In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: I. Please clearly identify and label on the mine maps all owners of record to lands adjoining the permit boundary. The property owners adjoining the Longleaf Pine,LLC parcel are not labeled, and proof of notice has not been provided. Please provide notice as required in NCGS §74-50(bl). NCGS §74- 50(b)(1) defines "Land adjoining" as any parcel or tract of land that is not owned in whole or in part by, or that is not under the control of, the applicant or operator or any lessor, affiliate, parent, or subsidiary of the applicant or operator and that is contiguous to either: a. Any parcel or tract that includes the permitted area. b. Any parcels or tracts of land that are owned in whole or in part by or under the control of the applicant or operator or any lessor, affiliate, parent, or subsidiary of the applicant or operator and that,when combined, are contiguous to the permitted area. 2. Please verify that Item 12 of the additional information letter dated September 6,2023,requesting that you provide construction and maintenance details on the existing wetland crossings were addressed as part of a separate application submittal. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
