Sawyer Mine Mining Permit No. 70-34 Pasquotank County Pasquotank River Basin Dear Mr. Williams: We have reviewed the modification request your company submitted for the referenced mine site. In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: 1. Please clearly indicate and label the Mine Permit Boundary all the way to the nearest public road. 2. Please clearly indicate and label on the mine map the properties with names of owners of record adjoining the entire mine permit boundary. This includes the properties adjoining the section of the mine permit boundary that includes the section of Sand Pit Road all the way to Pitts Chapel Road(SR 1169). 3. Please clearly indicate and label on the mine map all structures within 300 feet of any proposed excavation. There are structures that are located east of Sand Pit Road that do not appear on the Mine Map. 4. Please clearly indicate and label on the mine map the outline and acreage of all stockpile areas. 5. Please clearly indicate and label on the mine map the location of the 100-year floodplain. 6. If there are any mining activities that are proposed within the 100-year floodplain,please provide proof of notice and approval from the jurisdictional floodplain manager. 7. Please provide proof of right-of-way or access easement for access along Sand Pit Road. 8. Please provide proof of registration with the Division of Water Resources Groundwater Management Branch for dewatering activities. Please provide an Operation and Maintenance(O&M)plan for the pumping and dewatering activities. The O&M plan should provide details as to how the adjacent wetlands will be protected from the dewatering activities. 10. During a recent site inspection, it was noted that there is a drainage ditch installed in the 50' Right of Way setback along Sand Pit Rd. Please clearly indicate and label on the mine map any and all drainage ditches. 11. Please clearly indicate and label on the mine map all existing wells that lie within 500'of the excavation area. Please note, this office may request additional information not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
