In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: 1. Please label the names of the Names of owners of record of all tracts of land adjoining the permit boundary, on the mine map. The mine maps provided only labeled the PIN and provided no table to cross reference the owners name with the PIN. Please be sure that this map shows the existing permitted boundary and the proposed boundary. If the boundary survey map is to be used as the adjoining landowner map,please be sure to verify that the names on the map match those owners notified. 2. Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining landowners and chief administrative officer of each county and municipality have been properly notified. Notice for SECKEL WILLIAM, and POWELL J DEWEY ESTATE was not provided. 3. The parcel labeled"Tract 3", on the boundary survey, across Altapass Hwy.,was previously included within the permit boundary,however it does not appear with the the permit boundary on the last revised set of maps. Please clarify if this parcel is proposed to be removed from the permit boundary. Please provide a mine map with the entire proposed permit boundary and account for all acreages in the acreage table. 4. Your response to that last request for additional information stated that there will be no explosives used for the activities described in the modification application. Please be advised that the application is requesting information that describes the activities for the entirety of the operation, not limited to the activities for the proposed changes. Please verify that there will be no blasting on site whatsoever. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
