Dear Mr. Parr,
On behalf of T. Farnell Shingleton,we are submitting a response to your certified letter mailed
7/11/23. Please find your comments listed below with our response provided in bold.
1. N.C.G.S. §74-49 defines"affected land"as the surface are of land that is mined,the surface
area of land associated with a mining activity so that soil is exposed to accelerated erosion,
the surface area of land on which overburden and waste is deposited, and the surface area
of land used for processing or treatment plant, stockpiles, nonpublic roads, and settling
ponds. Please clearly indicate and label on the mine map that the haul road to the nearest
public road is included in the Mine permit boundary. Please include any notes about road
maintenance from the previous modification on this map set.
o The Saps Road and Hoover Road intersection view is shown as it was on
previous map revisions. We just assumed the permit would have the
overall boundary lines on previous maps as this is just a minor
modification,but we added it to this revised Sheet M2. The note about
the maintenance of Saps Rd has been expanded on Sequencing Notes#2
as well.
2. Please clarify your response to C.3.B in the mine permit application where you state there
is no discharge to waters of the State. The current permit allows dewatering, and the 2021
Modification maps show an outfall from the existing mine excavation.
o The current permit allows dewatering,but the 2021 mine outfall has been
removed and reclaimed for the most part. Dewatering for this new Pit
C2 may or may not occur, but in the event it does,the water from the
new pit will be pumped into the existing Pit C adjacent to it.
3. Please clarify your response to C.3.13 in the mine permit application where you state
NPDES Permit issued previously. Please provide proof of existing NPDES permit or
provide proof of NOI for submission of a new permit.
o The NOI was submitted but we never received a response or permit from
the office. In the last correspondence,Trentt James says a permit was
issued under NCG020963. See attached email.
4. Please clearly indicate and label on the mine map the 100-year flood plain limits. If there
are any mining activities within the 100-year flood plain, please provide proof of
correspondence with the local jurisdictional flood plain manager.
o There are no Regulatory Floodplains on the mine permit boundary—all
411 acres. See attached FRIS Images for reference.
5. Please clarify the width of your undisturbed buffer. The application states that there will
be a 50' undisturbed buffer to wetlands, however the mine map shows a 30' undisturbed
buffer. It is not clear of the limits of the wetlands.
o Yes,there are 30-ft undisturbed buffers on this permit modification and
no 50-ft buffers to any wetlands in this acreage. We will provide a letter
from the wetland scientist saying no wetlands in this area,but he hasn't
scheduled a visit to date. We will provide the letter once complete. A JD
was provided for the last modification as it was along the drainage
ditch/creek.
6. Please provide a JD (Jurisdictional Determination) on the wetlands in the vicinity of the
mine excavation. Please clearly indicate and label on the mine map the location of the
wetlands.
o The wetlands were identified on previous mine maps,but none exist for
this modification as stated in#5 above.
7. Please clarify your response to C.3.0 in the mine permit application where you indicated
that your withdrawal rate is proposed at 6 gpd. This rate seems unreasonable given the
size of the operation.Please clarify your dewatering procedure.
o The form I have says 6000 gpd,not 6 gpd? The dewatering may or may
not occur,but in the event it does,the water from the new Pit will be
pumped into the existing Pit C adjacent to it.
8. Please provide a sequence of mining operations for the removal of the dike between the
two ponds.
o Oh,I think my hatching for the reclaimed lake is misleading. I meant to
keep two separate ponds or lakes shown with the road in between. See
revised Sheet M2.
9. Please clearly indicate and label on the mine map the location of the proposed flashboard
risers.
o This doesn't make sense—not showing any flashboard risers.
10.Please provide construction and maintenance details for the proposed flashboard risers.
o This doesn't make sense—not showing any flashboard risers.
Please find these responses satisfactory for the permit review. Any outstanding items can be discussed
via phone to expedite any reviews/approvals.

Can you look up in your system and see if Farnell Shingleton has an NPDES NCG02 Permit in the file anywhere? I don't

Dear Mr. Shingleton,
This correspondence is in reference to a 6.2-acre portion("subject area",see attachment)of your property,with
the parcel number 3284-35-5825-0000,at 904 Sapps Road, in Hampstead,Pender County,North Carolina.
Our firm was contacted to determine if there were any wetlands or waters of the U.S.present within the boundaries
of the parcel.After a thorough review of local soils and USGS topographic data, our firm conducted an on-site
evaluation of the property on August 14,2023,to determine the extent of wetlands or waters of the U.S.,utilizing
wetland criteria outlined in the United States Army Corps of Engineers (USACE) 1987 Corps of Engineers
Wetlands Delineation Manual (TR-Y-87-1) and the Regional Supplement to the Corps of Engineers Wetland
Delineation Manual: Atlantic and Gulf Coastal Plain Region (TR-10-20). After a complete inspection of the
subject area, it is our firm's opinion that there are no wetlands present within the subject area. However, we
strongly suggest getting final concurrence from the USACE.
