Dear Mr. Parr:
I am writing to you on behalf of Tildon Whitehurst, Jr., operator of Haskett Mine, permit #72-21, in
Perquimans County. This cover letter is in response to your letter of May 22, 2023, requesting further
information on Mr. Whitehurst's application for modification of the permit. Items addressed are as follows:
• Floodplain limits are now shown on revised 100:1 mine map enclosed.
• Structures within 300 feet of excavation-revised 100:1 and 200:1 mine maps enclosed show all
dwellings within 300 feet of the original permitted excavation boundary.
• Cross-sections of fill slopes and berms are shown on revised 100:1 mine map enclosed.
200:1 mine map with entire permit boundary enclosed.
• Water discharge during reclamation-revised Addendum 1 (page 6.c.ix - Sequence of Events and
Operation) enclosed with discussion of unlikely discharge of water during reclamation.

C. Protection of Natural Resources
Haskett Mine is an existing permitted 9.55-acre excavation in a 16.58-acre permit area owned by
Whitehurst Sand, Inc. Excavation activities began in 2009 and have currently ceased, having excavated
6.4 acres. Owner now proposes to fill in the 6.4-acre excavated pond with clean fill sand and soil
brought onto the site from outside the permit area. Sequence of events to do so are as follows:
1. Sequence of Events for Development and Operation:
a. Operator will obtain all required mining permits from NCDEQ.
b. Operator will maintain one gravel construction entrance at intersection of mine access
road and SR 1129 Woodville Road.
c. Operator will maintain existing foliage visual screen along perimeter of the affected area.
d. Operator will begin filling existing 6.4-acre excavated pond (400'x 700')with clean fill soil
until surface height reaches that of surrounding existing natural ground level.
i. Source of soil will be from various offsite locations used by land developers
contracted to Whitehurst Sand, Inc., who need removal of unneeded clean soil
from their location. Whitehurst Sand personnel will also bring in clean soil fill
from Whitehurst contracted jobs in the area.
ii. Soil fill will be free of contamination from metal, plastic, rubber, wood or wood
by-products,asphalt,concrete, land clearing debris,construction and demolition
debris, medical waste,or municipal solid waste.
III. All soil brought in to the Haskett Mine site will be generated from properties
where there has been no known release of contaminants, and that is generally
approved for unrestricted use.
iv. No soil will be accepted from offsite properties contaminated by the release or
migration of contaminants.
v. Clean soil will be transferred to and stockpiled along the northern top edge of the
Haskett Mine 6.4-acre excavation, where it will be leveled and then pushed into
the pond with bulldozer and excavator.
vi. As soil is placed in the pond, excavators, bulldozers, and other heavy equipment
will compact the soil to form a firm base.
vii. Over a period determined by market conditions, estimated to be several years,
Whitehurst Sand personnel will continue to fill the pond with clean soil up to
surrounding normal ground level.,working their way across the entire pond,and
compacting the soil as they go.
viii. Water level in unfilled portion of the pond is expected to remain the same during
RECEN `.? the life of the filling period due to the relatively small amounts of fill added
JUL 2 d 1823 compared to size of the pond and length of time taken to fill the pond. Pond
water should have time to percolate naturally into groundwater level as filling
LAND QUALIT occurs.
MINING PROGRPM ix. If necessary,operator will pump remaining water from the Haskett Mine pond to
prevent overflow around pond edges during filling operation. Pumped water will
be transferred to an existing 0.93-acre foliated pond north of the Haskett Mine.
This north pond was formerly used as a sedimentation pond, has an active NPDES
COC permit #NCG020748, and has no overflow or discharge to Waters of the
State.
e. Soil fill brought in to the site will be regulated by Whitehurst Sand personnel who will
monitor the soil for contaminants that are not acceptable as beneficial fill at Haskett
Mine.
f. Once the excavated pond has been filled with soil up to the same level as that of normal
surrounding ground level,Whitehurst Sand personnel will continue adding soil to the site
and form a 2-ft tall, ridged mound in the center of the former excavated area with slopes
tapering to natural ground level at the edges. Peak of the ridged mound will be 200 feet
from all former edges of excavation.
g. All soil placed on the site will be compacted by heavy equipment as slopes are formed.
h. After construction of the mound and slopes,operator will grade the mound for evenness
and then sow groundcover grasses per State guidelines.
L All other affected areas inside the permit area will be graded, levelled, and sown with
groundcover grasses.
j. Former sediment pond, which has been unused for several years, currently has full-
growth foliage and woods surrounding it. Foliage will remain and be maintained by the
owner.
k. Operator will leave a 12-ft wide dirt field path around the cleared and grassed area.
I. After reclamation,area will revert to a natural grassed area suitable for wildlife habitat.
