Dear Mr. Pressley:
We have reviewed the modification request your company submitted for the referenced mine site. In order for this
office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining
Act of 1971,please provide the additional or revised information in accordance with the following comments:
1. Please provide maintenance details for all Erosion and Sediment Control(E&SC)measures.
2. Please provide construction and maintenance details for the permanent sediment basins.
3. Please clearly indicate and label on the mine map all haul roads that will be utilized to access different
areas (plant, pit, office, shop, scales, maintenance for berms and basins, etc.). Please clearly indicate
and label any and all roads that will remain at the time of reclamation.
4. Please provide construction and maintenance details for the construction entrance off Fletcher Tutor
Rd.
5. Please clarify if you intend to maintain the existing entrance. If so,please clearly indicate and label on
the mine map that the affected area for the existing entrance road is included in the permit boundary.
6. Please provide a justification why the area near the entrance along Fletcher Tutor Rd. has a 50'
undisturbed buffer, where other areas are shown with a 100' or greater undisturbed buffer. Please
clarify the activities that will occur in the proposed 50' unexcavated buffer.
7. Please specify, and label on the mine map, the width of the undisturbed buffer around the proposed
western expansion.
8. Please provide details for activities around the cemetery located northwest of Tutor Stephens Road.
Please clarify if this area will be buffered and access maintained. Please clearly label any roads that
will be maintained to this area.
9. Please clarify what activities will occur on the south side of Fletcher Tutor Rd and what type of regular
traffic will occur across the road from the plant on the north.

10. Please clarify how access to the Kring property will be maintained and how inadvertent access to your
operations will be limited.
11. The referenced 401 (DWR:20061887v3)is not a correct project number,as it references unrelated 401
project. Please ensure that the 401 project number is correct.
12. A buffer determination is needed for this project. There are four features depicted on the NRCS Soil
Survey, which are not depicted on the maps provided. Please clearly indicate and label on the mine
map all wetland and water features. These features may be subject to the riparian buffer rules. In
addition,there appears to be surface water impacts from the proposed pit excavation.
Please note, this office may request additional information, not included in this letter as the mining application
review progresses. Be advised that our review cannot be completed until all of the items listed above have been
fully addressed.

As required by 15A NCAC 513.0113,you are hereby advised that you have 180 days from the date of your receipt
of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request
additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot
be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be
made to grant or deny the mining permit based upon the information currently in the Department's files at the end
of the 180-day period.
Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the
additional information requested by this letter as soon as possible. Your prompt response will help us to complete
processing your application sooner.
