Dear Mr. Parr:
The following responds, in chronological order, to the October 9, 2023 letter requesting
additional information.
1. It is requested not to conduct any survey for endangered species at the mine. This mine
has been active for more than 60 years, and the proposed modification includes an
additional 6 acres of land added to the permit. The proposed 6 acre impact is wooded at
this time. There was an intermittent stream that once passed north to south through the
mine, but this stream was excavated before the 1980's. The portion of the stream that has
not been impacted will have a 50 ft. undisturbed buffer. Berms have and/or will be
constructed to divert stormwater runoff away from the stream and towards the mine.
Caves or old underground mines,which can be habitat for tricolor bats, are not located near
the mine. The proposed 6 acre mine expansion is wooded and the Schweinitz's sunflower
is unlikely to grow in wooded areas.
2. We did not receive the return signed receipt for notification of Ms. Janis Hammill.
However, based on the tracking of the letter by the US Postal Service, Ms. Hammill
received the notification on July 13, 2022. Submitted is the USPS on-line tracking
information.
3. No water supply wells are within 500 ft. of the mine excavation.

4. A 100 ft. buffer is required by Cabarrus County between the property line and the proposed
new mine disturbance. The berm is for ensuring that the stormwater is diverted to the
existing mine. The existing trees will remain in-place except where the berms are installed.
5. There will be no high wall along the perimeter of the mine. Ground will be sloped at 2:1
(H:V).
