Leland,NC 28451 RE: Butler Mine—DRAFT Permit Pender County—Cape Fear River Basin Dear Mr. Labarbera: We have received the$119,800.00 Surety Bond No.2550023 issued by West Bend Mutual Insurance Company for the referenced mining operation. However, this surety document was not completed correctly. The name of the applicant on the surety is listed as Landsdown Corporation and the name of the applicant listed in the mine permit application information received by the Department July 10, 2023, is Landsdown Earth and Pipe, Inc. The applicant's name on the surety and the mine permit application must match. In addition,the name of the applicant on the surety documentation is not consistent throughout the document. The applicant's name on the second paragraph of page 1 lists the applicant's name,mine name,county,and river basin. This should show the applicant's name only. I am returning the surety documents so that they may be correctly completed. The permit cannot be issued until the required security has been received. No mining may be conducted until the permit is issued. N.C.G.S. §74-65 states that the issuance of a mining permit does not supersede or otherwise affect or prevent the enforcement of any zoning regulation or ordinance duly adopted by an incorporated city or county or by any agency or department of the State of North Carolina.
