Raleigh, NC 27604 MINING PROGRAM RE: HOOPER HILL MINE RESPONSE TO ADDITIONAL INFORMATION Navassa, Brunswick Co., NC Dear Mr. Parr, On behalf of Jon Vincent and Acquisition NC, LLC,we are submitting a response to comments emailed March 19, 2024 for the above referenced proposed sand mine facility. 1. The updated application included with the response to the additional information request, states that no water will be discharged from the site (C.3.8) and that no dewatering will occur (C.3.C). Please clarify all your responses to question C.3 of the mine permit application. 2. Please clarify your intent to apply for an NPDES Stormwater Permit. 3. Please clarify your intent to register with the Division of Water Resources Groundwater Management Branch for the proposed dewatering. For Items 1-3,we will be dewatering onsite, but not offsite. The anticipated withdrawal rate will be 8000 GPD. No NCDWR registration is needed if the withdrawal rate is not over 100,00 GPD(§ 143-215.22H). (WWW.NCWATER.ORG) We also reached out to the Groundwater Branch and confirmed this to be the case. 4. Please clearly identify and label on the mine map the location of any proposed outfalls. Please clarify the location of the discharge point once the temporary basin is removed. • Added Sheet M-2.0 for initial erosion control phase 1 clearing with sediment basin. We revised the sequence of mining to make this clearer as well. 5. Please provide notice of application for all adjoining landowners. Proof of notice was not provided for the parcels owned by Melvin Hooper, and Melvin and Diane Hooper. • See copies of green card receipts. I N C. 6. The LOE and the 40' Excavation setback in the Northeast corner are not clear. It appears that the LOE is located within 10' of the permit boundary. • We have revised the LOE to match the 40-ft excavation setback in this corner. 7. The affected area table proposes 20.0 permitted acres of which 16.90 acres will be affected. There are no undisturbed buffers labeled on the mine map. Please clarify and provide an account for the unaccounted 3.1 acres. We have miscalculated the undisturbed area. Only 1.70 acres will be undisturbed buffers shown with the 10-ft perimeter buffer around the pit and along the entrance road. The un-excavated area has been corrected to 5.20 ac. There are a few properties that still have private wells for yard use or primary drinking water. However, the 350-ft offset from the property to the adjoiners is adequate clearance for any temporary surficial aquifer drawdown. Wells in this area are typical 135-ft or greater. There are no drinking water wells within 30-50-ft which is the depth of dewatering. D)If you answered yes to any of the above questions,provide evidence that you have applied for or obtained the appropriate water quality permit(s)(i.e.,non-discharge,NPDES,Stormwater,etc.)from the Stormwater Program.In addition,the applicant is required to register water use with the Division of Water Resources,Ground Water Management Branch,if the operation withdraws more than 10,000 gallons per day and needs a capacity use permit from the Division of Water Resources,Ground Water Management Branch,if the operation lies in a capacity use area and withdraws more than 100,000 gallons per day. 4.
