State Mining Specialist NC Division of Energy, Mineral and Land Resources 512 N.Salisbury Street,5x'Floor Raleigh, North Carolina 27604 Re:Mine Permit 07-01 Modification Additional Adjacent Landowner Notification Proof and At-Grade Mine Crossing Information for Application Dear Mr. Miller: As a follow-up to my August 26 submission to you, enclosed are two copies of the remaining material demonstrating proof that two owners of six parcels of land adjoining the 07-01 permit boundary or that lie within 1,000 feet of the permit boundary but are adjacent to PCS Phosphate Company, Inc. (PCs) property were notified, per your letter of September 22,2021. Attached is documentation for the parcels in question. PCS Phosphate owns an undivided interest in tract#188, listed under James Thompson heirs, and has been solely responsible for payment of property tax bills for the parcel for some time;county tax bills from 2018-2021, a copy of the deed,and information from the county OPIS page are included. John W.Whitehurst,the owner of parcels 347-351, now resides in Germany and the address listed in OPTS was incomplete. After contacting the Beaufort Co.tax office for a more complete address, a notification packet was sent via DHL;tracking and proof of delivery are included. Additionally, instead of constructing an overpass on SR 33 just west of Aurora for haul truck traffic and pipelines to cross under connecting our existing mining operation on the north side of SR 33 to the proposed mining tract on the south side,we have decided that it will be an at-grade crossing for vehicles,and the mine pipelines will be jack and bored under the highway and the Norfolk-Southern railroad.Two sets of drawings are enclosed for your review as part of our active permit modification application.
