Dear Mr. Williford:
We have reviewed the application your company submitted for the referenced mine site. In order for this office to
complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of
1971,please provide the additional or revised information in accordance with the following comments:
1. Please provide proof, such as copy of the signed return receipts from certified mail, that all adjoining
landowners and chief administrative officer of each county and municipality have been properly
notified. Please provide proof of notice for Julie Willaford and Donald Gene Riggs.
2. Please clearly indicate and label on the mine map the names of owners of record, both public and
private,of all tracts of land that are adjoining the mining permit boundary which lie directly across and
are contiguous to any highway, creek, stream, river, or other watercourse, railroad track, or utility or
other public right-of-way. If an adjoining tract is owned or leased by the applicant or is owned by the
lessor of the mine tract,names of owners of record of tracts adjoining these tracts,that are within 1,000
feet of the mining permit boundary, must be provided on the mine map(s).NOTE: "Highway"means
a road that has four lanes of travel or less and is not designated as an Interstate Highway. Please label
the properties for Julie Willaford and Donald Gene Riggs.
3. The existing wetlands crossing that has been used for timber and agriculture use will need to be
improved for mining or haul truck access. Please provide additional details including construction and
maintenance details for the wetlands crossing.
4. The response in the last letter stated that the USACE has not yet reviewed the delineation. Once the
delineation has been reviewed and please provide correspondence or a Jurisdictional Determination
(JD) from the USACE.
5. Please provide the pump size for pumping water to the basin.
6. You stated in your last response that the 30x60 basin is not an Erosion Control Structure,but rather a
dewatering structure to control the flow at the discharge point. Please clarify if there will be another
pond onsite to collect stormwater and groundwater to allow sediment to settle before pumping to the
settling basin. Please clarify if there will be pit to pit pumping utilized as part of the dewatering method.

As required by 15A NCAC 5B.0113,you are hereby advised that you have 180 days from the date of your receipt
of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request
additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot
be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be
made to grant or deny the mining permit based upon the information currently in the Department's files at the end
of the 180-day period.
Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the
additional information requested by this letter as soon as possible. Your prompt response will help us to complete
the processing of your application sooner.
