In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: I. N.C.G.S. §74-49 defines "affected land" as the surface are of land that is mined, the surface area of land associated with a mining activity so that soil is exposed to accelerated erosion,the surface area of land on which overburden and waste is deposited, and the surface area of land used for processing or treatment plant, stockpiles, nonpublic roads, and settling ponds. Please clearly indicate and label on the mine map that the haul road to the nearest public road is included in the Mine permit boundary. 2. Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining landowners and chief administrative officer of each county and municipality have been properly notified. 3. Please provide proof that the NOI for your NPDES permit has been submitted to the stormwater program. 4. Please indicate all current and proposed outfalls or discharges on the mine map. This should include processed wastewater and NPDES stormwater. 5. Please clearly indicate and label on the mine map whether the proposed buffer is unexcavated or undisturbed. Your responses in your application indicate that the buffer is proposed to be undisturbed, but the label has not been included on the mine map. 6. Please clarify the width of the proposed buffers. The response in the application states that there will be a 50' undisturbed buffer to all wetlands, however some buffers on the mine map are drawn a minimum of 40'. Also,please be advised that buffers to mining activity are regulated from within the Mine Permit Boundary. Please provide proof of easement or right of way for the proposed 30' access easement. 8. Please provide a pumping operation and maintenance(OM)plan for the proposed dewatering activities. 9. Please show all Erosion and Sediment Control(E&SC)measures on the mine map including diversion ditches to direct surface flow to basins. E&SC measures must be shown for all stages of operation including initial clearing and grading. 10. Please provide construction drawings and maintenance requirements for all E&SC measures including but not limited to silt fence, construction entrance, stilling basins, energy dissipators, etc. 11. Please provide additional details for E&SC measures and BMPs that will be installed to protect wetlands. Pits 1,2, and 3 appear to be sloped toward wetlands. 12. Please provide construction and maintenance details on the existing wetland crossings. Please clarify if these crossings will need to be improved. 13. Please provide construction and maintenance details for stilling basins used for dewatering. Please clearly indicate and label on the mine map the location of the basins. 14. Please clarify the location of the Mine Permit Boundary and the Limits of Excavation for Pit 3. 15. Please provide a wetlands delineation for the wetlands indicated on the mine map. 16. Please clearly indicate and label on the mine map the location of the haul road to access Pit 1 and Pit 4. 17. Please clarify the name of the mine. The application lists the name of the mine as "Hooper Road— Butler Tract Mines #145", however the mine map lists the name of the mine as Hooper Road Sand Mine 1 —5. Please provide the corrected pg. 1 of the application or the corrected mine maps. 18. Please indicate the name of the applicant on the mine maps. The application lists the applicant as Longleaf Pine Holdings, LLC, however the mine map lists the owner as Sawyer River Farms, LLC. Please provide the corrected pg. 1 of the application or the corrected mine maps. 19. Please indicate and label on the mine map the north arrow. Please note, this office may request additional information not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
