Describe in detail the sequence of events for the development and operation of the mine and reference the sequence to the mine map(s).Attach additional sheets as needed. -Obtain plan approval and all other applicable permits. •Repair&upgrade entrance road(as required). -Strip and stockpile any topsoil. •Construct&extend berms around excavation areas using stockpiled material. -install additional'Open Pir warning signs around perimeter of berms(as required). •Maintain all stormwater runoff to flow into excavated areas. -Excavation will begin In the southwest corner and will proceed from west to east in strips.When excavation reaches the eastern setback line,the activity will resume on the west side of a strip just north of the previous strip. •Temporary stockpile and processing areas vdU be placed Immediately adjacent to the area currently being excavated.As the excavation progresses, the stockpile areas wail be relocated as necessary to be just outside the current excavation.At no time vAa any stockpile or processing areas be outside the permitted area. -After excavation Is complete,temporary measures will be removed,side slopes graded per reclamation plan,and site re-vegetated per the permanent seeding specifications. 2. Describe specific erosion control measures to be installed prior to land disturbing activities and during mining to prevent offsite sedimentation(include speck plans for sediment and erosion control for mine excavation(s),waste piles,access/mine roads,and process areas),and give a detailed sequence of installation and schedule for maintenance of the measures.Locate and label all sediment and erosion control measures on the mine map(s)and provide typical cross-sectionskonstruction details of each measure.Engineering designs and calculations are required to justify the adequacy of any proposed measures. A haul road has been installed from SR 1128(Berry Lewis Road)to the mine entrance.The existing haul road will remain in place for the Phase 1 expansion.Stripped overburden will be pushed to the buffer line to create a +/-5'berm along the excavation.The berm also serves to divert sediment laden runoff into a sediment basin and/or the excavation. For Phase 2,stripped overburden will be pushed to the buffer line on the east to create a+/-5'berm along the eastern property/permit boundary.The haul road will then be relocated as shown in Phase 2.All stormwater runoff inside the berms will be directed to the western boundary which will be the lowest portion of the site.This area will serve as a sediment basin for the site. 3. A)Will the operation involve wash in the material mined,recycling process water,or other wastewater handling? FTES X NO If yes,briefly describe all such processes including any chemicals to be used. A)Will the operation involve crushing or any other air contaminant emissions? YES D NO If yes,indicate evidence that you have applied for or obtained an air quality permit issued by the Division of Air Quality or local governing body. B)How will dust from stockpiles,haul roads,etc.,be controlled? Dust will be controlled as needed by the use of water truck. A)A buffer will be required between any mining activity and any mining permit boundary or right-of-way.It may be an unexcavated buffer(no excavation,but roadways,berms,and erosion 8 sedimentation control measures may be installed within it),an undisturbed buffer(no disturbance within the buffer whatsoever),or a combination of the two, depending upon the site conditions.Note that all buffers must be located within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site?A minimum buffer of 25 feet is recommended,although a wider buffer may be needed depending on site conditions.Show all buffer locations and widths on the mine map(s). A 30' unexcavated buffer will be maintained around the perimeter of the mining operation as shown on the drawings. The buffer will contain a seeded or grassed berm composed of the striped overburden. Maximum side slopes on the berm will be 3H:1 V with a maximum height of 5'. After mining activity has ceased in a section of the mine, the material will be spread on the cut slope and the area seeded and stabilized. B)A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can be justified. Depending on site conditions,a buffer wider than 50 feet may be needed. How wide an undisturbed buffer will be maintained between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands at this site?Show all buffer locations and widths on the mine map(s). USGS topographic maps do not indicate the presence of any natural watercourse (blue lines)or wetland areas on the property. Big Swamp is located about 3,400 feet to the west of the site. Furthermore, the Lakeland (LaB) and Blanton (BnB)series soils, which make up 98 percent of the proposed mine site, are characterized as excessively drained, sandy soils which should significantly limit runoff from the site. 6. A)Describe methods to prevent landslide or slope instability adjacent to adjoining permit boundaries during mining. Minimum 2 horizontal to 1 vertical slopes or flatter for clayey material and minimum 3 horizontal to 1 vertical slopes or flatter for sandy material are generally required unless technical justification can be provided to allow steeper slopes. Excavation slopes are expected to be maintained at 3H:1 V. B)Provide a cross-section on the mine map(s)for all 0 slopes(berms,waste piles,overburden disposal areas,etc.), clearly indicating the intended side slope gradient,installation of any benches and/or slope drains(with supporting design information)if needed,and the method of final stabilization. Excavation slopes are expected to be maintained at 3HAV. D)In hardrock excavations,specify proposed bench widths and heights in feet.Provide cross-sections of the mine excavation clearly noting the angles of the cut slopes,widths of all safety benches and mine benches,and the expected maximum depth of the excavation. There is no hard rock excavation on this site. 7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling,house, public road,or public,commercial or industrial building from any mine excavation.Locate all such structures on the mine map if they are within 300 feet of any proposed excavation. See mine maps. Required berms, slopes, buffers, and signage will be maintained on this site. 8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area and when it will be implemented.Vegetated earthen berms,appropriate fencing and adequate boulder barriers may be acceptable high wall barricades.A construction detaillcross-section and location of each type of barricade to be used must be indicated on the mine map(s). Vegetated berms and buffers will be maintained at this site as well as required signage and gates. The existing fencing around the perimeter of the property will be utilized as much as possible. Cut slopes will not exceed 3H:1 V, so no highwall areas will be created by the mining operation. 9. Are M roducing minerals or soils present? YES M NO If yes,how will acid water pollution from the excavation,stockpiles,and waste areas be controlled? A)Describe specific plans(including a schedule of implementation)for screening the operation from public view such as maintaining or planting trees,bushes or other vegetation,building berms or other measures.Show the location of all visual screening on the mine map(s)and provide cross-sections through all proposed berms or proposed spacing, sizes and species for tree plantings. Vegetated earthen berms will be constructed at a height of 5' and maintained to screen the operation from the public. The permitted area is within an overall tract which is very remote such that there is no visibility from public roads. B)Could the operation have a significantly adverse effect on the purposes of a publicly owned park,forest,or recreation area?If so,how will such effects(i.e.,noise,visibility,etc.)be mitigated? No public parks or recreation areas are located near this site. 11. Will explosives be used? YES FX1 NO If yes,specify the types of explosive(s)and describe what precaution(s)will be used to prevent physical hazard to persons or neighboring property from flying rocks or excessive air blasts or ground vibrations.Depending on the mine's location to nearby structures,more detailed technical information may be required on the blasting program(such as a third-party blasting study).Locate the nearest offsite occupied structures)to the proposed excavations)on the mine map and indicate its approximate distance to the proposed excavation. 12. Will fuel tanks,solvents,or other chemical reagents be stored on-site? FIYES �NO If yes,describe these materials,how they will be stored and method of containment in case of spill.Indicate the location(s)of all storage facilities on the mine map(s). Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate the sequence and general methods to be used in reclaiming this land.This must include the method of reclamation of settling ponds and/or sediment control basins and the method of restoration or establishment of any permanent drainage channels to a condition minimizing erosion,siltation and other pollution. This information must be illustrated on a reclamation map and must correspond directly with the information provided on the mine map(s).In addition, design information,including typical cross-sections,of any permanent channels to be constructed as part of the reclamation plan and the locafion(s)of all permanent channels must be indicated on the reclamation map. Mine slopes will be reclaimed with slopes at 3H:1 V. The land shall be graded to prevent the collection of small pools that could become noxious or foul. Any stockpiles or wastepiles shall be leveled and smoothed. Perimeter berm soil shall be spread along cut slopes to provide a medium for vegetation. Disturbed areas shall be seeded and stabilized. Temporary sediment basins shall be removed and the surrounding area leveled and smoothed. 2. Is an excavated or impounded body of water to be left as part of the reclamation? FIYES FX]NO If yes,illustrate the location of the body(s)of water on the reclamation map and provide a scaled cross-section(s) through the proposed body(s)of water.The minimum water depth must be at least 4 feet,measured from the normal low water table elevation,unless information is provided to indicate that a shallower water body will be productive and beneficial at this site. Will the body(s)of water be stocked with fish? YES FINO If yes,specify species. NIA 3. Indicate the method(s)of reclamation of overburden,refuse,spoil banks or other such on-site mine waste areas, including specifications for benching and sloping.Final cross-sections and locations for such areas must be provided on the reclamation map. Berms, overburden, and spoil banks will be used to establish final slopes at 3H:1 V. There will be no waste areas left on site. 5. A)Describe reclamation of processing facilities,stockpile areas,and on-site roadways. Stockpiles will be removed and the entire area will be seeded and stabilized. All equipment will be removed from site. The stabilized roadway will remain in use to provide access. B)Will any on-site roadways be left as part of the reclamation? Describe the method of control of contaminants and disposal of scrap metal,junk machinery,cables,or other such waste products of mining.(Note definition of refuse in The Mining Act of 1971.) No off-site generated waste shall be disposed of on the mine site without prior written approval from the NC Department of Environmental Quality,Division of Energy,Mineral,and Land Resources and either the Division of Waste Management(DWM)or local governing body.If a disposal permit has been issued by DWM for the site,a copy of said permit must be attached to this application.All temporary and permanent refuse disposal areas must be clearly delineated on the mine map(s)and reclamation map,along with a list of items to be disposed in said areas. No scrap metal,junk machinery, or other mining waste products will be disposed of on-site. All scrap materials will be removed from this site and taken to a designated landfill. Describe your plan for revegetation or other surface treatment of the affected areas.This plan must include recommendations for year-round seeding,including the time of seeding and the amount and type of seed,fertilizer, lime and mulch per acre.The recommendations must include general seeding instructions for both permanent and temporary revegetation.Revegetation utilizing only tree plantings is not acceptable.Recommendations can be sought from: a. Authorized representatives of the local Soil and Water Conservation District; b. Authorized representatives of the NC Forest Service,Department of Agriculture and Consumer Services; c. Authorized county representatives of the North Carolina Cooperative Extension Service,specialists and research faculty with the Colleges of Agriculture and Life Sciences and Forest Resources at North Carolina State University; d. Revised September 21, 2021 Page 119 1 AGREEMENT State of North Carolina County of Bladen This contract and agreement made and entered into as of January 1, 2024 or when necessary regulatory permits have been obtained by the Contractor by and between Edward Ross Lewis and Penny Langston Lewis hereinafter called the"Owner" and Barnhill Contracting Company, 800 Tiffany Blvd.,Suite 200 Rocky Mount, N.C. 27804 hereinafter called the"Contractor". Mr. Edward Lewis and Ms. Penny Lewis are currently the sole owners of large parcels of property located at or near 4754 Berry Lewis Rd. in Bladen County, N.C. and each has the authority to execute all agreements concerning this property. WIT NESSETH: That the Contractor agrees to buy and the Owner agrees to sell certain soil materials(sand) to be used at the Contractor's asphalt plant and on various projects throughout Southeastern North Carolina. The property is located at or near 4754 Berry Lewis Rd. Bladenboro, North Carolina. This property is as shown on the drawing(Attachment "A"), attached hereto and made a part hereof. The permitted area will be +/- 64 acres in size and the boundaries are identified by the yellow shaded area on the attached map(Attachment "A"). It is understood and agreed that the Contractor will be responsible for obtaining all permits and complying with such in reference to mining and dewatering. The Owner shall remain responsible for all property taxes which may be due. The Contractor shall have sole rights to said property for mining for the duration of this agreement. The Contractor will adhere to all safety - 1 - 1 rules and regulations as required by OSHA and MSHA and any other regulatory agencies. Generally,the Contractor shall allow others in the pit only for hauling units and inspections. It is understood and agreed that the Contractor shall have full access to the sand mine by Berry Lewis Rd. as shown on the attached drawing (Attachment "A"). It is also understood and agreed that it is the Contractor's responsibility to grade and construct any access roads, gates or haul roads that may be needed,including any required culverts. Upon completion of the mining, the access roads and or haul roads will be removed, unless Owner requests otherwise,and returned to a condition which blends with adjacent topography, with all culverts which have been installed being removed or left at the Owner's request. The Contractor shall maintain exclusive rights for all soil excavated from within the pit until such time as the pit is exhausted and all reclamation is completed. The excavation depth will vary depending upon the location and depth of usable material and there is no limit upon the excavation depth should usable material be obtainable. However, the depth shall be limited by practicality and the Contractor is the sole judge thereof. It is also understood and agreed that the Contractor will begin mining operations on the Southwest end of the lease property unless unable to do so because of permit requirements or erosion control requirements.(See attachment"A") It is understood and agreed that the Contractor will pay the Owner$35 per cubic yard for all soil materials used in various projects in southeast N.C.removed from the property. An advance payment of Forty Thousand Dollars and no cents ($40,000.00) will be paid to owner by January 31, 2024, January 31, 2025 and January 31, 2026 of each of those years -2 No additional payment for cubic yards of sand material will be paid to owner in each of those three years until the total of cubic yards at $.75 per cubic yard of sand material removed by contractor equals to the $40,000.00 of the advance payment in each of those three years. There will be no pay for material used in access roads, slopes, haul roads, or stockpile areas. Payment to Owner will be by truck load count and paid on a monthly basis if material is removed from lease property during that month. Truck loads are based on 9 cubic yards per tandem, 10 cubic yards per tri-axle 1 1 cubic yards per quad and 12 cubic yards per quint and long trailers. It is also understood and agreed that topsoil or unsuitable overburden which is not usable but required to be removed from the excavated pit area will be used to construct the slopes of the proposed pit upon completion of the mining operation. All other unsuitable material and top soil will be stockpiled within the permitted area. This stockpile will be seeded and dressed to drain and will remain on the property if not needed by Contractor. Only materials leaving the site will be paid for. There will be no payment for topsoil and overburden that is used to dress the slopes. Final dressing of any slopes as well as seeding and erosion control per NCDENR permit specifications will be by the Contractor. All slopes will be final graded to 3 to 1 and should water be encountered, slopes below the water elevation would be graded at a 2 to I. It is also agreed that on certain projects, the Contractor may accumulate certain materials which may be brought back into the pit for dressing slopes and to fill areas as agreed to by the Owner and the Contractor. This material will consist of only clean inert structural and non-structural soil materials. No monies will be paid by the Contractor or deducted from the Owners payments for clean, inert earth materials brought to the pit. -3 Further, the Contractor shall indemnify and hold harmless the Owner for any and a I 1 damage, loss, cost, expense, fines, penalties or reasonable attorneys' fees incurred by Owner arising from any breach or violation of this Agreement or any use of this property by the Contractor, its agents, employees, sub-contractors, or independent contractors working under or through the Contractor, including all accidents or incidents and clean-up or remediation. It is further agreed that the Owner may be conducting work on this property during the term of this agreement and shall likewise indemnify and hold harmless the Contractor for any and all damage, loss, cost, expense or reasonable attorneys' fees incurred by the Contractor arising from any and all accidents or incidents which may occur on the mine site and easements by any reason caused by the Owner, it's agents, employees, sub-contractors,or independent contractors working under or through the Owner from the date of execution of this agreement until terminated as provided herein. The indemnity obligations set forth in the foregoing two paragraphs shall survive the termination of this Agreement. Contractor shall maintain general liability and umbrella insurance coverage in the amount of no less than $5,000,000, and shall name Owner as an additional insured. During the term of this Agreement, Contractor shall provide Owner with a current insurance certificate evidencing the required coverage. -4 It is further understood and agreed that this agreement is valid for a period of Fifteen (15) years and may only be modified by the Owner and Contractor in writing. This period of 15 years will commence January 1, 2024, the Effective Date or when all necessary regulatory permits have been obtained by the Contractor. This Agreement is contingent upon Contractor being able to acquire all required local, county, state and federal permits to operate this mine. The Contractor shall furnish the Owner a copy of the permits required for the mine operation. The agreement may be renewable after the 15 years with mutual agreement in writing by the Owner and Contractor. Contractor may not directly or indirectly assign or transfer any of its rights or obligations under this Agreement, including an assignment by operation of law or upon merger or transfer of control or a sub-license or sub-lease, without Owner's consent, which shall not be unreasonably withheld, delayed or conditioned, provided that Contractor provides Owner with evidence that the proposed assignee or transferee has comparable financial resources and history of responsible operations as Contractor.
