I did have a Teams meeting with Jerry and Shannon from the Mooresville Regional Office to discuss their comments on March 25, 2024. Additional Requested Comments: 1. Included is a separate map showing the outline of the property currently permitted by Lake Norman Quarry with the adjoining property owners as of March 2024 according to the Lincoln County GIS website. 2. The legend has been updated on the attached maps to properly reflect the colors used on the map for illustration. 3. Dark shading for berm has been added to legend. 4. Wetlands are shown on the site map. 5. Included is the documentation that was submitted to FEMA for the CLOMAR study that will reflect the floodplain information as requested. 6. Included is map EC-200 that reflects the proposed buffers off Forney Creek once the relocation has been completed. These buffers were approved by DWR and Army Corp of Engineers as part of their issuing the permits. 7. Included is a reclamation map. Comments from Mooresville Regional Office: 1. Legend has been updated on all maps to reflect the areas identified. 2. The acreage for disturbance is 26.60 acres. This is the amount of newly affected acreage. The 34.7 acres inside the LOD has some areas that have already been previously permitted in 2018. The total new acres to be disturbed is 26.60 acres. This is the area that will be under Conservation Easement once the project is completed. 3. The stream contours are different from the mine map. I have asked that NCDEQ look at the construction drawings for the stream relocation for further detail. The contours are 1' on the construction drawings. The mine map is 5' contours. The area shaded in hatched purple is to show the proposed stream relocation area and then to reference the construction drawings for more in depth detail. All erosion control that was is shown on the site map was previously permitted and installed as of the approved NCDEQ 2015 permit modification and prior. Some of the basins have been moved outside the LOD as shown on the"Forney Relocation Map" and will be reconstructed as needed to ensure proper BMP's are in place prior to construction of new stream channel. 5. An adequate construction sequence has been provided in the construction plans by DRG for the new stream construction and redirecting flow from old channel to new. 6. Buffers are shown on included map EC-200 after the completion of the new stream channel. 7. Calculations and basins that were approved in 2015 by NCDEQ will adequately handle any material that is stored in the temporary waste area. The waste area dimensions will change throughout the project as material will be stockpiled and then reused during the project. At the end of the project there will not be a waste pile. The area will be returned to natural grade and seeded according to the approved seeding plan by NCDEQ as shown on the details and listed in the mining permit. 8. The berms on the NW side of the map were permitted in 2018 by NCDEQ. 9. Seeding instructions are included in the construction plans by DRG that were recommended and approved by the Army Corp of Engineers. There is also a seeding plan approved by NCDEQ and shown on the details section of the plans. If additional seeding is required outside of the LOD then the seeding plan approved by NCDEQ in the mining application will be used. 10. The LOD line was approved by the Army Corp of Engineers. 11. The erosion control measures shown on the construction plans for Forney Creek are adequate. Silt fencing will be provided during construction and will separate the old and new channels. The construction phase will last approximately 6-months. Most of the questions by the Mooresville Regional Office were due to not knowing what was previously permitted versus what was being requested. I have included a map that shows what has been permitted prior to this request. The only modification request is the area for the stream relocation. Basins E, F, G, H, I, and J were constructed in 2015 as approved by NCDEQ. If during construction, it is determined that these basins need to be moved they will be reconstructed to the design parameters as already approved by NCDEQ. Basins 0, P, and Q have not been constructed but no disturbance activity as been conducted in the area. Basins 0,P, and Q were approved by NCDEQ as part of the 2018 modification request. The berm as shown above these basins has not been constructed. This area is fully vegetated.
