Dear Mr.North:
We have reviewed the modification request your company submitted for the referenced mine site. In order for this
office to complete its review of the referenced project in accordance withN.C.G.S. §74-50 and§74-51 of the Mining
Act of 1971,please provide the additional or revised information in accordance with the following comments:
1. Please verify that the houses along Clint Mills Road are more than 300' from the excavation. Any
structures within 300' of the excavation should be clearly labeled on the mine map.
2. Please clearly indicate and label on the mine map all Erosion & Sediment control measures for the
future pit.
3. Please clearly indicate and label on the mine map any discharge points for the future pit.
4. Please clarify the intent to mine the future pit on the east side as part of the future pit.
5. Your application states that sequence for mining operation is included on the mine map, however no
notes of mining sequence are listed on the mine map.Please include a sequence for existing pit,stripped
areas and future pit.
6. They typical pit cross-section does not include a water level. Please provide a cross section of any
permanent bodies of water.
7. Please indicate and clearly label the location of any permanent roadways to remain on the reclamation
map.
8. The bridge over the White Oak River that connects your east and west operation is not shown on the
mine map. Please clearly indicate and label on the mine map this bridge and any permanent haul roads.
9. Please clarify why the berm along Hwy 58 S was not continued to the north around the proposed pit.

10. A berm was utilized in the existing pit to buffer from the White Oak River and wetlands. No berm has
been identified on the future pit to the south. Please clarify your reasoning not to berm adjacent to the
White Oak River and wetlands. Please clarify any additional measures to mitigate non permitted
disturbance.
11. Please Provide a symbol in the legend of the mine map for the cemeteries.
12. Please add a north arrow to the mine map.
13. Tailings and sediment pond acreage is listed at 12 acres on the table present on the mine map and is
shown with light-blue-hatching, but nothing is marked with blue hatching on the mine map. Please
identify the tailings and sediment ponds with the hatching used on the legend.
Please note, this office may request additional information, not included in this letter, as the mining application
review progresses. Be advised that our review cannot be completed until all of the items listed above have been
fully addressed.

As required by 15A NCAC 5B.0113,you are hereby advised that you have 180 days from the date of your receipt
of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request
additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot
be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be
made to grant or deny the mining permit based upon the information currently in the Department's files at the end
of the 180-day period.
Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the
additional information requested by this letter as soon as possible. Your prompt response will help us to complete
processing your application sooner.
