Dear Mr.Clayton:
CDM Smith Inc. (CDM Smith)is submitting this letter in response to the comments,dated December
21, 2023,regarding the mining permit modification for the Dare County Construction/Demolition
Landfill On-Site Borrow Pit(Mining Permit No.28-24).Division of Energy,Mineral and Land
Resources comments are provided in italics with CDM Smith responses immediately following.
1. Please verify that map C-2 replaces C-IA&C-1 R from your response to question C.33 of the mine
permit application.
CDM Smith's Response:
Response to 1.-The response to Section C.3.B.of the permit application should reference Sheet C-2-
Dewatering Plan instead of Sheets C-1A and C-1B.
2. Please confirm that adjoining landowners have been notified by submitting copies of the Certified
Mail green cards.
CDM Smith's Response:
Response to 2.- There is only one adjoining landowner(U.S.Department of the Interior-Fish
and Wildlife Service)that was notified by mail and e-mail.The Affidavit of Notification was not
sent by certified mail;however,confirmation of receipt was provided via e-mail.A copy of the e-
mail from Fish and Wildlife service was provided in Attachment D of the permit modification.
