3. Mine maps must be accurate and appropriately scaled drawings,aerial photographs,or enlarged topographic maps of
the entire mine site.All aspects of the mine site must be clearly labeled on the maps along with their
corresponding(approximate)acreage.Thus,all mine and reclamation maps must denote those activities that
are intended to be conducted during the life of the mining permit.All maps must be of a scale sufficient to clearly
illustrate the following,at a minimum:
a) Property lines of the tract or tracts of land on which the proposed mining activity is to be located including

C.PROTECTION OF NATURAL RESOURCES
1. Describe in detail the sequence of events for the development and operation of the mine and reference the sequence
to the mine map(s).Attach additional sheets as needed.
Overburden is stripped using excavators and/or trucks as needed. The sand and
gravel is mined and is transported to the existing processing plant using
excavators and haul trucks. The disturbed land is made to drain back to the pit
or to an approved erosion control structure. Mining proceeds as regulated under
the existing permit.
2. Describe specific erosion control measures to be installed prior to land disturbing activities and during mining to
prevent offsite sedimentation(include specific plans for sediment and erosion control for mine excavation(s),waste
piles,access/mine roads,and process areas),and give a detailed sequence of installation and schedule for
maintenance of the measures.Locate and label all sediment and erosion control measures on the mine map(s)and
provide typical cross-sections/construction details of each measure.Engineering designs and calculations are required
to justify the adequacy of any proposed measures.
Erosion control measures are noted in the attached Mine Map. These structures
are all designed according to the specifications shown in the Surface Mining
Manual distributed by the Land Quality Section. Details for all existing structures
have been submitted and approved through past submittals. Any new erosion
control structures as part of this renewal are detailed in the supporting
documents.
3. A)Will the operation involve washing the material mined,recycling process water,or other wastewater handling?

If yes,briefly describe all such processes including any chemicals to be used.
Mined sand and gravel is washed and sorted. Wash water is recycled through settling ponds. No chemicals are used in the process.
Water is also used for dust control at the facility.Water is used at the processing plants by introduction through sprays at crushers and at
conveyor transfer points to control dust emissions.It is also used in the water truck to control dust emanating from haul roads and stockpiles.
Water used in dust suppression is usually pulled from the settling ponds.
At the present time,no chemicals are used in any of these processes;however,there are times it is necessary to use DWQ approved flocculants
in the recycle system to help achieve a cleaner source of water for the plant washing and dust control.It may also become necessary to use
chemicals such as calcium chloride or organic surfactants on the haul roads and crusting agents on the stone product stockpiles
B)Will the operation involve discharging fresh or wastewater from the mine or plant as a point discharge to the waters
of the State?

We currently operate under the NPDES COC No. NCG020178 General Permit
that covers the discharge of excess groundwater from the pit de-watering
process, as well as any excess water from our closed circuit settling pond
system. Groundwater and storm water flow into existing on site ponds where it
ultimately discharges through NPDES discharge point 001.

The estimated withdrawl rate(0.9 MGD)is the average from 2022 for the entire site. Mine dewatering
will vary, based upon groundwater infiltration rate and mine operations. Sheet 10, provided,shows
the apparent private groundwater well houses located within 500 feet of the extent of the proposed
excavation area. The surrounding locale is served by a combination of private wells,as well as
county water along Covington Road and Byrds Mill Road.Additionally, as a condition of the Special
Use Permit,the property owners located between Covington Road and HW 217 have been placed
on a Well Protection Program(WPP).A copy of the WPP has been included with this application.
D)If you answered yes to any of the above questions,provide evidence that you have applied for or obtained the
appropriate water quality permit(s)(i.e.,non-discharge,NPDES,Stormwater,etc.)from the Stormwater Program.In
addition,the applicant is required to register water use with the Division of Water Resources,Ground Water
Management Branch,if the operation withdraws more than 10,000 gallons per day and needs a capacity use permit
from the Division of Water Resources,Ground Water Management Branch,if the operation lies in a capacity use area
and withdraws more than 100,000 gallons per day.
Elliott Sand & Gravel currently operates under the NPDES Stormwater Permit
COC No. NCG020178 that covers the pit discharges as well as the closed circuit
process water system. This site is not within a capacity use area. The Elliott
operation is registered with the Division of Water Resources, Facility ID:
0340-0007, and reports annual groundwater withdrawal data on an annual basis
(data due April 1, each year).
4. A)Will the operation involve crushing or any other air contaminant emissions?

Air Permit No. 04152R18 issued by the NC Division of Air Quality covers this
site.

A water truck is used to wet the haul roads and stockpiles as needed to control
fugitive emissions from these sources.

5. A)A buffer will be required between any mining activity and any mining permit boundary or right-of-way.It may be an
unexcavated buffer(no excavation,but roadways,berms,and erosion&sedimentation control measures may be
installed within it),an undisturbed buffer(no disturbance within the buffer whatsoever),or a combination of the two,
depending upon the site conditions.Note that all buffers must be located within the mining permit boundaries.
How wide a buffer will be maintained between any mining activity and any mining permit boundary or right-of-way at
this site?A minimum buffer of 25 feet is recommended,although a wider buffer may be needed depending on site
conditions.Show all buffer locations and widths on the mine map(s).
The buffer locations and widths are shown on the Mine Map and Details Page.
B)A minimum 50 foot wide undisturbed buffer will be required between any land disturbing activities within the mining
permit boundaries and any natural watercourses and wetlands unless smaller undisturbed buffers can be justified.
Depending on site conditions,a buffer wider than 50 feet may be needed.

A 50' wide buffer will be maintained between all wetlands located on the site. For
this submittal, the recent USACE Preliminary Jurisdictional Deterimination
(SAW-2022-00061) has been included to show the wetlands found on the
property to be added to the permit. These wetlands and buffers are shown on
the Mine Map.
6. A)Describe methods to prevent landslide or slope instability adjacent to adjoining permit boundaries during mining.
Minimum 2 horizontal to 1 vertical slopes or flatter for clayey material and minimum 3 horizontal to 1 vertical slopes or
flatter for sandy material are generally required unless technical justification can be provided to allow steeper slopes.
Excavated overburden faces will be left at a maximum slope of 3:1 (h:v) to
reduce instability. Slope stability will be maintained with backfilling of
overburden and re-vegetating exposed surfaces.
B)Provide a cross-section on the mine map(s)for all fill slopes(berms,waste piles,overburden disposal areas,etc.),
clearly indicating the intended side slope gradient,installation of any benches and/or slope drains(with supporting
design information)if needed,and the method of final stabilization.

Above the water elevations, excavation slopes of unconsolidated materials will
be 3:1 (h:v) or flatter. Below the water elevations, excavation slopes of
unconsolidated materials will be 1-1/2:1 (h:v).
D)In hardrock excavations,specify proposed bench widths and heights in feet.Provide cross-sections of the mine
excavation clearly noting the angles of the cut slopes, widths of all safety benches and mine benches,and the
expected maximum depth of the excavation.

7. Describe other methods to be taken during mining to prevent physical hazard to any neighboring dwelling,house,
public road,or public,commercial or industrial building from any mine excavation.Locate all such structures on the
mine map if they are within 300 feet of any proposed excavation.
A 50' un-excavated buffer will be maintained along the permit boundary. Pit
excavations slopes shall be 3:1 with a maximum excavation depth of 60 feet
below grade. The above mentioned measures should be sufficient to address
the concerns. Neighboring dwellings withing 300 feet are shown on the Mine
Map.
8. Describe what kind of barricade will be used to prevent inadvertent public access along any high wall area and when it
will be implemented.Vegetated earthen berms,appropriate fencing and adequate boulder barriers may be acceptable
high wall barricades.A construction detaillcross-section and location of each type of barricade to be used must be
indicated on the mine map(s).
Inadvertent public access to mining areas is prevented by vegetative buffers,
berms, and fencing where appropriate. Gates are maintained at all entrance
points.

The property is isolated and naturally screened by trees, etc for much of the
property boundary. The Stephenson property (subject of this modification) is
bordered by neighbors along one boundary. Along this boundary, we propose a
vegetated berm. Please see Mine Map and cross section D-D and K-K, sheet
X-2 for further details.
B)Could the operation have a significantly adverse effect on the purposes of a publicly owned park,forest,or

On-site storage of diesel fuel,gasoline,and various oils and greases is necessary to facilitate the operation of
various equipment needed to mine and process crushed stone aggregates.The bulk storage tanks for diesel fuel,
gasoline,and oils are approved aboveground storage tanks having concrete secondary containment.Any major
spill or leak from these tanks would be contained within the concrete containment structures.Greases and other
oils are stored in aboveground storage tanks and 55-gallon drums and are stored in a concrete containment
structure.An oil/water separator is located at the shop and servicing area to treat spent water from vehicle and
equipment washing.Used oil is collected from equipment and picked up for offsite recycling by properly certified
contractors.Empty oil and grease barrels are returned to the supplier or cleaned and placed into the metal scrap
bin for offsite recycling.The Elliott facility has a Spill Prevention Control&Countermeasures(SPCC)Plan that
requires monthly inspections of all bulk fuel and lube storage units.All employees are trained on a regular basis
in the proper handling of petroleum products,managing and cleaning of spills,and proper disposal of rags,
absorbent materials,and any contaminated soils.

D.RECLAMATION PLAN
1. Describe your intended plan for the final reclamation and subsequent use of all affected lands and indicate the
sequence and general methods to be used in reclaiming this land.This must include the method of reclamation of
settling ponds and/or sediment control basins and the method of restoration or establishment of any permanent
drainage channels to a condition minimizing erosion,siltation and other pollution. This information must be illustrated
on a reclamation map and must correspond directly with the information provided on the mine map(s).In addition,
design information,including typical cross-sections,of any permanent channels to be constructed as part of the
reclamation plan and the location(s)of all permanent channels must be indicated on the reclamation map.
The reclamation plan is to return the site to an open water area when operations
are terminated. The mined area will be a combination of discrete land and water
areas. The plant and stockpile areas will be reclaimed and seeded with grass.
All disturbed areas will be graded, scarified and re-vegetated in accordance with
the revegetation plan. The restored mine site could be utilized for water storage,
recreation, wildlife sanctuary or other uses. Please see the attached reclamation
drawings for further details.
2. Is an excavated or impounded body of water to be left as part of the reclamation?

If yes,illustrate the location of the body(s)of water on the reclamation map and provide a scaled cross-section(s)
through the proposed body(s)of water.The minimum water depth must be at least 4 feet,measured from the normal
low water table elevation,unless information is provided to indicate that a shallower water body will be productive and
beneficial at this site.

4. Indicate the method(s)of reclamation of overburden,refuse,spoil banks or other such on-site mine waste areas,
including specifications for benching and sloping.Final cross-sections and locations forsuch areas must be provided

Overburden, refuse, and spoil piles will be leveled with excavators and/or
bulldozers to produce a finished elevation several feet above the water table.
Slopes will be left at 3:1 (h:v) or flatter above the water and 1-1/2:1 (h:v) below
the water.

These areas will be graded, scarified and revegetated in accordance with the
attached schedule. Erosion control structures necessary for final reclamation

No off-site generated waste shall be disposed of on the mine site without prior written approval from the NC
Department of Environmental Quality,Division of Energy,Mineral,and Land Resources and either the Division
of Waste Management(DWM)or local governing body.If a disposal permit has been issued by DWM for the
site,a copy of said permit must be attached to this application.All temporary and permanent refuse disposal
areas must be clearly delineated on the mine map(s)and reclamation map,along with a list of items to be disposed in
said areas.
As previously approved, temporary scrap and used equipment storage areas
have been developed at this site. The scrap material and used equipment which
accumulate as a result of mining and processing activities are stored in these
areas until sold to an independent recycling contractor.
A scrap bin is maintained on site for disposal by recycling of small metal scrap.
Tires are recycled through the various tire suppliers.
