Page & Sons, Carteret County Dear Mr. Parr; I am writing on behalf of Mr. William Page, W.A. Page & Sons, Inc., in response to your letter of August 31, 2023, requesting additional information on the above referenced Mining Permit Application. I will respond to each item in your letter in order, for clarity; 1. All known wells within 500 feet of the excavation are shown on the mine map. 2. The "sequence of mining operations" is actually quite simple. Since the property is already cleared, the mining will simply be excavation of the soil /sand. As indicated on the site plan, a perimeter berm will prevent any runoff. Any runoff from disturbed areas will naturally flow into the excavation, since it will be the lowest point. As the excavation extends below the water table, the saturated sand will be temporarily placed adjacent to the excavation to allow water to drain back into the mine. Dewatering is not necessary. If any part of the excavation extends below the water table, it will be excavated to a depth to assure that at least 4 feet of water remains in the excavation upon completion. 3. Please find attached the Wetlands Delineation by John Roberts, Ground Truth Soil Consulting, as well as confirmation by the U.S. Army Corps of Engineers 4. Please find attached the Deed of the property, clearly describing the entrance/ Haul Road access. 5. The 100 year Flood Plain is not within the Permitted Area. 6. The information requested has been added to Page 1 of the application form, attached. 7. The wetlands delineation, including crossings, were reviewed and approved by the US Army Corps of Engineers, and they did not require any modification of the existing crossings. 8. Sediment will not leave the permitted area because the "mining area' will always be the lowest point, and any runoff will remain in the disturbed area. The premise of the statement in your letter is incorrect; the previously mined area (outside of the new permitted area) is not a "pond", and it will not be "combined" with the new area. The new mining area was specifically designed to remain separate from the previously mined area. The new excavation will be sloped to keep any runoff from disturbed areas within the excavation. Topography in the stream buffer areas has been added to the site plan The premise of the statement in your letter is incorrect, there is no "existing pond" adjacent to the new mining area, and therefore, there will be no combination of ponds. The new excavation will be sloped to keep any runoff from disturbed areas within the excavation. The study area comprised approximately 14.8 acres. Ground Truth Soil Consulting, PLLC (Ground Truth)was obtained to delineate jurisdictional wetland features within the project study area. INVESTIGATION METHODOLOGY Ground Truth reviewed mapping resources that included United States Geologic Survey(USGS) 7.5-minute topographic quadrangle map, National Wetland Inventory(NWI) Mapping, NRCS Web Soil Survey, and LiDAR elevation imagery from the North Carolina Emergency Management(NCEM). The field survey was conducted in June 2023 by John C. Roberts, North Carolina Licensed Soil Scientist#1292 and Professional Wetland Scientist#2826. A jurisdictional delineation was performed using the three-parameter approach as prescribed in the 1987 US Army Corps of Engineers (USACE)Wetlands Delineation Manual (Environmental Laboratory 1987). The Regional Supplement to the Corps of Engineers Wetland Delineation Manual: Atlantic and Gulf Page Tract Jurisdictional Feature Delineation Ground Truth Job#23-173 1 September 15,2023 Coastal Plain Region (Version 2.0)was also utilized. Hydric soil determinations were made using Field Indicators of the Hydric Soils in the United States, Version 8.2 (2018). FINDINGS Jurisdictional 404 wetlands were identified and exhibited all three required parameters to meet jurisdictional 404 wetlands. Wetlands were positioned within concave, depressional, and linear landscapes. Areas of CAMA coastal vegetation wetlands were not observed in the study area. CONCLUSIONS The findings presented herein represent Ground Truth's professional opinion based on our Jurisdictional Feature Delineation. Jurisdictional 404 wetlands were delineated within the project study area. Concurrence of these findings was provided by Mr. Thomas Charles, USACE, in an email received on September 11, 2023. The concurrence email and JD packet submitted to USACE are appended. It is highly recommended that the verified wetland lines be survey located by a professional land surveyor. No site work is to be completed within delineated jurisdictional wetlands unless properly permitted. A Preliminary Jurisdictional Determination(PJD)provides an indication that there may be"waters of the United States" or"navigable waters of the United States"on a property.
