This letter is in response to your request for further information on Mr. Hoggard's application for modification of his mining permit. Response to items in your request are as follows: 1. Structures within 300 ft of excavation-One residence located 218 ft from proposed excavation edge, with one outbuilding 238 ft and another outbuilding at 275 ft from proposed excavation edge. One groundwater well 260 ft from excavation edge is present at the residence. This residence belongs to the aunt of the applicant, Lee Hoggard, and is on Mr. Hoggard's property with his permission. Next closest outbuildings or residences are at 620' and 864'from excavation edge, respectively. Mine map at 1:200 scale showing all structures is enclosed with this letter. 2. Existing wells within 500 ft of excavation - One well located 260 ft from proposed excavation edge at residence described in #1 above. Groundwater well was drilled to 420 ft depth when residence was constructed in 2016. Well location is shown on 1:200 mine map enclosed. No other wells located within 500 ft of proposed excavation. 3. Puel tank or chemical storage locations - Updated 1:120 mine map enclosed showing locations of portable 500 gal. fuel storage tank and temporary office trailer. 4. Mitigation plan for potential groundwater impacts- No impacts are expected to residential groundwater supply well located 260 ft from proposed excavation edge. Depth of this well is 420 ft, with proposed maximum excavation depth of Lee Hoggard Mine to be 35 ft. However, in addition, the applicant is providing a performance guarantee to correct any problems with water supply wells within 1000 ft of excavation that might occur during periods of dewatering activity at the Lee Hoggard Mine, without charge to the satisfaction of the owner, including repair or replacement of the pump and/or replacement and installation of a new well. Copy of warranty enclosed. 5. County name on mine map - Updated and corrected mine map enclosed. 6. Geographic controls for mine permit boundary-Coordinates map enclosed showing latitude/longitude and bearing/distances for mine permit boundaries. 7. Permit boundary marks on site- Permit boundary of Lee Hoggard Mine has been marked with flags and PVC pipe. One mark in cultivated field will use geographic control to mark boundary. Two copies of all documents are enclosed with this letter. The warranty period will be as follows: Date starting: May 1, 2024 Date ending: May 1, 2034 Should any problems with operation of water supply wells located within 100 feet of the Lee Hoggard Mine occur during the specified warranty period, due to faulty workmanship or service, Lee Graham Hoggard will correct the problems,without charge, to the satisfaction of the owner. Correction of problems occurring will include repair or replacement of the pump and/or replacement and installation of a new well. Should any problems or complaints arise from use of dewatering activities at Lee Hoggard Mine, Lee Graham Hoggard will immediately cease and desist dewatering operations until all problems have been resolved.
