Dear Mr. Parr:
On behalf of Jason Deck, please see the below responses to your October 201h letter related to the Adger Mine
Mining Application. Our embedded responses are in Red below:
1.The Mine Permit boundary needs to be shown to include the area that you are proposing to operate in
the river. Please clearly identify and label on the Mine Map the mine permit boundary that encompasses
the entire operation. The mine map has been revised to show additional labeling for the on-shore mining
boundaries and the in-stream mining boundaries. Revised map is attached. Blue shading depicts the in-
stream mining boundary and the orange shading depicts the on-shore mine boundary. This revised map
is attached.
2. Please clarify how you propose to mitigate potential erosion from the outlet pipe from the settling
pond. The outlet pipe from the settling pond will discharge directly into the river with riprap placed
below the pipe to minimize any potential erosion.
It is not clear from the application details where the discharge point of the pipe is located. Map has been
revised to clarify pipe location.
3. Please provide proof you have submitted your application for the NPDES NCG052. Proof of this
submittal from the NCDEQ Permit tracking website and NCDEQ issuance of a permit number while the
application is being reviewed is attached.
4. Please provide proof you have submitted your application to the USACE. The USACE Applications have
already been approved and our approvals are attached.
5. Please clearly identify and label on the mine map the location of the fuel storage tanks. The diesel fuel
storage tank will be located adjacent to the plant and is now shown on the revised figure.
6. Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining
landowners and chief administrative officer of each county and municipality have been properly
notified. Proof of receipt in the form of certified mail receipts and or tracking information is attached.
7. Please clarify if you intend to use treatment additives (flocculant) in the settling pond. No flocculants
are currently planned for the pond.
