State Mining Engineer LAND QUALITY NCDEQ-DEMLR-Mining Section MINING PROGRAM 1612 Mail Service Center Raleigh,NC 27699-1612 RE: Lane Sand Mine NCDEQ Permit Application Stump Sound Township Onslow County Dear Mr.Parr, On behalf of Mr.James Lane and Mrs.Hilary Maready,we are submitting a letter addressing the review of the subject mine proposal from your emailed letter dated October 12,2023. 1. Please clarify if you intend to dewater from pit to pit. The Division of Water Resources (DWR) Groundwater Management Branch defines dewatering as"Dewatering occurs when aquifer water levels are depressed below the top of a confined aquifer or water table declines adversely impact the resource."If you intend to dewater from pit to pit,please clarify your response to C.3(C) and C.3(D) in the mine permit application. 0 Yes, revised application to dewater from pit to pit. 2. If you are dewatering from pit to pit,please clarify how your initial pit will be dewatered without pumping offsite. 0 The pits are large enough to handle the capacity of pumped discharge from other pits. If any discharge occurs outside of the pits, the overflow will remain onsite. No surface discharge will leave the property meaning there is sufficient space for the ground and any wetland areas to absorb any discharge. 3. If you are dewatering from pit to pit, please clearly indicate and label on the mine map the location of all existing wells that lie within 500 feet of the proposed excavation or clarify whether the dwellings indicated on the mine map are serviced by county or municipal water systems. 0 See revised application and the only neighbor with a well is not used for drinking water and it is over Soo-ft away. The County (ONWASA)provides drinking water mains in this area. + 21Page 4. It is unclear if a 401 certification is required. Please provide the completed determination of the PJD,so that DWR can determine if a 401 certification is required. 0 We had the USACE visit the property,but they have yet to provide a written jurisdictional or non-jurisdictional determination. Our wetland consultant anticipates there will be no jurisdictional wetlands on the property as there is no stream or body of water connection. The nearest surface water is about 0.5-1.0 mile downstream towards the Pilchers Branch watershed. 5. Please clearly label and identify on the map the location of the Mine Permit Boundary. 0 The boundary is the property boundaries owned by James and Hilary,specifically the i.1 and the 18.2 acre tracts on the mine map Cover Sheet. The property for the entrance road and the mine pit area are these two tracts. The boundary has been made bolder and labeled more on the maps for clarity. 6. N.C.G.S. §74-49 defines"affected land"as the surface are of land that is mined,the surface area of land associated with a mining activity so that soil is exposed to accelerated erosion,the surface area of land on which overburden and waste is deposited,and the surface area of land used for processing or treatment plant,stockpiles,nonpublic roads,and settling ponds. It appears that the haul road through Parcel 040866 is not included within the Mine Permit Boundary. Please clearly indicate and label on the mine map that the haul road to the nearest public road is included in the Mine Penn it Boundary. 0 No,the haul road to US 17 is included as stated above. 7. Please clearly identify and label on the mine map the location of the fuel tanks. 0 The fuel tank has been located on the mine maps near the shelter. 8. Please provide proof,such as copy of the signed return receipts from certified mail,that all adjoining landowners and chief administrative officer of each county and municipality have been properly notified. Please provide proof that George Deligne, State of NC Game lands,and the adjoining owner across HWY 17 (see §74-50(bl)(3)),have been properly notified. 0 We did mail those mailings to the neighbor Mr. Deligne,but his son lives in the house currently as the father has passed, and we didn't receive anything back from USPS or the son. We will reach out directly and/or through the USPS again with a certified letter. We did mail one to the local Camp Lejune fire station as finding the correct address for the base might be challenging. See attached receipt for Camp Lejune mailing. 9. Please clarify if the 50-ft county mine buffer is undisturbed or unexcavated. If unexcavated, please clarify the activity that will take place in the unexcavated buffer. 3 1 P a - e 0 The 50-ft county buffer is unexcavated. The only undisturbed buffers are the west and east property line adjoining properties as they are residential,and a 24-ft vegetated buffer is required. See Sheet CM-1 as the two labels for the 24-ft are described. The eastern boundary will remain wooded,but the western boundary will be planted and left undisturbed in places to establish the 24-ft zone. The affected areas are not counted in these areas. 10. Please clearly identify the buffers on the western side of the property as unexcavated or undisturbed. 0 Its undisturbed as it's a 24-ft vegetative buffer,but 50-ft before the excavation can take place. We have revised the 50-ft buffer to a setback and labeled it unexcavated. See responses above as well. We have applied to the DWR for the CCPCUA Permit as Onslow is one of the counties in the groundwater critical zone. Monthly and annual registrations will commence online at ncwater.org once pumping starts. Pumping will be from excavation area to another and not discharged offsite. No dewatering offsite will commence therefore no NPDES discharge permit is required. 4. A)Will the operation involve crushing or any other air contaminant emissions?
