meeting on the 12th day of September, 2023 , the Richmond County Board of
Commissioners found that closing the requested portion of Lassiter Road is not contrary to the
public interest , and that no individual owning property in the vicinity of the road will thereby be
deprived of a reasonable means of ingress and egress to their property ; and
WHEREAS , on September 12th , 2023 , the Richmond County Board of Commissioners adopted
an order closing and abandoning the requested portion of Lassiter Road , conditioned upon
NCDOT' s stated willingness and intent to abandon any property interests it has , or may have , in
the roadway easements , and/or rights of way of said portion of Lassiter Road ; and .
WHEREAS , said order was recorded in Book 1977 , page 083 of the Richmond County Register
of Deeds Office ; and
WHEREAS , on November 15th , 2023 , the NCDOT' s Board of Transportation approved the
abandonment of any property interest that it had , or may have had , in the roadway easements

or rights-of-way in that portion of Lassiter Road (SR 1123 ) located south of Tillman Road and
north of Mary Evans Road measuring approximately 3228 linear feet , adjacent to Vulcan Lands
LLC .
NOW, THEREFORE , IT IS HEREBY ORDERED that the portion of Lassiter Road (SR 1123)
located south of Tillman Road and north of Mary Evans Road , Richmond County , North
Carolina and measuring approximately 3228 linear feet adjacent to Vulcan Lands LLC , and as
shown on that plat identified as Exhibit A , and more particularly described by metes and
bounds in that document identified as Exhibit B ( both Exhibit A and Exhibit B being attached
hereto and incorporated herein by reference) is permanently CLOSED AND ABANDONED by
the County of Richmond , North Carolina , as of and including , November 16 , 2024 .
BE IT FURTHER ORDERED that pursuant to G . S . 153A-241 , all rights , title , and interest in the
aforementioned portion of Lassiter Road has vested in Vulcan Lands LLC for the width of its lots
or parcels of land adjacent to said portion of Lassiter Road , and that Vulcan Lands LLC ' s right,
title , and interest extends to the center of said portion of Lassiter Road .
BE IT FURTHER ORDERED that a certified copy of this Order be recorded in the office of the
Register of Deeds for Richmond County .
