Dear Mr. Pan-; Please find attached two copies of the mine pennit application and a review fee of$750,00. We would like to revise the blasting conditions in our mine pen-nit to remove Condition 9.M, which is related to removal of the muck pile prior to setting off another shot. This condition appears to be unique to this operation. The blasting conditions was added after a flyrock incident that occurred in the early 1990's. Since that period, there have been several changes to the site and the blasting technology that reduce the potential for flyrock incidents. We believe that the following items have reduced the potential for any flyrock incidents impacting the public. • The blasting at the site during the flyrock incident was conducted by a private contractor. Since that time, an internal blasting program was created along with updated drilling and blasting standards. Any contract drilling and blasting that occurs on site are held to these internal standards as well. All muck bound shots require further review approval from Area Manager/Drilling and Blasting Manager before loading. • The technology used for blasting has improved. Electronic detonators are utilized when necessary, allowing for greater control of muckpile heave. This allows us to create more relief within the timing schematic of the shot to account for any extra confinement. In addition, 2D profiling systems and even 31)profiling systems are available to our blasting engineers and all shots are required to have burden checked before loading. • The design of the shot patterns, detonation timing, and explosive loads are customized to the site conditions and will include consideration of muck pile against a working face. • The depth of Pit 1 is substantially deeper now and it is more difficult for stray flyrock to leave the site. Pit 2 is located father away from Galestown Road than Pit I and has fairly large screening berms between the pit and Galestown Road.
