Reference: Havelock Drugstore Mine - Resubmittal
Dear Mr. Parr:
Please find attached the resubmitea for the above referenced project addressing comments
received on the September 26, 2023.Two (2) copies of the revised plan sheets & PJD are
attached. Responses will be noted in Green. Please review the following responses to
comments:
1. In your previous response you provided a land entry agreement for the easement along View
Nicholson Rd. However,this section of the road is still not shown within the mine permit
boundary. Please clearly indicate and label on the mine map that the haul road to the nearest
public road is included in the Mine permit boundary.
The permit boundary has been updated to include the additional acreage along the easement
access.The land entry agreement was signed by the easement holder since the easement
grantor would not sign.The updated plan sheets have been attached.
2. In your previous response you stated that a JD package was submitted on 3/22/23 and attached
with the submittal dated July 17,2023.No JD information was included in the submittal.You
have since provided the wetland JD form to this Department. However, comments from USACE
indicate that his package was never submitted to them. Please provide proof that you have
received a Jurisdictional Determination(JD) from the USACE for the wetlands.
The JD package was accidentally left out,of the hard copy submittal. We sent it via email , at
which time we realized the JD was not logged in.The JD submittal was submitted in September
2023. We resubmitted it in October and the Corp made a site visit in December and have been
waiting on the AJD since. We were told by them they couldn't issue the JD because there was a
legal case on the adjacent property that was owned by a different entity but still tied to the
same parent company. The PJD package has been attached and the AJD once received will
be sent under a separate cover.
