Furness PCS Phosphate Company, Inc 1530 NC Hwy 306 South Aurora,NC 27806 RE: Aurora Phosphate Mine Mining Permit No. 07-01 Beaufort Tar-Pamilco River Basin Dear Mr. Furness: We have reviewed the modification request your company submitted for the referenced mine site. In order for this office to complete its review of the referenced project in accordance with G.S. §74-50 and §74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: 1. The application states the Company wants to add 1,232 acres to the permitted and affected areas. When these amounts are added to the amounts listed in your current permit, the totals come to 17,744 permitted acres and 16,797.75 affected acres. Page 5 of the application states that the affected acreage will be 15,206 acres. DWG 1 states the Total mining area is 17,847 acres but does not state what the total affected area is. a. What are the correct amounts for permitted and affected areas? How were these amounts determined? b. Please supply a new DWG-I showing the correct amounts of permitted and affected areas. 2. Not all of the affected neighbors appear to have been notified.N.C.G.S. §74-50(b 1)(2)states: (bl) At the time of an application for a new mining permit or for a modification of a mining permit to add land to the permitted area, the applicant or operator shall make a reasonable effort,satisfactory to the Department, to notes (2) The owners of record of land adjoining that lies within 1,000 feet of the permit boundaries. Page 27 and page 28 of the application supplies a list of the people and where their property lies in relation to the expansion. The list is far from being complete. Furthermore,there are several properties shown on page 28 that do not state who owns them. a. Please supply a map(s) showing where the properties of the owners lie in relation to the permit boundary. It would also be helpful if the map(s) delineates where the 1000-feet outside of the permit boundary lines. c. If there are property owners on the new map(s) that you did not notify which are adjacent to the permit boundary, please explain why. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Be advised that our review cannot be completed until all of the items listed above have been fully addressed. In order to complete the processing of your application,please forward two(2)copies of the requested information to my attention at the following address: Division of Energy, Mineral and Land Resources Department of Environmental Quality 1612 Mail Service Center Raleigh,NC 27699-1612 As required by 15A NCAC 513.01 13, you are hereby advised that you have 180 days from the date of your receipt of this letter to submit all of the requested information. If you are unable to meet this deadline and wish to request additional time,you must submit information,in writing,to the Director clearly indicating why the deadline cannot be met and request that an extension of time be granted. If an extension of time is not granted, a decision will be made to grant or deny the mining permit based upon the information currently in the Department's files at the end of the 180-day period. Though the preceding statement cites the maximum time limit for your response,we encourage you to provide the additional information requested by this letter as soon as possible.
