Please find attached the proper application, supporting documents and a check in the amount of$5,000.00 to cover the cost of review. Historically like several tracts in the Mitchell County, the Olerud tract has previously been mined for mica and feldspar by hand cobbing in the early part of the last century and later by heavy equipment. But for the Quartz Corp the value of the tract is it location near the Quartz Corp's mining operations. This makes the Olerud mine unique in that no excavation of economic ore will be hauled away from the mine to generate income but instead the site will be used as a overburden management area. The Quartz Corp believes that a mine permit issued by the State of North Carolina covers three important issues that a soil and erosion permit would not. 1. The mine permit requires a reclamation bond so if in the unlikely eventthat the Quartz Corp would go into bankruptcy the state would not have the economic burden of reclaiming the site. V Olerud Mine Cover letter page 2 2.The mine permit has a higher standard for Air, Land, storm water and waste water. 3.The development of the infrastructure of the mine, i.e.sediment and erosion controls and haul roads will require blasting, which naturally falls in a mine permit. To address the potential noise from mining activity the normal operating hours of the mine will be from daylight to dusk five days week with the occasional Saturday. Only in emergency will there be work at night or on Sundays. For the land owners who request it, a blasting notification by a third party phone service can be provided. This is a service that is currently being used at other Quartz Corp mines. The mine plan for the Duncan mine is as follows: 1. The development of infrastructure will be kept to the minimum. Focusing on sediment and erosion controls followed by haul road development. 2. The area cleared of trees and brush along with the stockpiling of topsoil will be based on the space needed for holding the estimated overburden generated by the mines in a year and half.The majority of the cleared vegetation will be \`We, mulched or chipped for use as cover on exposed area of overburden in the winter time. Stockpiling the topsoil will save energy and prove economical for cover dirt. Stockpiled topsoil will be roughed, seeded and the storage area surrounded with sediment fence for added control. Topsoil storage will always be located in an area that has planned controls installed. 3. The mine will be developed from the bottom up, in 40-foot lifts with 15-foot- wide benches,with 2:1 slopes between benches.This will aid in managing the areas of exposed materials (a 40-foot 2:1 slope versus a top end dump).Refer to the section in the permit labeled slope stability (Waste rock(overburden )Slope Stability Study for the Quartz Corp, October 1, 2020). 4. As the lifts are completed to the final grade, they will be stabilized by placing topsoil on them and if in the growing season, seeded.In the off growing seasons, a mulch cover or a thin layer of soil will be placed on the finished grade slope till the spring/fall growing seasons. These lifts are shown as Phases on the plans and a total of 21 phases are planned Olerud Mine Cover letter page 3 Blasting will only be done for the construction of controls and haul roads. Shot rock will be crushed on site for road gravel. The attached mine permit package includes all the required sections for a mine permit, it also contains one additional section,the fugitive dust control plan. This plan is based on a fugitive dust plan that has been implemented at another Quartz Corp mine.A SWPPP plan with a Notice of Intent(NOI) is also included in the Mine permit package to speed up the permitting process. To address slope stability and long-term geochemical effects from overburden the Quartz Corp had a third party geotechnical/geochemical firm evaluate the current overburden management to ensure design parameters for overburden design and long-term stability. This evaluation is attached and labeled "Waste rock (overburden )Slope Stability Study for the Quartz Corp, October 1, 2020" A soil and erosion plan for the entire life of mine (all 21 phases) has been is attached complete with maps, controls, calculations and drawings. Concrete boxes are planed at the start and end of all slope drains and other collection points.This is done because of the limited space. Other options such as energy dissipators would require too much space and allow water to flow on to the lower slope. Use of concrete boxes help eliminate the creation of rills and channeling. A nationwide permit has been applied for through the United States Army Corp of Engineers and a copy of the application is attached. The line of site section of the Olerud Mine permit shows that the Blue Ridge Parkway(federal), Mount Mitchell and Roan Mountain (state) and Riverside Park (local) are all visually screened from the mine. We believe the application and all supporting documentation are complete and correct and that the mine permit is a good solution for the tailing management at The Quartz Corp. Please note that only certain copies have calculations and certain mining information included so the application is Olerud Mine Cover letter page 4 not so large and bulky. Describe in detail the sequence of events for the development and operation of the mine and reference the sequence to the mine map(s).Attach additional sheets as needed. This mining operation(which is not what is typically defined as mining)will involve filling the mine site with overburden from a nearby mine.The site will be prepared for the overburden by placing soil and erosion control measures along the perimeter of the mining site as shown on the attached mine maps.Access roads supplied with ditches,culverts and associated sediment basins will be constructed in advance of the placement of any overburden materials. The placement of the overburden material will be done in phases, in lifts of 40 feet or less with seeding and stabilization of the slope concurant with the filling operation. Timbering of the site will be performed on an as needed basis a few acres at a time. all finished slopes will be graded at an angle of 2:1 or flatter. Additional control maesures may be added as the filling of the site progresses,but only after the submittal of plans and engineering calculations to you office. 2. Describe specific erosion control measures to be installed prior to land disturbing activities and during mining to prevent offsite sedimentation(include specific plans for sediment and erosion control for mine excavation(s),waste piles,access/mine roads,and process areas),and give a detailed sequence of installation and schedule for maintenance of the measures.Locate and label all sediment and erosion control measures on the mine map(s)and provide typical cross-sections/construction details of each measure.Engineering designs and calculations are required to justify the adequacy of any proposed measures. See attached mine maps and details for the soil and erosion control measures and their location. The calculations required for the controls are also attached and a summery of the control information is on the mine maps. All sediment basins are skimmer basins and diversion berms and ditches are are grass or rip rap lined. Sediment fence will be used during the initial startup phase of the mine and during the timbering untill other controls can be constructed. 3. A)Will the operation involve crushing or any other air contaminant emissions? MYES ]NO If yes,indicate evidence that you have applied for or obtained an air quality permit issued by the Division of Air Quality or local governing body. Crushing will only be performed if stone is encountered during construction of roadways and controls. See attached letter to the Asheville Regional Air Quality office concerning the use of mobile equipment. B)How will dust from stockpiles,haul roads,etc.,be controlled? Dusts from stockpiles, haulroads and fill areas will be controlled by the use of wet suppression and other methods needed to control fugitive emissions. A fugitive dust control plan will also be used and is attached. A)A buffer will be required between any mining activity and any mining permit boundary or right-of-way.It may be an L..•� unexcavated buffer(no excavation,but roadways,berms,and erosion 8 sedimentation control measures may be installed within it),an undisturbed buffer(no disturbance within the buffer whatsoever),or a combination of the two, depending upon the site conditions.Note that all buffers must be located within the mining permit boundaries. How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at this site?A minimum buffer of 25 feet is recommended,although a wider buffer may be needed depending on site conditions.Show all buffer locations and widths on the mine map(s). A minimum buffer of 25 feet will be maintained along the entire permit boundary. Most buffer will be 25-50 feet except where control structures, roadways and mine entrances are located. No mine excavations are planned only what is necessary for construction of controls and roadways. B)A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can be justified. Depending on site conditions,a buffer wider than 50 feet may be needed. How wide an undisturbed buffer will be maintained between any land disturbing activities within the mining permit boundaries and any natural watercourses and wetlands at this site?Show all buffer locations and widths on the mine map(s). A minimum undisturbed buffer of 50 foot will be maintained along all streams (except where permitted for disturbance by 401 and 404 permits). Emergency situations, although none exist, would be covered by the 10% of total run rule for trout streams. See attached maps for stream buffer locations. 6, A)Describe methods to prevent landslide or slope instability adjacent to adjoining permit boundaries during mining. Minimum 2 horizontal to 1 vertical slopes or flatter for clayey material and minimum 3 horizontal to 1 vertical slopes or flatter for sandy material are generally required unless technical justification can be provided to allow steeper slopes. The fill area will be graded and sloped to 2:1 or flatter and benched to prevent landslides. See attached Waste Rock (overburden) Slope Stability Study for the Quartz Corporation from October 1, 2020 (only included in Land Quality Copies). B)Provide a cross-section on the mine maps)for all fill slopes(berms,waste piles,overburden disposal areas,etc.), clearly indicating the intended side slope gradient,installation of any benches and/or slope drains(with supporting design information)if needed,and the method of final stabilization. There will be no high wall areas only the 2:1 fill slope areas. The site will be posted, gated and fenced as necessary to prevent access to the property. 9. A)Describe specific plans(including a schedule of implementation)for screening the operation from public view such as maintaining or planting trees,bushes or other vegetation,building berms or other measures.Show the location of all visual screening on the mine map(s)and provide cross-sections through all proposed berms or proposed spacing, sizes and species for tree plantings. The mine will be screened from the view of the local community by the buffer area and location in some areas and also by trees and natural vegetation. Because of the mine size,location and topography,total visual screening is impossible.Because the mine will be developed in phases, the screening of completed phases,can be accomplished by vegetation. The clearing of trees and other vegetation will be limited to only what is necessary to advance to the next phase area. B)Could the operation have a significantly adverse effect on the purposes of a publicly owned park,forest,or recreation area?If so,how will such effects(i.e.,noise,visibility,etc.)be mitigated? The Olerud Mine site is not located near any Federal State or local park. The mine cannot be seen from the Blue Ridge Parkway which is about six miles south of the mine on highway 226. The only noise from the mine site will be tuucks dellivering material to the site and equipment grading the site.Activities at the mine will be limited to daylight hours with exception for emergency situations. See attached line of sight from the Blue Ridge Parkway and other area parks. 11.
