In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: 1. There is no well indicated on the map at the residence of Stanley Krieger east of the pit. Please verify that there is no well at that residence. 2. Please provide additional details on the sequence of mining operations. Please explain how you intend to mine below the water table without dewatering. 3. Please provide proof of wetlands delineation from John Roberts of Ground Truth Soil Consulting, and the confirmation by the US Army Corp of Engineers. 4. Please provide proof of easement or right of way for the haul road that crosses the property of Rronnie Weatherington. 5. Please clearly indicate and label on the mine map the 100 year flood plain limits. 6. Please provide the Applicant Contact Name, Mine office address, Mine Manager Name and contact information that was left blank on page 1 of the mine permit application. 7. Please clarify if there will be any upgrades or improvements required to the wetland crossings. 8. Please clarify how you will prevent sediment from leaving the permit area once the excavation area is combined with the existing pond to the south. Please clarify how you will prevent discharge from leaving the permit area. No topographic information was provided on the mine map. Please clarify if there are any low lying areas or discharge from the existing pond,that would then discharge from the permitted area once the ponds are combined. Please note, this office may request additional information not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. If you are unable to meet this deadline and wish to request additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
