I will respond to each item in your letter in the same order for clarity: 1. The coordinates on the application were taken from the NCDEQ Mining Permit Database found on your website to be consistent with your information. This point was part of the original Mining Permit, however, that area has since been released. Coordinates have been added to the application page 1 that reflect the current mine office location. 2. According to Sampson County GIS data, there is less than 4 feet of topographic relief across the entire new mining area and therefore it is essentially flat. Therefore, there are no contours to show. It is important to note that stormwater is held within the mining area by the perimeter berm, which will notably be the highest relief in the disturbed area. It will be impossible for stormwater to leave the disturbed during a storm event. As noted in the narrative, stormwater is held within the mining area, and occasionally pumped into the previously mined areas (ponds) as needed. 3. The statement in your letter is incorrect. The "temporary dewatering basins" shown on the 2008 map were proposed to be built "if needed" during initial excavations, but they were never built. They do not exist, and are not needed now, so they were deleted from the mine plan. 4. The discharge point has been relocated to a confirmed location on the mine map. This point is about 8 feet above current water level in the previously mined area. It can only discharge if the water level in the previously mined area rises over 8 feet from current level. 5. The narrative statement on the mine map has been revised. 6. The site has been registered for several years with the Division of Water Resources for water withdrawal reporting. The registration number is 0823-0002 7. The buffer and mining limit has been shown for all mining areas. 8. A copy of the NOI for the NPDES Permit is attached. PO Box 429, GARNER, NC 27529 (919) 779-0017 page 2 Mr. Adam Parr 9. The buffer for the new area has been revised to be 50 feet undisturbed to comply with Sampson County requirements. 10. The current location of the fuel tanks are shown on the map. However, they are portable and are moved when necessary or convenient. 11. The plant area shown on the mine plan exactly corresponds to the most recent modification of this permit. Please note that the Affected Area Table combines Processing Area with Haul Roads. The 4.5 acre entry on the chart accurately reflects the combination of the 1 acre plant, and 3.5 acres of haul roads. 12. The current location of the stockpile area has been added to the mine plan. 13 & 14. Please find attached a new page 1 and Land Entry Agreement, signed by corporate officer and reflecting the legally registered address. 15. The property lines of adjoining property lines have been clarified as much as possible. 16. The property lines and permit boundaries are shown accurately. When the permit boundary and property lines correspond, they are so labeled. Please note that the properties for Black River Farms and Forks, LLC are very large tracts, nearly 3,000 acres. It is not within the scale of the mine map to show the property lines of these tracts as requested. 17. The new property is only on Forks LLC property, and it was assumed that the existing Land Entry Agreement for Black River Farms is still valid. However, a new Land Entry Agreement signed by the representative of Black River Farms is attached. 18. The map number was a typographical error. There is only one map sheet. 19. The Affected Area Table has been revised as requested. 20. Certified Mail Receipts for adjoining property owner notifications are attached. In addition, the mine map had been revised to show the latest information on wetlands and streams. The delineation was done by Wyatt Brown of Brown Environmental Group. In order for this office to complete its review of the referenced project in accordance with N.C.G.S. §74-50 and§74-51 of the Mining Act of 1971,please provide the additional or revised information in accordance with the following comments: 1. Please clarify the coordinates provided in the mine permit application. The coordinates listed are for a location 6,800 ft southeast of the existing operation. 2. Please provide topographic contours on the map so that the flow of stormwater can be evaluated. 3. Temporary dewatering basins shown on the last approved map dated June 3,2008,are still existing and should be shown on the new map submitted for this modification. 4. During a recent inspection by the Fayetteville Regional Office (FRO), it was noted that the location of the discharge point on the map is incorrect. The FRO measured a discharge point at Latitude,34.6160, Longitude,-78.2664. Please verify and correctly indicate and label on the mine map the location of the discharge point. 5. Please clarify the statement on the mine map that "the mine does not discharge any stormwater or groundwater." There is a statement in the application that states some water will need to be discharged. There is also an outfall listed on the mine map. 6. Please provide proof of registration with the Division of Water Resources Groundwater Management Branch for dewatering activities. The registration form may be obtained from the following link: ems://www.iicwater.or /g wwatr 7. Please clarify the buffer in the previously mined area in the southeast of the property. There is no buffer shown on the mine map and it is not clear where the excavation limits are in this area. 8. Please provide proof that the NOI for the NPDES Stormwater permit has been submitted. Please clarify your response to question 5a of the mine permit application. You've indicated a 50 ft buffer made up of 25 ft undisturbed and 15 ft unexcavated. 10. Please indicated and clearly label on the mine map the location of the fuel tanks on site. 11. Please clearly indicate and label on the mine map the location of the plant area. The current map only shows a plant area of roughly 1 acre. The affected area table shows an acreage of 4.5 acres. 12. Please clearly indicate and label on the mine map the location of the stockpile area. The affected area table shows an acreage of 3.0 acres;however this area is not identified on the mine map. 13. The application has not been signed by an officer of the company. Tony Harris is not listed as an officer or managing member of American Materials Company, LLC in the annual filings on the Secretary of State Website. An officer of the company will need to sign page 1 and the land entry agreement on page 19 of the application or provide proof that Tony Harris has signature authority for American Materials Company,LLC 14. Please clarify the address provided in the application under permanent address for receipt of official mail. The address provided in the application does not match the mailing or the registered address listed for American Materials Company,LLC on the Secretary of State Website. 15. Please clearly indicate and label on the mine map the location of adjoining landowner tracts. Names of adjoining landowners are shown on the map;however,no property lines are shown,and it is difficult to determine if all adjoining landowners have been listed. An adjoining property map may be submitted as a separate map. 16. Please clearly indicate and label on the mine map the property lines of the tract or tracts of land on which the proposed mining activity is to be located including easements and rights of way. The property boundaries and tracts for Black River Farms,and Forks,LLC do not appear on the mine map. 17. Please provide a land entry agreement for the tract of land owned by Black River Farm LLC. 18. Map sheets 2 and 3 were omitted from the application submission. Please provide Map sheets 2 of 3, and 3 of 3. 19. Please complete the affected area table. The proposed change to the total affected area and the proposed change to the total permitted area were omitted form the table. 20. Please provide proof, such as copy of the signed return receipts from certified mail,that all adjoining landowners and chief administrative officer of each county and municipality have been properly notified. Please note, this office may request additional information, not included in this letter, as the mining application review progresses. Background: The NPDES General Stormwater Permit for Mining (NCG020000)addresses impacts of mine dewatering wastewater pumping and discharge on surrounding areas, including potential impacts to wetlands. The NPDES Permit requires that the mine have a site specific plan for, 1)Groundwater monitoring strategies to demonstrate the effect of pumping, 2) Detailed plans to maintain the surrounding hydrology that protects the affected streams and wetlands, 3) Monitoring to demonstrate compliance, and 4)The pumping regime deemed necessary to protect affected streams and wetlands In order to develop these plans, detailed studies must be done to understand the site-specific parameters. First, any wetlands that may be potentially impacted must be delineated according to US Army Corps of Engineers criteria. Second, a study of potential impacts of groundwater levels must be conducted. This should include a detailed examination of soil types, permeability, and various zones of groundwater within the zone of influence. Third, based on the groundwater data, an assessment of potential impacts to the wetlands by mine dewatering should be estimated. Finally, based on the potential impact, a plan should be developed to limit as well as monitor the potential impacts to the wetlands. Site description: The Ivanhoe#2 Pit mine is located on Dr Kerr Road, west of Ivanhoe, NC It is located within the USGS Hydrologic Unit 03030006, Cape Fear River Basin. This mine has been in operation for over 20 years, and at this time new acreage is being added to the existing mine. Groundwater and stormwater are retained in the mining areas, and occasionally pumped from pit to pit. Since the water levels within the previously mined areas are several feet below natural ground surface, the water pumped into the ponds flows into the soil before discharging. Natural groundwater levels within the sand mine are within 2 to 8 feet of the surface. The sand deposit being mined is an alluvial and coastal deposit consisting of sediments, ranging from a silty fine to coarse grained sand. The excavation will be reclaimed as a pond. The Mine Plan as submitted for the Mining Permit Application is attached. Wetland description: The wetlands adjacent to the new mining area at Ivanhoe Pit#2 mine were delineated as part of the original mine permitting. The wetland area is confined to the western side of the new mining area. The wetland is broadly classified as a Freshwater Forested/Shrub Wetland. It is further classified as a Palustrine System, which includes all nontidal wetlands dominated by trees, shrubs, persistent emergents, emergent mosses or lichens. Surface water is present for extended periods especially early in the growing season but is absent by the end of the growing season in most years. The water table after flooding ceases is variable, extending from saturated to the surface to a water table well below the ground surface. Natural hydration of the wetlands is accomplished by regular flooding and natural fluctuation of the river, as well as natural surface drainage from rainfall. Pumping and mine dewatering: This sand deposit is typical of other deposits in this area. The groundwater table is several feet below the original ground surface, but above the total depth of the excavation. Therefore, some groundwater is occasionally pumped from the mining area. Goundwater and stormwater will be collected within a large sump area in the mined area. The dewatering pump intake floats on the surface of the collected water, preventing any sediment from leaving the mining area. Water is then pumped to previously mined areas, where the static water levels are several feet below natural ground level. This allows the pumped water to gradually infiltrate back into the near surface soils. With several feet of freeboard in the ponds, it will be virtually impossible for water to discharge from the site during normal operations. Impact of dewatering on adjacent wetlands: The wetlands that have been identified in the area of the sand mine are located within the lower elevation areas that are subject to occasional seasonal flooding. The natural hydration of the wetlands is accomplished by occasional flooding of the area, natural surface runoff, and rainfall, and not from the deeper groundwater found in the sand mine. Therefore, the mine dewatering will have no impact on adjacent wetlands. In addition, the water that is pumped from the mining area will indirectly flow into wetlands through the porous sand soils of the receiving ponds. Therefore, the dewatering activity will actually enhance the wetland environment, providing hydration even during dry periods. It is important to note that mining has been ongoing at this location for over 20 years, including occasional pumping and dewatering. There has been no impact to adjacent wetlands, and these areas have thrived. There is no reason to believe that this will change at this time. Monitoring: Based on the observed disconnection between the water within the mining area and the surrounding wetlands, it is anticipated that any potential dewatering at this mine will have no impact on the adjacent wetlands. In order to confirm that there is no impact to the wetlands, a monitoring plan should be established as a precaution. 1. Any discharges should be quantitatively and qualitatively monitored according to requirements of the NPDES permit. See the "Monitoring Requirements" in the Stormwater Pollution Prevention Plan. 2. The Discharge Point should be examined weekly to make sure that it is functioning as designed and that no sediment has discharged into the adjacent wetlands. 3. A written record shall be kept of pumping times and rates. A record of rainfall shall also be kept in the Stormwater Pollution Prevention Plan. 5. The wetland vegetation should be inspected at least quarterly. If any vegetation appears to be distressed, an investigation should be conducted to determine the cause.
