Our hope is to complete the process before any ground disturbing activity begins. However, each crossing being considered is distant in need, and rushing to secure permits two to three years before they are necessary limits Iluka's flexibility to avoid impacts and introduces uncertainty into project planning that could adversely impact returns on its investments. We understand and appreciate that all issues will be vetted thoroughly and that the process is both public and unpredictable. Therefore, a plan to move forward while respecting the process and regulations has been developed. Under this alternative the preliminary jurisdictional determination would be applied for and secured and the IP application would continue being developed. The concentrator facility, process water infrastructure, and up to two to three years of mining could be completed before stream, wetland, or riparian buffer impacts are necessary. The NC Department of Energy, Mining, and Land Resources (DEMLR)would review and permit the project. Sediment and Erosion Controls and Stormwater Management Plans are being developed. NPDES, Zoning, and other required approvals would be secured. The NC Division of Water Resources would review and approve riparian buffer compliance prior to any ground disturbance. Water required for the project will be sourced through a dual-supply system that will include purchase from Halifax County(through a metered connection to their distribution system) in combination with supply from a network of bedrock aquifer wells. Water lines from these wells may need to cross jurisdictional areas, but would be laid on the ground with no disturbance required. This email is being sent to both inform and to secure concurrence from ACOE that, if necessary, these actions would be in compliance Section 404 of the Clean Water Act.
